Practice Areas

Practice Areas Description

- Criminal Defense

If you have been charged with a crime, it is very important to have a good defense attorney who will ensure that your rights are protected and that you receive quality legal representation. We are diligent and devoted to our client's well-being after a criminal arrest. A defense attorney from Kenneth L. Baritz & Associates, P.C., will meet you in jail and help get you out on bail promptly as needed. Depending on the type of crime, your sentence if convicted could range from merely paying court costs and fines to spending significant time in state prison. You need an experienced attorney to make the right pre-trial motions, to develop the best possible trial theory, to make the most convincing closing argument, and to fight in your defense.

- Drug Charges

No matter what type of drug charge you are facing or the circumstances of your drug-related arrest, having the representation of a knowledgeable, well-qualified criminal defense attorney is urgent and real. These types of drug dealing or drug trafficking charges fall under four broadly defined categories: the alleged manufacturing or creation of illegal drugs with a distribution intent; the alleged selling or delivering of illegal drugs to another individual; the alleged possession of illegal drugs in large enough amounts that indicate you intended to deliver them; and you are charged with criminal conspiracy and possession with the intent to deliver because it is alleged you were working in conjunction with, or aiding in some way, another individual who is selling or delivering drugs. If you are convicted of this charge, a mandatory minimum sentence may apply. The type of drug, the weight of that drug, and whether you have any prior convictions for possession with the intent to deliver are all factors for your sentencing.

- DUI Defense

After a drunk driving or DUI arrest in the Philadelphia area, it is important that you speak with an experienced criminal defense lawyer. Even if you failed a Breathalyzer test or refused to take one, you have rights that should be protected throughout the legal process. Beginning in 2004, the Pennsylvania Legislature enacted a new set of DUI laws that include mandatory minimum sentences for DUI convictions. In addition to whatever probation or incarceration is called for under the applicable mandatory minimum sentence, there are also a number of other consequences that may follow a DUI conviction including the following: loss of driver’s license for a period of time; payment of court costs and fees; an alcohol highway safety class; and requirement of an ignition interlock device in your car.

- Gun Charges

A conviction on gun-related charges will have a lifelong impact. Retaining one of our experienced criminal defense lawyers is crucial to getting the best possible outcome in your case. We can provide legal defense against all manner of gun charges, including: possession of a firearm by a person not entitled to possess one (generally, a convicted felon); possession of a concealed firearm without a valid license or permit; possession of a firearm on Philadelphia public property without a valid license or permit; carrying a firearm with an obliterated or altered serial number; and possession of a firearm by a minor. If you have been charged with any of the above crimes or another crime involving a rifle or other firearm, our law firm can give you the knowledgeable help you need and we will work hard to avoid conviction for illegal firearm possession.

- Assault / Burglary

Assault, robbery, burglary and theft are all crimes that may have a very serious impact on a person's life. All four of these crimes have different levels of charges and different levels of consequences. That is why it is so important to have an experienced Philadelphia criminal defense attorney on your side. No matter what type of assault charge you have been arrested for, it is important to have legal representation on your side to ensure that your rights are protected. Because all robbery charges are felonies, it is very important to have diligent legal representation on your side. Burglary is a serious charge which requires a serious lawyer to build a serious defense. Our experienced attorneys can provide the strong representation you need to ensure that your rights are protected. We also handle defense of all types of theft charges.

- Underage Drinking

Underage drinking charges are often treated lightly by parents and the minors who receive them. It is tempting to write this offense off as "kids being kids" or "that's what you do in college." The fact is, a charge of underage drinking can have serious ramifications that may impact a person's life forever. If your child has been charged with underage drinking, it is important to have experienced legal representation to protect your rights. At the law firm of Kenneth L. Baritz & Associates, P.C., our attorneys have more than 30 years of experience practicing law. As a family run law firm, we understand the issues that families face together.

- Expungement

Having a criminal record, with or without a conviction, can haunt you in all aspects of life, particularly when this information is easily accessible on the Internet. A criminal record or record of arrest can impact: job applications, school applications, credit applications, housing applications and gun permit applications. These are but a few of the ways an arrest record can follow you for the rest of your life; however all hope is not lost. Our experienced Pennsylvania lawyers can file a motion to have your record expunged so you can have a clean start in life. Once the expungement is granted your record will be sealed and your arrest record will be erased.

The criminal defense attorneys at Kenneth L. Baritz & Associates, P.C., we will aggressively defend against a variety of white collar crime cases, including: bank or credit card fraud, identity theft, embezzlement, employee theft, money laundering, mail and wire fraud, and Internet crimes. - Eviction Proceedings

Sometimes you have a tenant who will not pay, and would like to evict them. You may consider doing it yourself, ;rather than hire a lawyer, to save money. However, there is the danger that you will miss a critical procedural step. Let the law firm of Kenneth L. Baritz & Associates, P.C., represent you. We will: send the notice to vacate; file the complaint; attend hearings, and negotiate or litigate as needed; file writs of possession; coordinate lockouts; and provide appellate representation. We will also advise you about leases, landlords' and tenants' rights and obligations, and all related matters.

- Landlord / Tenant Matters

In the United States people are entitled to be treated fairly when they are trying to rent a place to live, without regard to their race, color, national origin, sex, disability or, in some situations, family status. The federal Fair Housing Act of 1968 guarantees protections against discrimination in housing. If you have been discriminated against in your search for housing, contact an experienced real estate attorney today to discuss your rights. When you are interested in entering into a lease for an apartment or rental property, you will have to sign documents that bind you to your decision. Afterward, any number of things could go "wrong," such as a discovery that the property is unsafe for habitation, or your failure to pay rent when it is due. Sometimes real estate issues are resolved without the involvement of judges or lawyers. In other situations, the disputes and consequences surrounding the rental of property necessitates legal assistance and resolution.

- Business Formation

Different businesses have different needs. If you are looking for lawyers with broad experience, skill and knowledge, you have come to the right firm. You know how to run your business. We know how to assist you in resolving the legal issues involved in the formation of your business. Once your company has been successfully created, we will assist in issues that may occur over time such as: amendments to articles of incorporation and other governance issues; business management; employee-employer contract development and issue resolution; tax planning; expansion and financing; regulatory and statutory compliance; and changes in ownership interests. There may also come a day when you will want to sell your business, buy another business, or merge businesses. We can assist you with all your business formation and business law needs.

- Social Security Disability Benefits

The process for collecting Social Security Disability (SSD) benefits is complicated and time consuming. A Philadelphia, Pennsylvania, Social Security attorney may be necessary to work with the Social Security Administration on your behalf and assist with applying for disability benefits. The length of time it takes to receive a decision on your disability claim is from three to five months. It can vary depending on several factors, but primarily on: the nature of your disability; how quickly we obtain medical evidence; whether it is necessary to conduct a medical examination to obtain evidence to support your claim; and if your claim is randomly selected for quality assurance review.
