Practice Areas Description

Our practice areas include:

- Chapter 7 Bankruptcy

Chapter 7 is a liquidation bankruptcy. Generally in bankruptcy, a trustee liquidates assets and uses funds to pay unsecured creditors a portion of what they were owed. However, in Chapter 7 cases generally individuals do not have assets to administer. In most Chapter 7 cases, individuals are allowed to keep their personal belongings because they are exempt from liquidation. For that reason, Chapter 7 is advantageous because generally individuals can keep their belongings and many of their debts are forgiven forever. Chapter 7 truly provides you with a fresh start in life.

- Chapter 13 Bankruptcy

Chapter 13 bankruptcy allows individuals who have a regular income to develop a debt reorganization plan that pays all or part of their debts over a 36- to 60-month period. Often Chapter 13 is used to save a home that is in foreclosure and to cure any back payments that were missed over the course of the debt repayment plan. Once the three- to five-year payment plan is completed successfully, the individual's debt is discharged just as it is in a Chapter 7 bankruptcy.

- Credit Counseling

There is a lot of false information that circulates about bankruptcy. Often individuals and families, who do not understand that they are eligible for debt relief through bankruptcy, struggle with their debt. They try to cut back and work second jobs, but their debt compounds with astronomical interest rates, making it impossible to pay back. Our law firm is committed to educating our clients on the options that are available for them. - Garnishments and Bank Levies

Our law firm can address garnishments and bank levies through bankruptcy.

Garnishment: If a creditor pursues a judgment against you for the debt you owe, he or she possesses the ability to have the sheriff seize your assets.
Bank levy: A bank levy is similar in that a creditor must obtain a judgment from a court in order to take action. Once a judgment is obtained, it allows the creditor to seize assets from the debtor.

- Loan Modifications

One option to address your mortgage payments is loan modification. A loan modification is a permanent change in one or more terms of the loan. A loan modification is used so that individuals can afford their payments. There are attorneys who offer loan modification services; however, individuals can do a loan modification on their own. There is a simple process that involves filling out documentation. One program that uses loan modification to help individuals meet their mortgage is the Home Affordable Modification Program (HAMP). There are eligibility requirements to qualify for HAMP. If you qualify, the program can lower your monthly mortgage payment, making it affordable.

- Second Mortgages

If you have a second mortgage on your home, it is possible that you can discharge this debt through a bankruptcy. However, there are specific rules for taking this action. In a Chapter 13 bankruptcy, it may be possible to discharge part of your second mortgage if certain conditions are met. If the outstanding balance on the first mortgage is higher than the value of property, then you may be in luck. In cases where this happens, the second mortgage is treated as wholly unsecured claim. Because the property is not as valuable as it once was, it cannot serve as a security interest. Essentially, the second mortgage (lien) can be stripped from the property and the homeowner will receive a break on the payments. Contact a lawyer for more details on this process.
