Practice Areas Description
Jennifer R. Kuczler, Attorney at Law offers legal representation on the following areas of practice:- Criminal Defense
As you face a difficult family law situation or prepare to fight serious criminal charges, it is extremely important to have an experienced lawyer on your side. I'm Jennifer R. Kuczler. I have extensive trial experience in criminal and family law cases. I believe strongly in providing people with the personal service and honest legal advice they deserve. While I cannot promise a particular result, I can promise you that I will work hard to achieve an outcome that protects your rights.
- Criminal Post-Conviction Relief & Appeals
Just because you have been convicted or pled guilty in court does not mean your case is without hope. In some cases, a knowledgeable lawyer could help you fight against a wrongful conviction or find other forms of post-conviction relief. While things may seem bleak at the moment, you shouldn't give up without a fight. As a former prosecutor, I understand where the flaws often rest in criminal cases, which is something I can use to achieve results in post-conviction relief and appeals cases.
- Drug Crimes
Having a drug conviction on your record could cause you trouble for the rest of your life in ways you may not have even thought of. It could make it difficult to find work in many fields and even bar you from being employed in others. If you are facing drug charges, you cannot afford to be without representation from an experienced lawyer. From marijuana and cocaine to prescription drugs, I handle cases involving all sorts of drugs. You can count on me to fight aggressively against misdemeanor and felony charges such as: Drug trafficking; Drug possession; Possession with intent to sell; Prescription drug fraud; Cultivation of marijuana; Drug manufacturing.
- Sex-Related Crimes
If you've been arrested or charged with a sex-related crime, you may feel like you've already been convicted. But don't give up hope. Unfortunately for prosecutors, you are presumed innocent until proven guilty and having an experienced attorney can go along way toward making sure your rights are not violated. The seriousness of sex crimes charges cannot be stressed enough. A conviction may require you to register as a sex offender for the rest of your life, making it nearly impossible to get a job and making you a pariah in your community. Not to mention the fact that all this could happen after you've already served your prison time.
- Juvenile Crimes
When a child or teen makes a mistake, it shouldn't define who they are and certainly shouldn't ruin the rest of their childhood. If you are facing juvenile crimes charges or have a child who is facing criminal charges, it is worth the time to discuss your situation with an experienced juvenile crimes attorney. While most of these cases are tried in juvenile court, some prosecutors do seek to try teens as adults. If I am hired early enough in the process, I can work with prosecutors in an attempt to keep the case in juvenile court. Records are generally sealed when someone turns 18, limiting the damage of a juvenile conviction, but attempting to seal records will not help you if you are tried as an adult.
- Probation & Probation Violations
If you have been accused of committing a probation or parole violation, it is important to realize just how serious your situation is. At a time like this, it is in your best interest to have a criminal defense lawyer you can trust handle your parole or probation violation matter and keep you out of jail. A probation violation defense is not something every attorney is comfortable with, and for good reason. There is a lower standard of proof in these cases, and they are decided by a judge rather than a jury. In addition, unlike an initial arrest in which you might be entitled to a bond, a judge does not have to set a bond in a probation violation. These unique factors, combined with facing the possibility of being sent back to jail or prison, are why it is so important to have experienced legal representation.
- Divorce
If you are considering filing for divorce, searching for the right divorce lawyer can seem overwhelming. It is crucial to have someone on your side who understands all aspects of divorce and children's issues so that you can arrive at a legal solution that protects your children and meets your needs. A one-trick pony is not the right attorney to have on your side during a divorce. No two divorces are ever exactly the same. I will not pump you up with false hope or unrealistic expectations about your divorce. I will provide you with straightforward advice about your options. If settling is best for you, I'll tell you. If a trial is necessary, I will aggressively pursue an outcome that protects your rights.
- Parenting Plans/Child Custody
As uncertain and scary as divorce can be for adults, just imagine what it must be like for your children. Not only are they dealing with the crumbling relationship of their parents, they are dealing with uncertainty about where they will live and who will be taking care of them day to day. I work closely with parents to create child custody and parenting plans that are in the best interest of their children. To prevent any unforeseen difficulties and fights over parenting time, it is important for any parenting plan to include: Plans for child custody during school breaks, holidays and summer vacations; Plans for child custody on holidays such as Mother's day, Father's day and family birthdays; Procedures for drop-off times, pick-up times and other logistical issues.
- Father's Rights/Paternity/Child Support
Many fathers feel left out of the parenting process, particularly when the birth of their child happened outside of wedlock. It doesn't have to be this way. If you are a father, you have just as much of a right to be involved in your child's life as their mother does. An experienced family law attorney can help you assert those rights. I believe it is important for fathers to stand up and make sure their parental rights are being respected. Paternity cases are similar to divorce in the respect that all issues considering custody and care of children need to be ironed out in a way that protects and benefits the children. You should never consent to anything without making sure your parental rights are protected.
- Modifications & Relocation
No one's life stays the same forever, and agreements reached during a divorce often do not reflect the evolving needs of parents and children as the years pass. If a parent is considering relocating or if you need to draw up a new arrangement to reflect the changing circumstances, it is important to have a lawyer looking out for your interests. Many divorced parents make the decision to move away, often for economic reasons. However, gaining the permission from the court can be difficult when the other parent is opposed to the idea. If you are considering moving, I can help you fight for the right to do so or help you negotiate with the other parent to reach a new parenting plan that you both can agree to.
