Practice Areas
Practice Areas Description
Jean Galloway Ball, P.L.C has built a reputation for providing highly customized legal services to help our clients address immediate needs and achieve long-term goals, including:- Estate Planning
At the Fairfax law firm of Jean Galloway Ball, PLC, our attorneys handle difficult issues such as contested wills and estates and estate planning in second marriages with sensitivity and diplomacy. The experienced legal team at our firm helps clients realize their goals and protect their loved ones, using documents such as: Last Will and Testament; Financial or medical power of attorney; Advance medical directives and living wills; Revocable Trust and irrevocable Trust, including life insurance and living trusts; Special needs Trust for disabled children; Trusts for minor children or grandchildren; Pet Trusts. In the documents we prepare for our clients, we minimize potential estate tax liability through smart estate tax planning. For families with young children, we address guardianship and inheritance management issues.
- Life Care Planning
Our attorneys work with the elderly and their families to plan for the time when it becomes necessary to seek help and to address important concerns when that time arrives. When a client comes to us because an aging parent can no longer live alone without help, the first question we often ask is whether there are sufficient assets to pay for home health care or for high-quality assisted living or nursing home care. If not, the next step is to create a plan for preserving assets while allowing the parent to qualify for Medicaid. We can advise you on other government benefits, like Veteran's Aid and Attendance. Another important consideration is whether your loved one is married or not. We can help you set up a life care plan that provides for your loved one's spouse and preserves the assets of the estate, whenever it is possible and practical to do so.
- Special Needs Planning
When a child turns 18, he or she is considered an adult under the law, regardless of capacity. We can assist parents of children with special needs to draft medical and financial powers of attorney or establish guardianship and conservatorship so that the parents or a trusted individual can help make the important decisions for the disabled adult. As part of our comprehensive special needs planning services, we will discuss eligibility for Supplemental Security Income (SSI), Medicaid, and other government benefits that may be available to your disabled loved one. We will help you plan your estate using a special needs Trust so the assets your child inherits can pay for goods and services not covered by government programs. We can assist in structuring personal injury and medical malpractice settlements to protect eligibility for government assistance.
