Practice Areas Description
Our firm offers legal services on the following areas of practice:- DUI/DWI
If a driver is charged with driving while impaired ("DWI") or driving under the influence ("DUI") of alcohol, the State has the burden to prove its case beyond a reasonable doubt. The difference between a DWI and a DUI is one of degree. To convict a driver of a DWI, the State must show the driver's normal coordination was impaired by alcohol. In order to convict a driver of a DUI, the State must prove that the driver's normal coordination was substantially impaired by alcohol. For those drivers who elect to take the breath test offered by the police, the prosecutor will try to use those results to establish the driver's guilt.
- Drug Offenses
Possession of paraphernalia mirrors possession of CDS. Possession encompasses more than what is in a defendant's physical possession, it encompasses what is in their physical possession as well as their "constructive possession." Constructive possession is a fact driven analysis of all the surrounding circumstances. In order to prove possession, the prosecution must prove: That the defendant possessed the substance; That the defendant knew the general character or illicit nature of the substance; That the substance was illegal.
- Theft/Shoplifting
In Maryland, if a defendant is charged with theft, there are many ways for the state to secure a conviction. The crime of theft goes beyond merely shoplifting but also includes a wide range of conduct, including: Larceny; Larceny by trick; Larceny after trust; Embezzlement; False pretenses; Receiving stolen property. A conviction for theft can cause problems for someone if they apply for certain jobs that require background checks. This is especially true if the conviction is for a felony theft. Any person charged with theft should speak with an experienced criminal defense attorney to help to develop a defense to try and keep their record clean.
- Assault/ Domestic Violence
Domestic violence is one of the most difficult areas for everyone involved in the Court system, including the Judges and the prosecutors. Over the course of time, the Court system has become much more proactive in dealing with domestic violence. Most police departments even have police officers who are specially trained to deal with victims of domestic violence, and to train uniformed police officers how to deal with these situations. Judges, prosecutors and police all receive specialized training in these cases. Make sure to hire an attorney who has a firm background in handling these cases.
- BWI Airport Cases
The attorneys at Jimeno & Gray have experience both prosecuting and defending cases that arise inside and around BWI Airport. In and around BWI Airport, there are multiple levels of security. The Maryland Transportation Authority Police Department has the primary police authority both inside and outside of the airport. Enforcement outside of the airport includes traffic violations, such as speeding, driving while suspended and driving under the influence of alcohol, to controlling traffic and patrolling the parking garages to keep travelers and guests at the airport safe. Inside of the airport, enforcement can include handling situations involving disorderly individuals, assaults, drug possession, and possession of knives, guns and other weapons.
- Probation Violations
A violation of probation is an allegation against someone on probation that they have done something which conflicts with the instructions given to them by the Judge who put them on probation. Probation itself is essentially a contract between a Judge and a Defendant, if the Defendant does what they are supposed to do; there are no more bad consequences for the Defendant. However, if the Defendant does something they are not supposed to, there are consequences. A violation of probation can have serious consequences, or can be an opportunity to readdress problems in someone's life that have reemerged since being placed on probation.
- Social Services
The Department of Social Services in Maryland oversees many different areas of government oversight for families and children. One of these areas is their involvement in the investigations of complaints of neglect and abuse. No matter if the investigator is from Child Protective Services (CPS), the Child Advocacy Center (CAC), or DSS, these agencies are all part of the same larger agency, DSS. DSS receives complaints from mandatory reporters, citizens, and even the Court system. Mandatory reporters are people who are required by law to notify DSS if they are aware of possible neglect or abuse of a child, including doctors, nurses, social workers, police officers, psychologists and teachers. If these mandatory reporters do not report what they know, they face consequences themselves.
- Expungements
An expungement is a Court Order that tells the Court system, the law enforcement community, and others involved in the criminal justice community to destroy or pull from public access certain records. These records include police reports, court records, and even the recordings of the court proceedings themselves. The records that are kept are secreted and only available to certain law enforcement agencies under certain very narrowly limited exceptions. However, the records are shielded from public access as if they never existed. Some events are excluded from expungement, including drinking and driving related charges. While there is a method within the MVA to expunge such records, this is a practical improbability.
- Bad Checks
Not every passed bad check is a crime. Many people bounce checks, sometimes through no fault of their own. The difference between the crime of passing a bad check and just passing a bad check is often the idea of a "contemporaneous transaction." Think of this as an extension of theft, the person passing the bad check literally walks away with goods or services at the time the check is passed. It is not just putting a check in the mail to pay off a debt, but the cotemporaneous transaction that sets it apart and makes it similar to theft. In addition to being a contemporaneous transaction, the defendant must not have the intent to pay for the goods or services they walked away with when the check passed from hand to hand.
- Juvenile Offenses
The purpose of the juvenile justice system is not to punish the offender but rather to rehabilitate, although the maximum penalty for a juvenile offender is incarceration up to and including the juvenile's 21st birthday. Often, the Department of Juvenile Services or Circuit Court Judge or Master will look to determine what services, if any, would be helpful to try and rehabilitate the juvenile offender, including drug and alcohol treatment or even community service.
