As a Boston criminal defense lawyer, we know your rights and will fight hard to protect them. At Pickering Law, we defend clients against a wide range of criminal charges, including serious traffic violations. In addition to building an aggressive criminal defense, we explain the process the Registry of Motor Vehicles will take and make sure that you understand all of your options.
Our firm is dedicated to helping people who need to navigate the criminal justice system. Most people have never been arrested before and, thus, have no experience dealing with prosecutors, law enforcement, judges and juries. That is our job as your attorney: To get you through the process as efficiently as possible and obtain the best possible results for your situation.
Our law firm handles all types of criminal cases including drug crimes, violent crimes, OUI, as well as all types of traffic offenses. Some of these traffic offenses include license and registration issues, as well as reckless driving and vehicular homicide matters that could result in jail or prison time. Whatever the charge, we quickly determine the optimal strategy for your circumstances, and then apply that strategy aggressively, seeking the outcome that best meets your goals.
Practice Areas
Practice Areas Description
- Traffic ViolationsThere are many types of traffic violations. Some are immediately serious, requiring that you obtain sound legal counsel who will defend you against the charges and protect your rights. Others are seemingly more benign, and many people ignore them. Unfortunately, even a speeding ticket could have long-term negative consequences. It is important to know about your rights and the possible outcomes of all types of traffic violations. Traffic violations include, but are not limited to the following: speeding tickets and unpaid tickets; failing to obey traffic signs and signals; making an illegal U-turn; failing to use directional signals; failing to stop at toll booths; texting and using cell phones; and failing to yield to emergency vehicles.
- Ignition Interlock Violations
If you have been ordered to install the interlock device and are charged with driving without it, the consequences are severe. Your license will be revoked for up to 10 years. You will face a felony conviction and a minimum of at least 30 months in prison. You will have a criminal record for the rest of your life. The stakes are high. It is critical to have aggressive and determined legal representation if you are facing charges of driving without the required ignition interlock device.
- Unregistered Vehicle Defense
If you are convicted on a charge driving an unregistered vehicle, your driver's license may be suspended, your insurance premiums may increase and you may have to pay a fine. If you are charged again, your license could be suspended for a year. You will also have a record of a misdemeanor criminal conviction and points on your driving record. This could cause problems if you receive additional points for other offenses.
- Unlicensed Driver Defense
Driving without a valid license can be a serious offense in Massachusetts. You could face a steep fine and jail time. Subsequent convictions on this charge could result in as much as a year in jail. Your insurance premiums could go up, depending on the circumstances. Do not take this charge lightly. Instead, seek aggressive and knowledgeable legal assistance. We will seek the best possible outcome for you if you were charged with driving without a license when you were: driving after your license was suspended or revoked; under 16; using someone else's license; and never issued a license.
- Uninsured Motorist Defense
If convicted of driving without insurance, you could face a fine of $500 to $5,000, a jail or prison sentence of up to one year, or both. You could also be required to buy insurance with costly premiums and you could face cancellation of your car registration and license suspension. You will receive a traffic ticket that could add points to your driving record. If you receive a second conviction within six years, your license could be suspended for up to 12 months. We can help you by investigating the legality of the traffic stop and examining all the other facts of the case.
- Revoked / Suspended License
Being charged with driving after revocation or suspension can result in jail time and other harsh penalties. It is important to have a knowledgeable attorney to help you explore your options and protect your rights. At Pickering Law, we advocate for clients who are facing all types of serious traffic charges, including charges of driving after revocation or suspension. we investigate the facts, advise you about the best way to handle the matter and protect your rights throughout the process.
- Vehicular Homicide
Vehicular homicide is not an intentional crime. Rather, it is usually the result of a serious error in judgment that can lead to a drunk driving accident or other serious incident. Despite this, there is significant societal pressure to treat people convicted on this charge as serious criminals. In some instances, this charge is tried outside the courtroom, in the newspapers and television. If you are facing this charge, it is important to have an attorney who can handle your case in the courtroom and in the media. We have knowledge of criminal procedure, experience in the courtrooms of eastern Massachusetts and the skill to protect you throughout the process.
- Reckless Driving
Reckless driving in Massachusetts is not just a traffic ticket: It is a serious crime. With this charge, law enforcement is saying that you operated the vehicle negligently and placed others in danger as a result. You need a lawyer who will force the prosecution to make its case and demonstrate negligence. Otherwise, you could be facing fines, higher insurance premiums and a suspended license. You could also spend time in jail and have a lifelong criminal record. Reckless driving cases are both subjective and fact intensive. You could be charged with reckless driving because a trooper believed you drifted over the white line, were distracted or were speeding. However, unless the state can demonstrate that you were drunk, texting or using your cell phone, reckless driving can tough to prove if you have a knowledgeable defense lawyer.
- Commercial Driver License Violations
If you have a commercial driver's license (CDL) and have been charged with a serious traffic offense, you know better than anyone that your livelihood is at stake. People with CDLs are held to higher standards than ordinary drivers. Many traffic violations, while operating under a CDL, can lead to suspension or revocation, and severely limit your ability to drive a truck or other commercial vehicle. It is important to have a knowledgeable traffic law attorney to help you preserve your license and protect your rights. If you are charged with traffic violations or criminal offenses that put your CDL in jeopardy, we can help. We investigate the circumstances surrounding the charge, determine the facts, review police reports and interview witnesses.
- Criminal Defense
We defend clients against all types of criminal charges, including serious traffic offenses. My cases have included: drug charges such as possession, trafficking, possession with intent and trafficking; drunk driving (OUI / DUI); violent crimes from simple assault to attempted murder; sex crimes and other SORB related issues; and all types of juvenile offenses.
