- Chapter 7 Bankruptcy

Oklahoma Chapter 7 bankruptcy sometimes called the “Fresh Start Bankruptcy” is by far the most filed form of bankruptcy protection in Oklahoma. This is because it allows the debtor to wipe his or her financial slate clean of most if not all of their debts and start over. This bankruptcy code provision is available to individuals, married couples, corporations and partnerships.

- Chapter 13 Bankruptcy

Chapter 13 allows individuals who have steady incomes to pay all or a portion of their debts under protection and supervision of the court. Under Chapter 13, you file a bankruptcy petition and a proposed payment plan with the U.S. Bankruptcy Court. Payment plans provide for payment of debts over 3 to 5 years. An important feature of Chapter 13 is that you will be permitted to keep all your assets while the plan is in effect and after you have successfully completed it. One of the most important aspects to a plan being approved by the court is its feasibility of success. That is, if the repayment schedule is one which the debtor is unlikely to be able to meet, the court will not approve it. Unlike under the Chapter 7 provision, a debtor is not time limited in the number of Chapter 13 petitions he or she files.

- Chapter 11 Bankruptcy

Chapter 11 bankruptcy is referred to as “business reorganization” bankruptcy. It is specifically aimed at relieving the debts of businesses and corporations. If the Chapter 11 bankruptcy is confirmed the business is able to continue operations while leaving the business debtor in possession and leaving the business to continue normal operations. Filing for Chapter 11 bankruptcy requires the consent of the creditors. The creditors’ committee is presented with a debt repayment plan that typically explains how they will benefit. Creditors will only accept the plan if they believe they will receive more funds under the plan than from liquidation.
