Law Firm Overview Free Consultation

Kooi Law, a full service Indiana and Illinois injury and accident law firm, is dedicated to providing strong advice and aggressive legal representation to victims who have sustained injury or lost a loved one as a result of the negligence of another. Kooi Law also dedicates its practice to representing clients injured on the job, at the workplace or in the course and scope of their employment. Our firm is dedicated to the representation of wrongful death and personal injury victims and their families throughout the states of Illinois and Indiana. We represent individuals and their loved ones and never work for or defend insurance companies.

Kooi, who's been named to the Rising Stars list in the 2009 and 2010 Indiana Super Lawyers (an award reserved for less than 2.5% of all Indiana attorneys), and the members of his firm are dedicated to representing victims and their families. The firm's cases involve serious personal injury and wrongful death arising from trucking collisions and auto accidents, medical malpractice, brain injuries and spinal injuries, work injuries, defective products and nursing home abuse or medical neglect.

The members of Kooi Law believe in one-on-one interaction with clients. "They need to know what we're doing and why we're doing it at all times," he says. "This is ultimately about their life, and it is their right to be involved in the process from start to finish. It's their case, and that is a fact we never forget." The firm educates clients about the specific details and nuances of each case, including potential outcomes. "We make sure their condition is properly assessed- and treated-and we work with each client to evaluate the total ramifications of their loss, both financially and emotionally," Kooi says.

Accidents are not confined to business hours. Consequently, neither is the service the firm provides to its clients. If injuries limit the client's mobility, it is not uncommon for Kooi and his team to visit them in the hospital or at their homes.

While results are never guaranteed, the firm carefully considers each case before accepting it to maximize its potential. Once on board, the firm dedicates its professional resources and experience to their client's case.

"No one can return to you what you've lost," Kooi says. "But we believe you can move forward with the help of strong advice, aggressive representation and compassion. With these core values in mind, our law firm will give you the peace of mind of knowing that you and your family are taken care of."

Practice Areas Description

Kooi Law Firm provides legal representation and services in the following areas of practice:

- Animal Attacks

Animal attacks, including dog bites, can cause substantial and disfiguring injuries. Without regard to their breed or background, even good dogs can occasionally inflict serious injury to humans. Every year thousands of people are injured and seriously traumatized from the consequences of dog bites or other vicious animal attacks. Of times, there are insurance policies issued to the homeowners or renters whom own that dog that cover the damages inflicted by such acts. These injuries cause victims to incur medical expenses, time away from work, pain and suffering, and occasionally, disfigurement.

- Birth Injury

An injury to a baby can occur at birth due to a complication during the labor or delivery process. These injuries can occur as a result of an improper use of a medical devices or even techniques during the baby's delivery. Our firm has seen such cases with medical devices such as forceps or a vacuum. The harm to the baby caused by such action can lead to a variety of injury or damage, including, but not limited to, lack of oxygen, limb or nerve damage or severe head or brain injuries.

- Brain & Spinal Injury

Injuries to the brain can have temporary or long-lasting effects. Such injuries in a legal setting are sometimes difficult to prove. This is particularly true where injuries appear subjective and there are no signs of physical injury. Because some symptoms can be hidden or difficult to detect, it can be hard for someone who has suffered a brain injury to identify, relay and recover adequate damages for their injuries. It can also be difficult to establish and prove the lasting effects of a brain injury. This makes jury trials involving brain injuries a specialized task for even the most seasoned trial attorney. Kooi Law Firm has experience with traumatic brain injury cases and is aware of the multitude of long-term effects that can plague a Traumatic Brain Injury victim. We also have experience with effective methods of proving the impact of these injuries.

- Car Accidents and Auto Collisions

If you or a loved one have been hurt, injured or killed in an Indiana car accident or Illinois car accident, it is likely you have incurred medical bills, property damage, lost wages or pain and suffering for which you are entitled to compensation under the law. Our auto accident lawyers know that injuries affect entire families through loss of services and the love and affection of the injured person. Achieving just compensation for people involved in any type of automobile, motorcycle or trucking accident, as well as those affected, requires the highest degree of skill, knowledge and attention to detail.

The car accident attorneys at Kooi Law Firm posses the precise skill set necessary to protect the rights and benefits you or your loved one. The Car Collision Lawyers at Kooi Law Firm are committed to getting the best possible verdicts and settlements for their clients. We recognize how an injury can affect you physically, financially and emotionally, as well as your family. That is why we provide our clients competent, common-sense advice, and will take the time to listen and explain all options and solutions so that you can participate in making the choices which best meet your needs.

- Concert Injuries

The concert and entertainment industry has known for decades about the dangers of concerts that proceed without proper planning. Proper planning or failure to appreciate risk can and will eventually lead to tragedy. When things go wrong at these venues, there are a myriad of legal issues that may develop. These include liability for failures and injuries, insurance coverage, as well as issues on how to file appropriate claims.

In many cases, these claims may involve a government entity that requires notice of a claim far sooner than the two statute of limitations. For example, in most cases any claim against a governmental entity such as a government owned venue, State Fair Grounds, Concert Hall, library, etc. must file a Tort Claim Notice advising the entity of their potential claim. Failure to file the Tort Claim notice within the proper time frame (90 days in Indiana) could preclude recovery. Anyone injured at such a location should consult with an experienced attorney as soon as possible to allow for evaluation of their claim.

- Construction Accidents

If you or a loved one has been hurt, injured or killed from a construction accident, you should contact an experienced Indiana construction accident lawyer or Illinois construction accident lawyer. Our firm represents victims of construction accidents throughout the State of Indiana and Illinois, including Chicago, St. Louis, Indianapolis, Champaign, Urbana, Bloomington, Fishers, Carmel, Greenwood, Normal, Peoria and Decatur.

- Defective Products

A defective product can be any item that causes a person injury or harm as a result of a defective design, manufacturing or ineffective or false labeling. According to the Consumer Product Safety Commission, nearly 22,000 fatalities and in excess of 29 million injuries are associated with consumer products annually.

In looking at these cases, Kooi Law Firm will work with skilled experts to determine the viability of a claim. Anyone injured as the result of a defective, poor design, ineffective or failed warning, or unreasonably dangerous product can file suit against the corporations involved in introducing the product into the market - including manufacturers, designers, distributors and the end selling retailers. Those injured should act immediately to preserve evidence by keeping the product in a safe place and taking photos. Purchase information, receipts and instruction manuals or pamphlets are also helpful to establish the use and chain of custody.

- Funeral Home Claims

Funeral homes charge the families of deceased loved ones large sums of money in exchange for their agreement to provide funeral and burial services. When a funeral home breaches your family’s trust and improperly handles this process, it can lead to traumatic emotional distress and concern. During this time, families need vigorous representation to pursue legal remedies such as breach of contract or negligent or intentional infliction of emotional distress. At our firm, we understand that such conduct can tarnish the memory of a loved one, and holding funeral homes accountable for their actions is important. We will do everything we can to compensate your family and hopefully prevent future misconduct.

- Work Comp Injury

As a general rule of thumb, the Indiana Work Comp Act requires employers to maintain worker’s compensation insurance or a self-insured program. While there are exempt employees (railroad workers, realtors, household employees in a primary residence, farm workers, prisoners and some ambulance, police and firefighters, etc), most employees injured on the job are covered under the Indiana Workers' Compensation Act.

- Insurance Disputes

When individuals purchase an insurance policy, they do so to protect themselves against the unexpected. The unexpected should not occur when an insurance company fails to meet their obligations under the law or the terms of the policy. Our firm will vigorously represent you against your insurance company to resolve primary and excess insurance carrier coverage and to evaluate and resolve coverage disputes, including declaratory judgment actions, and direct actions based upon bad faith and excess judgment claims.

- Medical Malpractice

We represent clients injured or killed as the result of malpractice. Indiana Medical Malpractice can result in serious personal injury or wrongful death. Indiana Medical Malpractice and Illinois Medical Malpractice occurs when a physician or medical care provider (including facilities) fails to meet the standard of care as required by others practicing in the same or similar areas of medicine.

- Medical Negligence

Medical negligence refers to the failure of a physician or other medical personnel to meet the standards of conduct for duties relating to the medical profession. The standards of conduct expected for duties relating to the medical field are based on what a reasonable medical care provider with like-kind requisite knowledge and skills would or would not do.

- Motorcycle Accidents and Motorcycle Collisions

While the severity of motorcycle accidents sometime give the mode of transportation a bad reputation, as motorcycle injury lawyers our firm knows most accidents and injuries involving cycles are not the fault of the cyclist; rather, the dangerous and oblivious driving of those larger vehicles that surround them. This is exemplified by the fact that approximately 80% of reported motorcycle crashes result in injury or death for their drivers and occupants. By comparison, this figure is only about 20 percent for car accidents and truck collisions. Unfortunately, drivers of motorcycles are often at the whim of those around them. This can lead to danger for those who love to ride. Currently, there are over 4 million motorcycles registered in the United States. While motorcycles make up only 2% of the vehicles operating on U.S. roadways, motorcycle fatalities make up almost 5% of all highway fatalities each year.

- Nursing Home Injuries or Abuse

Nursing homes are paid to protect and care for the weak and vulnerable. As nursing home negligence lawyers, Kooi Law Firm helps victims and their families ensure this is done. When it is not, Kooi Law Firm helps victims recover compensation for nursing home neglect and abuse and hold these facilities accountable. Our nursing home injury attorneys believe that holding nursing homes accountable for their conduct is important, and we will do everything we can to expose a nursing home's neglect and compensate your loved one.

- Personal Injury

We represent victims of the most common types of personal injury claims such as car accidents and car crashes, work accidents and workers compensation claims, slip and fall injuries and tripping accidents, assault claims and battery injuries, property accidents and premises injuries, and product defect accident and product liability claims. When lawyers reference personal injury they often are also referring to medical malpractice and dental injuries and accidents. Medical Negligence claims can also encompass physical conditions or diseases frequently found in the work place, including asbestosis and mesothelioma, emphysema, bronchitis, chronic asthma, COPD, and chronic obstructive airways disease), occupational or work-related deafness, occupational or working stress, and repetitive motion injury cases.

- Premises Liability

Property owners, including business and homeowners, have an obligation under the law to make their premises safe for customers, and, in some cases, those who lease from them. When dangerous conditions such as ice, snow, leaks and other hidden dangers, are not remedied or revealed, they can cause serious, and in some cases, disabling injuries. Put our firm to work for you and we will do our very best to hold the property owner responsible for their negligence.

We handle cases involving landlords and businesses who may be in violation of housing codes, local ordinances or National safety standards that have resulted in serious injury to you or a guest of your premises. Early in the case, our investigators focus on these legal issues to maximize your chances of recovery.

- Trucking Accidents & Semi Collisions

If you or a loved one is suffering from the devastation of an impact with a big truck or semi, call the trucking accident lawyers and semi collision attorneys at Kooi Law Firm to get the sound advice of an experienced advocate for victims of semi truck accidents. We never work for or defend insurance companies, and we will use our experience and diligence to protect you and your family in this time of need.

- Workers' Compensation

Workers' compensation laws in Illinois and Indiana are very particular in how and when an application for adjustment of claim (a Complaint) must be filed. Because of this, it is essential that individuals who have sustained an on-the-job injury consult with an experienced workers' compensation attorney as soon as possible. A competent and experienced work comp attorney can efficiently and effectively analyze the facts of a particular case and apply the work comp laws to the claim's specific facts. By taking such measures, both the employee and their counsel can ensure that they will meet all legal requirements necessary to obtain the maximum compensation for the injury sustained.

- Wrongful Death

Wrongful death claims are somewhat self-descriptive. These claims can occur when a person is killed due to the negligent or intentional acts, abuse or misconduct of an individual, company or entity. These acts can vary in circumstance and facts, and may include reckless or careless driving, assault and/or battery, a death in the course of crime, drunk driving, vehicular manslaughter, manslaughter, murder, or medical negligence or abuse. If a victim is wrongfully killed as a result of such acts, their family, dependents or loved ones may have a basis for a lawsuit against the party or parties who caused the death and/or committed or contributed to the effect of the incident causing death.
