Practice Areas Description
- DWI First OffenseA DWI or DUI conviction is costly and could haunt you for many years to come. Your vehicle insurance rates may triple. Minnesota charges more than $700 for driver's license reinstatement. Your driver's license revocation could stay on your driving record permanently, even if you are found not guilty of the charges. This can be used against you by police, prosecutors and even insurance companies. If you are facing your first DWI offense, these consequences probably seem very confusing, frightening and uncertain. Keller Law Offices provides the legal help you need and deserve at this time. We can build the strongest defense possible on your behalf, calm your worries and minimize the penalties.
- DWI Second Offense
As the number of DWI offenses goes up, so do the penalties. Multiple drunk driving arrests can land you in jail, place your job in jeopardy and result in the loss of many freedoms. If you have been charged with or arrested for a second, third or fourth DWI/DUI offense, talk to Keller Law Offices. We have more than 14 years of experience protecting the rights of Minnesotans who are facing the serious consequences of drunk driving.
- Felony DWI
If you are convicted of DWI for a fourth time within 10 years of three other DWI convictions, it is a felony. If you cause an accident due to drunk driving, it can also be handled as a felony. The consequences of a felony can be extremely detrimental to your rights, freedoms and future. Penalties include up to seven years in prison. Keller Law Offices has more than 14 years of experience protecting the rights, freedoms and futures of clients throughout the Twin Cities metro area and the state of Minnesota. We are ready to help and defend you.
- DWI Defense
In the state of Minnesota, it is your right to challenge your DWI. If you feel that you have been wrongly accused of DWI, you need to call a Minneapolis DWI lawyer as soon as you are charged or suspected. Let the officer know that you would like to speak to an attorney. Then, let your attorney help you. But even if you do not acquire an attorney from the beginning, you can hired an attorney at any time to challenge the DWI criminal charge and to challenge the revocation of your driver's license.
- Drug DWI Defense
If you have been charged with drug possession, or if you think you may be facing drug charges, now is the time to talk with a skilled defense lawyer. At Keller Law Offices, we provide aggressive and experienced drug crimes defense services. We handle charges involving prescription drugs as well as marijuana and other types of "street drugs."
- BWI
You may be surprised to know that DUI and DWI laws do not apply only to motor vehicles, nor to those on the marked public roads. You can also be arrested and convicted for Boating While Intoxicated (BWI), Snowmobiling While Intoxicated (SWI) and ATV-ing while Intoxicated (AWI). The reason? Just because you are not behind the wheel of a car, the Legislature believes you are still endangering the lives of others as well as your own life by mixing drinking and driving. If you have been arrested for BWI, SWI or AWI, then contact our drinking and driving attorney right away.
- Hidden Costs of DWI Arrest
We have all been educated that drunk driving is wrong and that many people are killed on America’s roadways because of drunk drivers. But, there is a difference between knowing that driving under the influence is wrong and actually preventing yourself from accidentally committing a DWI without realizing you are over the .08 limit. If you are pulled over and charged with DWI, you need to have an aggressive, effective drunk driving lawyer by your side because there are both criminal and administrative costs that you must pay. However, there are collateral costs as well. This adds to the growing list of hidden costs that you may have never heard of that may result from a DWI charge in Minnesota.
- Field Sobriety Test
If a police officer has reason to believe that you are driving while intoxicated, he or she will require that you submit to field sobriety tests. These tests are to determine whether or not the officer’s suspicions were correct. If they are, then you will find that you are arrested for a DWI offense and taken to jail. If you refuse a field sobriety test, you will still be arrested and will later have to submit to breath, blood, or urine tests to determine if you are intoxicated. If you are charged with DWI or you refuse to take field sobriety tests, you do need to speak with a qualified field sobriety test attorney to help you in your case and to also help you in making decisions that are best for you.
- Test Refusal
Although field sobriety testing on the roadside is voluntary, test refusal at the station is a crime. In fact, test refusal at the station is an automatic gross misdemeanor carrying a possible punishment of one year in jail and a $3000 fine, even if this is your first-time DWI ever in your life!
- Refute DWI Charge
The reason is because you are giving your “implied consent” to such testing when you obtain a driver’s license. The moment you renew your license every few years, you are giving law enforcement in Minnesota permission to conduct a test to see if you are under the influence of drugs, assuming they have probable cause to ask your for a test.
- Implied Consent
The Implied Consent Law, Minn. Stat. Sec. 169A.50-.53, states that an individual who drives, is in physical control, or operates a motor vehicle on the roads, land, or waterways of Minnesota while impaired with alcohol, must take a breath, blood, or urine test to determine the presence of alcohol or any other controlled substance. The test of choice must be administered by a law enforcement officer.
- Drivers License Cancellation
Most drivers take the privilege to drive for granted. It is only after your license has been cancelled that they realize how integral the ability to drive is to the day-to-day tasks of life. If your driver's license has been cancelled due to a DWI offense, talk to Keller Law Offices. We can help you obtain a B-card license that allows you to drive with restrictions and explore other options for maintaining your driving privileges.
- Out Of State DWI
Were you simply traveling through Minnesota on a business or leisure trip? If you were and you were arrested for DWI, you need some assistance in your case. You need to call a qualified criminal defense lawyer in the Twin Cities to help you in your defense. The goal is to get you home as soon as possible and provide you with a defense that will work for you to the fullest. However, the first thing you need to realize in your case is that you are not alone. There are many individuals visiting the state that have been pulled over for DWI. Although it may seem like every DWI lawyer is qualified to take your case, you should know that many attorneys are not qualified to take on the case of an out of state defendant.
