- Employee Discrimination

Unfortunately in today's society, many employees still face discrimination in the workplace. To combat such discrimination, the Federal Civil Rights Act (Title VII) and the Florida Civil Rights Act were enacted. The purpose of these anti-discrimination laws are to assure equality of employment opportunities and to eliminate those practices and devices that discriminate on the basis of color, religion, national origin, gender, age, handicap, and disabilities.

- Retaliation

One of the worst things that can happen to a hard working person is getting let go by their employer for no legitimate reason. Worse still, is when a person gets blamed and ultimately fired for something they did not do. Retaliation occurs when employees suffer adverse consequences for exercising their legal rights.

- Wrongful Termination

- Employment Law

Unpaid wage claims are governed by State law. Wage has been defined as every remuneration payable for a given period to an individual for personal services, including salaries, commissions, vacation pay, dismissal wages, bonuses, and reasonable value of board, rent, housing, lodging, payments in kind, tips and any other similar advantage received from the individual's employer. The attorneys at LaBar Adams believe that everyone is entitled to an honest day's pay for an honest day's work. There is never a fee or cost unless you prevail against your employer.

- Fair Labor Standards Act

Employee overtime (forty or more hours in a workweek), wage and hour, and minimum wage is protected by the Fair Labor Standards Act ("FLSA") and as the Department of Labor has stated "almost every employee in the United States is covered by the FLSA." If you worked in excess of forty (40) hours in a given work week while employed by your prior employer, you may be entitled to recover money damages. You may be entitled to money damages even if you were a salaried employee, a commissioned employee, or categorized as an "independent contractor."

- Unemployment Compensation

Florida's unemployment compensation law provides compensation to those individuals who are unemployed through no fault of their own. - Employee Retirement Income Security Act

ERISA (the "Employee Retirement Income Security Act") is a federal law that governs health and retirement plans for non-governmental employees. ERISA imposes minimal standards upon individuals that manage ERISA qualifying plans. COBRA (the "Consolidated Omnibus Budget Reconciliation Act") is a subsection of the ERISA law. COBRA provides for continuation of health care coverage (for a limited period of time) for employees and beneficiaries after they stop working. COBRA also imposes a notice requirement that every employee receive notice of their rights under COBRA.

- Consolidated Omnibus Budget Reconciliation Act

A person who has been fired from their job faces many difficult challenges. Not only is the prospect of finding a new job daunting, there may be other consequences besides simply being out of work. The biggest concern for terminated employees is often health care coverage. Besides being unable to pay the bills, one may face the secondary crisis of not having health care coverage for the family.

- Employment Law

Individuals that are discriminated or retaliated against because of a disability are protected under the Americans with Disability Act. The Act protects disabled individuals from discrimination in employment, public accommodations, transportation, state and local government operations, and telecommunications. A disability under the Act is defined as a physical or mental impairment that substantially limits one or more major life activities. Major life activities include, but are not limited to: caring for oneself; breathing; doing manual tasks; walking; sitting and standing; hearing and speaking; seeing; working; lifting; reaching; and maneuvering.

- Equal Pay Act

Gender-based discrimination in rates of pay to employees, whether male or female, is prohibited by the Equal Pay Act of 1963. The Equal Pay Act is directed at wage discrimination between the sexes and forbids the specific practice of paying unequal wages for equal work to employees of the opposite sex. If you find that you are getting paid a different wage than the opposite sex for a job that requires equal skill, effort, and responsibility, and which is performed under similar working conditions, than you may have a claim under the Equal Pay Act.

- Pregnancy Discrimination Act

The Pregnancy Discrimination Act protects a pregnant woman's right to remain in the workplace. It protects female workers from being treated differently from other employees simply because of their capacity to bear children. Pregnant women who are able to work must be permitted to work on the same conditions as other employees, When pregnant employees are not able to work for medical reasons, they must be accorded the same rights, leave privileges and other benefits, as other workers who are disabled from working due to being pregnant.

USERRA was enacted by congress to prohibit employment discrimination on the basis of military service as well as to provide prompt reemployment to those individuals who engage in non-career service in the military.
