Law Firm Overview Free Consultation

James L. Arruebarrena, LLC has been providing quality representation for clients since 1993. The firm represents environmental whistleblowers who report illegal disposal and dumping of toxic waste, as well as employees who are harassed or discharged due to prohibited discrimination (such as for race, gender, age, disability, etc.) and complaining about discrimination. We also represent accident victims and families suffering from the wrongful death of a loved one.

Many employers, motorists, property owners, product manufacturers and other negligent parties have knowledgeable attorneys working directly for them, or on retainer, to represent them. They are often backed by large insurance companies that are reluctant to offer fair compensation.

Mr. Arruebarrena meets one-on-one with each client, evaluates the issue and prepares the evidence and the case for trial. He assembles the right team of experts and interviews the right people to establish wrongdoing and the extent of the emotional and financial damages caused by the wrongful termination or serious injury. As a result of his experience, skill and commitment to obtaining the best possible results, we have helped several clients get their jobs back or recover financial compensation for their suffering.

Practice Areas

Practice Areas Description

*Employment Law

- Employee Rights

New Orleans employee rights lawyer James Arruebarrena helps employees obtain the fair and just compensation they deserve from employee harassment claims to retaliatory discharge (firing) claims. He is a dedicated advocate who fights for employee rights. Our firm's practice is focused on assisting employees who have been injured mentally, emotionally and financially due to an employer's wrongdoing.

- Wrongful Discharge and Discrimination

Located in New Orleans, attorney James Arruebarrena has been representing employees throughout Louisiana who have been discriminated against in the workplace, in violation of Louisiana and federal law (including Title VII). Unfortunately, unfair treatment alone does not always equate to discrimination. To have a case, you have to show that something unfair happened because of a prohibited reason (i.e. race, gender, age, or disability). Mr. Arruebarrena will personally evaluate your case to determine if you have a case.

- Age Discrimination

Employers with 20 or more employees are prohibited by the Age Discrimination in Employment Act and other laws from discriminating against someone due to their age. Mr. Arruebarrena has more than 17 years experience representing clients in age discrimination claims. He understands the laws and the litigation experience to protect our clients' employee rights.

- Disability Discrimination

Located in New Orleans, disability discrimination lawyer James Arruebarrena assists employees with disabilities throughout Louisiana who have been discriminated against by their employer or denied a job because of their disability. Disability discrimination is primarily covered by the Americans with Disabilities Act (ADA), which prohibits discrimination against people with disabilities. The ADA also guarantees equal opportunities for individuals with disabilities in employment, and public accommodations.

- Disability Accommodations

The Americans with Disabilities Act (ADA) prohibits discrimination on the basis of a disability and requires employers to make a reasonable accommodation for the disabled or handicapped individual. What constitutes a reasonable accommodation is dependant on many factors, but generally it is defined by the Equal Employment Opportunity Commission (EEOC) as an accommodation that would not impose an undue hardship on the employer's business.

- Gender Discrimination

Gender discrimination (also called sex discrimination) is prohibited by state and federal law. Title VII and Louisiana statutes prohibit employers from discriminating against employees or treating employees in a discriminatory manner because of their gender. Discriminatory treatment includes unequal pay based on gender (typically unequal pay for women) and disparate treatment for pregnancy (pregnancy discrimination) or taking medical leave under FMLA. In addition, you cannot be fired or denied employment because of your gender.

- National Origin Discrimination

State and federal law prohibits employers from discriminating or retaliating against an employee based on their national origin or country of birth. This includes treating someone in a discriminatory manner because of their dress, customs and beliefs in accordance with their national origin.

- Pregnancy Discrimination

Located in New Orleans, gender discrimination lawyer James Arruebarrena helps women throughout Louisiana who are discriminated against by their employer or denied a job because of their pregnancy or taking advantage of FMLA benefits. Title VII and the Louisiana sex discrimination laws were recently amended to include protection for pregnant women against disparate treatment because of their pregnancy. Mr. Arruebarrena has been representing Louisiana clients in gender discrimination claims since 1993.

- Racial Discrimination

Employment discrimination is prohibited by state and federal law. Title VII prohibits employers from discriminating against employees or treating employees in a discriminatory manner because of their race. In addition, you cannot be passed over for promotion, denied benefits, or denied work assignments because of your race. You also cannot be discharged or denied employment because of your race.

- Religious Discrimination

State and federal laws, including Title VII of the Civil Rights Act of 1964, prohibit religious discrimination. These laws make it illegal for employers to fail to hire, fail to promote, wrongfully terminate, harass or retaliate against employees based on their religious affiliations.

- Title 7 Discrimination Claims

Title VII of the Civil Rights Act of 1964 makes it unlawful for employers to discriminate against a person based on race, sex, color, religion or national origin. If an employer failed to hire, failed to promote, wrongfully discharged or otherwise treated you unfairly because of any of these factors, you have the right to file a claim.

- Environmental Whistleblower and Qui Tam

In an effort to curb company wrongdoing and fraud against taxpayers and the government, whistleblower laws were introduced that reward individuals (typically employees) for reporting wrongful conduct and bringing a lawsuit on behalf of the government for fraudulent or harmful conduct. An individual files a claim against a company for wrongdoing or fraud (blowing the whistle), on behalf of the government, and then share in proceeds from the recovery.

- Employee Harassment

Located in New Orleans, employment harassment lawyer James Arruebarrena has over a decade of experience handling sexual harassment and other types of harassment claims on behalf of employees.

- Sexual Harassment

Located in New Orleans, Louisiana, sexual harassment attorney James Arruebarrena represents employees who have been sexually harassed in the workplace or who have been fired for complaining about sexual harassment.

- Wage and Hour Law

Louisiana wage and hour laws can be difficult to understand. Having an experienced employment law lawyer, such as James Arruebarrena, on your side can be helpful. He has been representing employees since 1993 and has a full understanding of the wage and hour laws in this state.

- FMLA

Under the terms of the Family and Medical Leave Act (FMLA) of 1993, employees that fit certain qualifications are able to take leave in order to tend to personal and family matters. Unfortunately, some employers look down upon employees that take FMLA, even though it is their right

- At Will Employee Discrimination

Most states across the U.S. are at will employment states, including Louisiana. Though Louisiana is an "at-will" employment state, there are specific responsibilities with which an employer is charged under the employment laws of the state. Many employees do not understand that they still have rights in the workplace as at-will employees. Regardless of your employment status, you may still have a case if you can provide proof that there was a prohibited motivation behind your termination or treatment in the workplace.

*Personal Injury

- Car Accident Lawyer

A car wreck can change your life in an instant. If you were injured you have to deal with the pain and medical treatments. You have to worry about money and whether you will be able to return to work. If someone close to you was killed in a fatal car accident, you may have to deal with confusing legal and economic issues as you grieve your loss of love and support. On top of all of this, you may have to deal with the insurance companies - unless you work with an accident lawyer who can take care of the paperwork and details for you.

- 18-Wheeler Accidents

A passenger car is no match for an 18 wheeler, which can weigh up to 80,000 pounds when fully loaded. In a truck accident, occupants of the smaller vehicle are likely to suffer catastrophic or fatal injuries. For that reason, Louisiana and federal transportation regulations hold semi truck drivers and commercial trucking companies to a high standard of care.

- Motorcycle Accident

Motorcyclists are among the most vulnerable travelers on the highway. Often they are not even seen by the drivers that hit them or force them off the road. Motorcycles are unstable, and it is actually more difficult for a biker to navigate debris or unsafe roads than for the driver of an automobile. When a motorcycle accident does occur, the rider and, if there is one, passenger, often suffer serious injuries, including brain, neck, and spinal cord damage, and broken shoulders and knees.

- Admiralty & Maritime Law

Workers and travelers on the Gulf of Mexico and the waterways that feed it are exposed to a wide variety of hazards. Pilots on cruise ships and drill operators on barges, employees being transferred by helicopter or crew boat, commercial divers, and fishermen on pogie boats, tugs, and platform rigs, if injured in maritime accidents, are covered by admiralty law. Lawyers at our New Orleans personal injury firm, James L. Arruebarrena, L.L.C., assist seamen and dock workers in recovering compensation for injuries suffered in harbor, on rivers and lakes, or at sea.

- Offshore Injury Claims

Insurance companies intend to pay as little as possible for offshore injury claims. If you or a member of your family was injured while working on a fixed platform or a vessel, it is important to explore all possible sources of compensation. Depending on the circumstances of your injury, you may be entitled to more than one claim. Each claim must then be carefully evaluated to see that you receive the maximum compensation you deserve.

- Product Liability

New and poorly manufactured products are rushed to market by corporations that value profits over people, sometimes in the face of clear evidence that product are dangerous. At our New Orleans law firm we are committed to protecting consumers through product liability claims. Lead attorney Jim Arruebarrena has the experience and the resources to effectively handle individual and class action claims on behalf of our clients.

- Auto Defect

An automobile that cost $25,000 should not spontaneously burst into flames. A motorist should not worry about tread separation and a blowout at high speeds caused by a defective tire. A factory-equipped mini-van or SUV should be stable, and resist rollover in normal situations. Rigorous crashworthiness tests should be performed before cars and trucks go to market, and design changes should be made before the vehicles go to market.

- Medical Malpractice

We entrust our lives and those of our families to medical professionals, individuals highly esteemed within our community. When doctors, dentists, hospitals, nursing homes or other medical providers make mistakes, their patient's health and lives are at risk.

- Premises Liability

Whether a property is public, commercial, or private, the owner or manager is responsible for maintaining it in a reasonably safe condition. Spills in grocery store aisles should be cleaned up promptly, hazardous sidewalks should be repaired, swimming pools should be properly supervised, and adequate security should be provided in apartment buildings, office complexes, parking lots, and stairwells.

- Catastrophic Injury

At James L. Arruebarrena, L.L.C., leading Louisiana personal injury attorney Jim Arruebarrena has fifteen years of experience successfully battling insurance companies and defense lawyers in serious personal injury claims. He knows what it takes to obtain the best result possible in all types of cases, including slip and fall accidents, motor vehicle accidents and medical malpractice claims.

- Wrongful Death

During this difficult time, when you are dealing with the medical bills, legal arrangements, and learning how to go on, you will have to make a decision about seeking financial compensation through a wrongful death claim. Attorney Jim Arruebarrena, lead counsel at our New Orleans firm, will work through the question with you, offering advice which is both practical and sensitive. As an experienced personal injury attorney he will be able to evaluate the value of your potential claim, and tell you frankly whether you are being treated fairly.
