Family law includes issues of divorce, child custody, child support, spousal support, property division, adoption, paternity, domestic violence, and post-decree matters. *Divorce
The law firm of Mulyk, Laho & Mack, LLC offers clients expert counsel navigating the complex world of divorce law. Whether you plan on initiating divorce proceedings or your spouse has already initiated proceedings, our attorneys can help protect your interests and advocate on your behalf. While our firm is skilled in arbitration, mediation and negotiating settlements, we are also highly experienced and successful litigators. The more contentious issues involved in divorce such as child support, child custody, maintenance and property division often cannot be settled outside of court. *Child Custody
Our attorneys have extensive experience working through complex child custody issues and achieving custody arrangements that are in the best interests of our clients and their children. Even in situations in which parents voluntarily agree to child custody arrangements, the advice and counsel of an experienced family law attorney is paramount in accurately structuring such an arrangement. There are numerous specifics involved with custody agreements including physical custody, legal custody, visitation rights, travel limitations and decision-making protocol among other concerns. Structuring a custody agreement correctly from the beginning will minimize the necessity and expense of post-decree modifications.
*Child Support
Child support is a common issue that is handled in Divorce, legal separation proceedings or between unmarried parents. Support is normally awarded to the custodial parent of a child from the non-custodial parent until the child turns 18. There are some exceptions to this norm, however. Generally, the child possesses the right to child support, though payments are made to the child’s custodian. The attorneys at our firm are experienced in negotiating and litigating the issue of child support. Additionally, we are skilled in handling post-decree modifications of child support and other issues as circumstances of the original decree change.
*Adoption
Our attorneys bring understanding and expertise to the sometimes frustrating adoption process. We are always concerned with serving the best interests of the child. Additionally, we are qualified to serve as guardians ad litem to represent the interests and desires of a child through the adoption process. We are experienced in working with both contested and consensual adoptions in Chicago’s western suburbs including DuPage, Kane, Will and Kendall counties.
*Paternity
Many paternity cases revolve around a mother seeking to determine paternity of her child in order to obtain a parentage decree. A parentage decree has a broad impact on a child’s life including securing insurance coverage, the right to inherit and financial support while the child is a minor. Our attorneys are experienced in advocating for mothers and their children to receive the support they are entitled to under the law. Our firm also represents fathers seeking to establish paternity in order to obtain child custody and visitation rights.
*Domestic Violence
Our attorneys are experienced in handling cases in which violence or the threat of violence is factor. We work diligently to gather evidence and build strong cases to protect the interests and safety of our clients and their children. In many cases, an order of protection(OP) or temporary restraining order(TRO) is required to ensure the safety of our clients and their children. An OP or TRO is typically granted based on the initial affidavit from the victim. For the order to be extended, however, testimony and evidence must be presented to the court. Our attorneys are skilled in preparing all of the necessary information and evidence including medical reports, eyewitness testimony, police reports, phone records and all other relevant documentation. We use all tools at our disposal to obtain the protection our clients and their families need.
*Property Division
There are three main steps in dividing property in a divorce—determining which property is marital property, assigning a value to the marital property and determining how the marital property will be distributed. In general, marital property consists of all property that is acquired during a marriage, which was not acquired by one spouse through an inheritance or as a gift. Valuing that property can be difficult and often requires the assistance of accountants and appraisers. Our lawyers are highly experienced in handling this often complicated aspect of the divorce process.
*Pre-Nuptial Agreements
Pre-nuptial agreements can address a wide variety of issues. Each couple will have different specific needs to address. If either spouse owns a business, for example, a pre-nuptial agreement can be crafted to prevent it from being divided as part of a divorce. Pre-nuptial agreements can also be used to protect assets meant to be inherited by children from a previous relationship. Additionally, they are often used to limit the amount of spousal support that can be granted in a divorce decree. Our attorneys have experience drafting and modifying pre-nuptial agreements to represent the best interests and wishes of our clients.
*Maintenance and Spousal Support
Our attorneys are experienced in dealing with all of the factors that influence spousal support. We are familiar with the norms of the local family law courts and skillful at presenting cases to secure the best interests of our clients. Additionally, we also help clients with post-decree matters of spousal support. As circumstances for one of both former spouses change, so too can maintenance orders.

*College Expenses
A determination of parental contributions to college expenses is a common part of a divorce agreement in which children are involved. Illinois law provides that one or both parents as well as the child may be ordered to contribute to the cost of college, professional school or other types of post-high school training. Children born to unmarried parents are also entitled to college support. *Mediation
A mediated divorce has both advantages and disadvantages in comparison to a litigated divorce. On the one hand, mediation is usually much quicker and less expensive than a divorce proceeding that goes to court. *Civil Union
Civil unions or domestic partnerships are increasingly common between both same sex couples and heterosexual couples. Sometimes a case is not over after you win a judgment. Until you have been paid according to the Court’s order, you may still need to fight for what you are due.
