- Lemon Law

Lemon laws are U.S. state laws that offer remedies to consumers for products such as boats, cars, computers, motorcycles, refrigerators, RVs, etc. that frequently fail to meet the set standards of quality and performance. These products are commonly referred to as “lemons”. There are both state and federal lemon laws that protect the interests of consumers. The rights afforded to consumers by lemon laws may exceed any warranties expressed in purchase contracts. The Federal Lemon Law is also referred to as The Magnuson Moss Warranty Act in legal terms. Most of the states also have independent laws and acts that govern lemons. These laws are named differently in each state and vary considerably from state to state. The Krohn & Moss Consumer Law Center® wants to help you understand your rights and responsibilities under the Lemon Law, and equip you with the information and expertise needed to obtain a fair resolution.

- Consumer Fraud / Auto Fraud

There are a number of federal and state laws designed to protect consumers from the many deceptive and unsavory practices used in connection with purchasing and financing an automobile. Auto fraud is a very broad area. There are many different types of auto fraud, and the defendants include: insurance companies, car dealers and manufacturers, extended warranty companies, service contract companies and car finance companies. Few things are more annoying in the purchase of a vehicle than to find out that it has sustained prior accident damage. In many states, it is illegal to sell a new vehicle that has sustained some form of body, structural, collision, or other damage up to a certain percentage of the manufacturer’s suggested retail price for the vehicle without first disclosing the prior damage to the buyer. It is also generally considered illegal to sell an unsafe vehicle, to make affirmative misrepresentations about a vehicle, new or used, or to lie to a consumer in response to questions asked about a vehicle.

- Class Action Lawsuits

A "class action" is a civil suit brought by one or more people on behalf of themselves and others who are similarly situated. In other words, the others are in substantially similar circumstances where the common issues are the most critical to the lawsuit. Class actions are those brought by a group of people against the manufacturers of allegedly defective products. Examples of class action law suits include claims by: consumers who purchased the same defective product or were harmed by similar unfair business practices committed by a corporation; merchants and consumers who pay inflated prices for products caused by the anti-competitive activities of large corporations; and tenants that have been affected by the policies of a rental company.

- The Magnuson Moss Warranty Act

The Magnuson-Moss Warranty Act is a federal law that governs the content and regulation of consumer product warranties. This Act is designed to protect the rights of consumers and detail the obligations of warrantors that are offering written warranties with their consumer products. The Magnuson-Moss Warranty Act gives consumers considerable rights in dealing with manufacturers of “lemon” products. The Act requires that all warrantors meet certain minimum requirements when issuing a written warranty to a consumer and that the terms of the written warranty be fully disclosed before purchase. The Krohn & Moss, Ltd. Consumer Law Center® can represent your rights under the Magnuson-Moss Warranty Act. It is our goal to provide legal services to consumers utilizing the laws that provide for payment of our attorneys’ fees by the manufacturer, seller or warrantor. Thus, our clients do not pay attorneys’ fees, but only minimal court costs and filing fees.

- Warranty Rights

A warranty is an agreement between a seller or manufacturer and the buyer stating that the product will work as intended or that the warrantor will agree to repair any defects and non-conformities in the product. A warranty binds the manufacturer or seller to take responsibility in the event of a malfunction to repair or replace defects in your product within a given period of time. Warranty problems occur when the company has misstated its policy or when the language included in the warranty is confusing. The main problem which lies in warranty is warrantors refusing or failing to honor the warranties they unilaterally drafted and provided to the consumer. However, it is the seller's responsibility to make sure that the warranty's language and intent is clear. Based on the laws that govern warranties, a manufacturer should either repair the nonconformity or replace the product in fully working condition, or in some instances even refund the money that you paid for the product.
