In order to recover the statutory penalties, a claimant must submit a satisfactory proof of loss and show that the insurer failed to pay the claim within the applicable statutory period either without probable cause or in an arbitrary and capricious manner. A manufacturer is liable for damage caused by a characteristic of the product that renders the product "unreasonably dangerous" when such damage arises from a "reasonably anticipated use" of the product.
