- Admiralty and Maritime Law

The attorneys of Kelly & Lemmons assist and advise clients on marine and marine-related commercial transactions involving the "brown water" and offshore trades. Our attorneys stand ready to advise vessel owners and operators, charterers, cargo interests, construction and dredging firms, freight forwarders, inland carriers, lenders, marina operators, marine surveyors, stevedores, and terminal operators, with issues such as affreightment, brokerage, charter parties, cargo, dredging, documentation and marine registration, energy, environmental regulation, finance and foreclosure, fisheries, management and crewing, marine construction, maritime service agreements, towage, transportation (ocean and inland marine), trade-related agreements, and vessel construction.

- Jones Act

Maritime workers and seamen injured while in service to a ship operating in navigable waters are covered under the Jones Act and the general maritime law. The Jones Act provides redress for seaman injured by negligence, while the general maritime law provides some strict liability remedies. When a ship or onboard working environment is considered unsafe, a ship is said to be "unseaworthy." Here, if the owner or operator of a ship, barge, or boat fails to maintain the safety or upkeep of a vessel, injured maritime workers can receive additional damages under the general maritime law.

- Administrative Law

Kelly & Lemmons, P.A. handles all administrative law issues: appeals of decisions by local zoning boards on development issues; environmental law compliance and alleged violations; applications for zoning and land use permits, and zoning appeals; professional and business licenses; and non-profit registration and accountability. - Police Misconduct Defense

Kelly & Lemmons defends police officers accused of police misconduct in cases involving the following: use of excessive force, misuse of canine units, excessive use of a Taser, excessive use of pepper spray, beating a suspect while handcuffed or in custody and improper use of deadly force. In defending law enforcement officers facing charges of police misconduct, we review witness statements, video footage if available, chips from stun guns, and other pertinent evidence. We contextualize an officer's actions in terms of his or her training, the situation at hand, and what standard operating procedures call for in these kinds of situations.

- Civil Rights and Constitutional Law

- Dram Shop Law

In cases involving injuries or fatalities due to a drunk driver, drinking establishments can be held liable for their actions as well. Under Minnesota's dram shop law a restaurant, bar, or liquor store that serves alcohol to someone who is visibly intoxicated can be held liable for injuries caused by them in a drunk driving accident. Working with investigators, our attorneys recover bar tabs, credit card receipts, and interview wait staff and patrons in order to determine what happened.

- Premises Liability

Property owners, retailers, managers of office buildings, and owners of parking garages can be held liable for injuries that result from disrepair or inadequate security. When investigating premises liability cases, our office works with safety experts, design engineers, and others in exposing structural defects and inadequate safety measures involving the following: crumbling stairs or sidewalks, exposed wiring, wet floors, malfunctioning elevators or escalators, inadequate lighting, broken front door locks, falling debris, fire and locked fire escapes.

- Criminal Law

Kelly & Lemmons, P.A. is equipped to handle all misdemeanor and felony offenses for clients charged in the Twin Cities area and western Wisconsin: DUI and implied consent; drug possession and sale; property crimes (theft, burglary); violent crimes (assault, robbery, domestic abuse); and white collar crimes (fraud, embezzlement).
