Practice Areas Description

Julien & Schlesinger, P.C. provides legal representation on the following areas of practice:

- Personal Injury

Personal injury occurs when a person is physically or mentally injured due to the negligent or reckless act of another person. Personal injury can result from numerous incidents or accidents, including dog bites, faulty products, wrongful death, and other wrongful acts resulting in injury to a person. The injured victim can sue the wrong-doer and claim compensation. A Jury will consider the intensity of injury and the loss incurred to the individual when determining compensation.

* Medical Malpractice

Medical malpractice means any negligent or unskilled treatment of a patient by health care providers, such as doctors, nurses, therapists, pharmacist, and other health care professionals that result in injury to the patient. By “vicarious liability,” hospitals and clinics can also be held liable for the negligent acts of their employees. A person who alleges medical malpractice has to prove negligence on the part of the health care provider.

* Birth Injury

Our attorneys have experience with all types of cases involving birthing errors that result in the injury or death of the mother or child. We have a complete understanding of the medical issues and the law, and we know what it takes to see that your interests and the interests of your child are protected. You can count on us to pursue every available option in an effort to secure a favorable result in your case. We are prepared to help you with any type of birth injury case, including: Brain damage due to lack of oxygen; Cerebral palsy; Shoulder dystocia; Brachial plexus injuries; Erb's palsy; Premature delivery; Failure to perform a timely C-section; Performing an unnecessary C-section; Negligent fetal monitoring; Uterine rupture and other injuries to the mother; Physical injury to the baby; Wrongful death.

* Brain Injury

Brain injuries can happen in many different ways, but what they all have in common is the serious impact they can have on the victim's life. Trouble with motor skills, slurred speech, memory loss, personality changes and permanent brain damage can all result from serious brain injuries. When these injuries happen in accidents that were caused due to the negligence of another, victims have the right to seek compensation from the responsible parties. Our New York City brain injury lawyers have extensive experience handling all types of traumatic brain injury cases.

* Wrongful Death

We understand what a troubling time this is for you and your family. When you hire our firm, we will take the burden off your shoulders and handle all of the legal issues for you. * Workplace Injury

If you have been injured on the job, you likely have a legitimate claim for workers' compensation benefits. Depending on the circumstances of your injury, however, you may also have grounds for a separate personal injury claim. At the law firm of Julien & Schlesinger, P.C., we represent injured workers with the personal injury portion of their cases. We have experience in a wide variety of workplace injury cases, including: Construction site accidents; Injuries caused by defective equipment; Forklift injuries; Machinery malfunctions; Trip and fall over debris in a work area; Explosions; Electrical malfunctions.

* Construction Accidents

Construction workers put themselves in harm's way every time they walk onto a job site. Construction is among the most dangerous occupations in New York, and it is the responsibility of the owner, general contractor and others to ensure a safe working environment for everyone on the site. Any failure in that responsibility puts everyone at risk of serious injury. We have experience with many different types of job site injury claims, including: Falls from ladders, scaffolding or other heights; Failure to provide vertical passage; Roof collapse; Electrical accidents; Falling debris; Elevator accidents; Crane accidents; Equipment or power tool malfunctions.

* Premises Liability

Property owners, tenants and others may be responsible for taking the necessary precautions to ensure that there are no hazards that could cause injury. When property owners are aware of hazards or should have been aware of them, they have an obligation to correct the issue. If you have been injured due to a hazard that a property owner neglected to repair, you may have a claim for damages. We represent clients in a broad range of premises liability claims, including: Slip-and-fall; Trip-and-fall; Dog bites; Negligent security; Ceiling collapse; Uneven pavement; Cracked sidewalks; Ice and snow; Lead poisoning; Dangerous stairways; Broken or missing handrails.

* Product Liability

In New York, when a manufacturer or seller distributes or sells a defective product and a consumer gets injured by the product, the manufacturer or seller can be sued and held liable under product liability and consumer protection laws. Product liability claims can be pursued on the basis of strict liability, negligence and/or breach of warranty. A consumer who is injured because of a defective product can allege claims for defective designs, manufacturing defects and/or failures to warn.

- Civil Trial Practice

General trial practice covers a vast area of the law and can involve numerous issues, such as accidents, personal injury, product liability, malpractice, commercial disputes, and negligence. Trial practice involves judicial examination of facts and legal issues and the resolution of disputes brought by the parties to the courts for settlement. The general goal of civil trial practice is generally compensation or defense of personal interests and rights.

- Commercial Litigation

Any litigation that involves business matters or commercial disputes is known as commercial litigation. Commercial litigation includes issues related to debt collection, bankruptcy matters, contract disputes, shareholder litigation, antitrust actions, consumer fraud allegations, and civil RICO (Racketeer Influenced and Corrupt Organization) claims. Commercial litigation matters range from simple business transactions to complex actions involving numerous parties.

- Real Estate Litigation

Immovable property, such as buildings, land, and any object attached to immovable property is considered real property or real estate. The two kinds of real estate are commercial and residential real estate. Federal and state laws govern all matters concerning the sale and lease of real estate. Real estate laws regulate the activities and functions of lenders, commercial or industrial landowners and users, developers, contractors, brokers, and building and homeowner associations stringently.

- Employment Discrimination

Employment laws govern the relationship between employers and employees, individual contracts, wages, work hours, rules governing collective bargaining agreements, and protection against discrimination. The Civil Rights Act prohibits discrimination on the basis of sex, race, religion, national origin, or color. Both federal and state employees are protected against discrimination under the Civil Rights Act and the Executive Law of the State of New York. By the enactment of the Americans with disabilities Act, discrimination against qualified individuals with disabilities is also forbidden. Discrimination includes bias in promotion, hiring, job allocation, compensation, and termination, and various kinds of harassment.
