Practice Areas Description

Our firm can assist clients charged with any of the following types of criminal charges:

- Assault

If you have been charged with criminal assault, you need the services of a top-notch Dallas criminal attorney like Jose Noriega who understands the defenses available to you, and who will vigorously defend your case. There are three distinct types of actions that can lead to a charge of criminal assault under Texas Penal Code § 22.01(a): Intentionally, knowingly, or recklessly to cause bodily injury to another person, including one’s spouse; Intentionally or knowingly to threaten another person with imminent bodily injury; Intentionally or knowingly to cause physical contact with another person when the actor knows or should reasonably know that the person will regard the contact as either offensive or provocative.

- Theft

In cases of theft, it is critical to have a knowledgeable Dallas criminal attorney involved in the early stages of your case. Texas law is very particular about the manner in which an indictment or information in a theft case is written, and errors on the part of the prosecutor in describing the elements of the offense or defining the nature of the alleged appropriation can lead to a case being thrown out of court. If you have been charged with theft, you need the services of a top-notch Dallas criminal attorney like Jose Noriega who understands the defenses available to you and who will vigorously defend your case.

- Robbery

The key element that distinguishes robbery from theft is the defendant’s assault of the victim. If it cannot be shown that the defendant either caused an injury or put the victim in fear of injury, no robbery has occurred. Another important distinction is that the victim of a robbery is the person who is assaulted by the defendant, even if he or she is not the owner of the property in question. Another point that must be proved to obtain a conviction for robbery is the intent of the defendant to obtain or maintain control of the property. This can be shown even if the defendant was not successful in obtaining or maintaining such control. However, if the alleged assault was not committed with such intent, no robbery has occurred.

- DWI/DUI Defense

“Intoxication” may be proven by demonstrating either: that the defendant did not have the normal use of his or her mental or physical facilities by reason of the introduction of alcohol, a controlled substance, a drug, a dangerous drug, a combination of two or more of these substances, or any other substance into the body; or that the defendant had an “alcohol concentration” of 0.08 or more. If you have been arrested for driving while intoxicated or a related offense, you need the services of a Dallas criminal attorney who understands the law and can help protect your rights, including challenging the admissibility of any tests for alcohol concentration that may have been administered to you.

- Sex Crimes

A person who is convicted of any of the following sex crimes is required to register with local authorities as a sex offender: Indecency with a child; Sexual assault; Aggravated sexual assault; Prohibited sexual conduct; Sexual performance by a child; Compelling prostitution; Possession or promotion of child pornography; A second conviction of indecent exposure; Aggravated kidnapping with intent to sexually abuse the victim; Burglary with intent to commit specified sexual offenses; An attempt, conspiracy or solicitation to commit any of the above offenses (other than indecent exposure); or
A conviction under laws of another state for similar offenses (other than first offense for indecent exposure).

- Drug Possession

Drug possession in Texas is a serious crime and carries, upon conviction, some of the most severe penalties of any state in the Union, as any experienced Dallas drug possession attorney can attest. Under Texas law, if you are charged with possession of an illegal drug, it means you are accused of either “carrying” or “having access” to what is considered a “controlled substance.” Penalties vary depending on the type of drug, the amount of the drug and whether the charge is a misdemeanor or felony. Any drug possession conviction under Texas law will subject the person to a six-month’s driver’s license suspension. Due to the severity of these penalties, you may wish to speak with a Dallas criminal attorney if you were arrested on such charges to explore your options.

- Drug Transportation

Drug transportation under Texas law involves a variety of different offenses. Among these are: Possession of a controlled substance with intent to deliver; Possession of a controlled substance with intent to distribute; Possession of a controlled substance; Drug trafficking. As the penalties upon conviction for any drug transportation charge are severe, someone accused of drug transportation should prepare to mount a vigorous defense with a seasoned Dallas criminal attorney. As an experienced Dallas criminal attorney may explain, the specific charges that may be brought against the person depend not only upon the individual circumstances of each case, but also upon the type of drug involved and the quantity.

- Drug Trafficking

Illegal drugs have become an increasing focus of law enforcement scrutiny, especially in Texas. Whether prosecuted federally or in Texas state courts, penalties upon conviction for drug-related crimes are among the highest in the country. Drug trafficking may be defined as the trade, exchange or delivery of a controlled substance. While the term “drug trafficking” likely conjures up notions of large operations involving international cartels and vast sums of cash, it also involves the individual people within that chain who perform specific tasks. Even the smallest player within that network is exposed, upon conviction and arrest, to large fines, long prison terms, or both. It is essential to retain a Dallas criminal attorney with specific familiarity with drug issues. If arrested, you must act immediately.

- Homicide

A vigorous defense asserting the wrong person was arrested is not the only tactic available to an experienced Dallas criminal attorney. It is typical in Texas criminal homicide cases for the accused to be tried on the most severe charge the allegations can support. Often times, this is murder or capital murder. However, at trial, the judge instructs the jury that they may alternatively find the defendant guilty of manslaughter, which is considered a “lesser included charge.” Thus, the accused is actually being tried on all the criminal homicide charges in one proceeding. The efforts of an experienced Dallas criminal attorney may result in a verdict concluding, perhaps, that the defendant behaved recklessly but not intentionally or knowingly. This can be the difference between a death sentence or life in prison without parole, and a prison sentence of limited duration.

- Domestic Violence

Domestic violence may be defined as actual physical violence, a threat of violence and/or abuse within a specified type of relationship. It is important to note the “threat of violence” to the alleged victim is sufficient in many cases to result in an arrest and/or other immediate consequences. Those specified relationships include married couples, couple who cohabitate (i.e. live together), those couples who have a child in common, those couples who are in a relationship or had a former relationship, and couples formerly married to one another. A person accused of domestic violence may be held in jail for up to 48 hours, even if they have posted bail, if there were any past incidents of violence or upon a reasonable belief a subsequent act of violence may be imminent.
