Practice Areas
Practice Areas Description
- Criminal DefenseIf you face criminal charges anywhere in the State of Maryland, an experienced and respected defense lawyer can help protect your rights, evaluate possible defenses, negotiate preferential plea bargains and use every facet of the law in your defense. At the Law Offices of Charles L. Waechter, I bring more than 25 years of experience to the job of defending people accused of criminal charges ranging from Federal and State Internet child pornography to sex crimes and serious traffic offenses.
- Federal and State Internet Child Pornography
Child pornography cases are often referred to federal prosecutors in cases involving a large number of images and also with persons interacting with file sharing networks. If you face a federal Internet crime, you need a defense lawyer who is well versed in the rules, procedures and consequences of the federal court system. Distribution and possession of Internet child pornography is a growing area of criminal prosecution, both in Maryland state and federal courts. Finding a defense attorney who understands the appropriate legal defenses of Internet sex crimes is essential to ensure the fullest protection of your rights and privacy.
- Child Abuse / Child Sexual Abuse
Child abuse and child sexual abuse charges can result in the loss of your freedom, your reputation and your parental rights. An experienced defense lawyer can help you take immediate steps to protect your rights and your future. In Maryland, child abuse usually involves acts such as striking a child on the face or beating a child. However, parents can be also be charged with misdemeanor child abuse for acts of corporeal punishment such as spanking a child with a belt or washing a child's mouth out with soap. Child sexual abuse is a felony that involves allegations of molestation, fondling or rape of a minor.
- Sex Crimes
Being accused of a sex crime is a shattering experience, especially when those charges involve a minor. The stigma and consequences can last a lifetime, and you need a lawyer who defends sex crime cases on a regular basis. I provide criminal defense representation for all sexual offense charges in Maryland, including: sexual assault and rape; statutory rape; child sexual abuse and molestation; distribution and possession of child pornography; chat room offenses, including online solicitation of a minor for sexual purposes; solicitation and prostitution; indecent exposure; and sex offenses such as sodomy.
- DUI / DWI
Maryland's driving while under the influence (DUI) and driving while impaired (DWI) laws are harsh. A conviction will result in the suspension of your driver's license and many thousands of dollars in fines and added insurance costs. While the cost of fighting a DUI or DWI conviction may be high, the cost of pleading guilty may be higher. In Maryland, you can be convicted of DUI if you operated a motor vehicle with a .08 blood alcohol concentration (BAC). You can be convicted of DWI if you have a .07 BAC, or if you appeared to be intoxicated at the time of your arrest. A DUI conviction carries a maximum penalty of up to one year in prison and a $1,000 fine. A DWI conviction carries a maximum penalty of up to 60 days in jail and a $500 fine. Both the jail time and the fines will double on your second conviction.
- Drug Crimes
The consequences of a drug conviction can vary greatly. Possession of a small amount of marijuana is a misdemeanor that can usually be resolved without a conviction. Possession of a large quantity of meth or crack cocaine can lead to federal drug charges and a lengthy prison sentence. As your lawyer, I will tailor my defense to the circumstances of your case to obtain a positive outcome. If you face serious felony charges such as distribution of drugs or manufacturing heroin, cocaine or meth, I will provide you with an aggressive and hard-hitting defense.
- Handgun Offenses
Handgun offenses can affect people from all walks of life, from store owners who carry a concealed handgun in self defense, to people who carry weapons in the commission of the crime. The consequences of carrying or transporting a handgun without a license can be high no matter who you are or why you were carrying it. In Maryland, it is legal to have a handgun in your home. If you take the gun outside of your home, however, it must be registered and you need a permit to carry it. You can be charged with a handgun offense even if you carry a gun in the trunk of your car.
- Traffic Offenses
I defend people charged with all kinds of traffic tickets in Maryland, including: reckless driving, negligent driving, speeding tickets, running a red light or a stop sign, driving without insurance and driving on a suspended license. Even if you think you are guilty of a traffic offense, there are reasons to fight the charges. As your lawyer, I can seek to negotiate your ticket to an offense that will avoid a loss of points on your driver's license − and therefore will not affect your car insurance rates or your ability to drive. If the police officer does not show up in court, I can get your ticket dismissed.
