Our practice includes:- Divorce
A divorce case is initiated in New Jersey when one party files a Complaint for Divorce with the Court. The most frequently used ground for divorce in New Jersey is irreconcilable differences lasting at least six months. After the filed Complaint for Divorce is received from the Court, it must then be served upon the other party, who in turn must file a responsive document with the Court. Given the emotionally charged nature of divorce work, as well as the complexity of the issues sometimes presented, New Jersey divorce practice can be quite challenging. Frequently, prospective clients have no real understanding of what their rights or obligations may be or how the process itself unfolds. Attorney Jeffrey Brown has extensive experience in representing clients in matters involving divorce.
- Child Support
In divorce cases where there are children, child support will need to be set. In New Jersey, child support is determined in the vast majority of cases by utilizing a formula better known as the New Jersey Child Support Guidelines. The Child Support Guidelines take into account the number of children and the incomes of the mother and father, as well as various other factors, including the cost of any work-related child care which is being paid, any previous child support orders in effect, mandatory pension contributions, any alimony which is being paid or received, and so forth. The Child Support Guidelines also take into account the number of overnight visits the non-custodial parent receives with the children. If you have a child support matter, Jeffrey R. - Child Custody
Child custody and visitation are among the most emotionally charges issues facing couples during the divorce process. The reality, however, is that most visitation and custody disputes are resolved (sooner or later) by agreement between the parties and without the necessity of a trial. In determining custody, whether in a divorce case or in the case of two unmarried parents, the New Jersey Courts are guided by a variety of factors set forth in N.J.S.A. 9:2-4c, including the parents ability to agree and communicate with each other, the stability of the home environment offered, the needs of the child, the fitness and geographic proximity of the parents, the preference of the child when of sufficient age so as to reason, the extent and quality of the time spent with the child prior to or subsequent to the separation, the age and number of children, the employment responsibilities of the parents, and the history of any domestic violence.
- Municipal Court
The Municipal Courts in New Jersey hear matters such as motor vehicle and traffic violations, quasi-criminal offenses (i.e. disorderly and petty disorderly persons offenses), and municipal ordinance violations. The vast majority of cases, however, are those involving motor vehicle or traffic violations. Most often, a potential client contacts an attorney after receiving a ticket in the hope that the attorney can successfully reduce the original charge to a less serious violation which may not carry with it motor vehicle points. Potential clients are also concerned with the increasingly expensive fines which are imposed by the Courts as well the possible insurance ramifications of a guilty plea, such as higher premiums. I have appeared in towns throughout the state representing clients on a wide range of Municipal Court matters.
