New York uncontested divorce is a great way to save money, time and prevent the heartache from a litigious divorce. Uncontested simply means not contested, or not argued or litigated. The issues commonly contested, or argued, in divorces are: whether both spouses want to get divorced; the grounds for divorce (i.e., adultery, abandonment, cruel and inhuman treatment); the division of assets or liabilities; child support, custody and visitation; whether one spouse will receive maintenance or alimony. If you and your soon to be ex-spouse can agree upon the issues, then you qualify for a New York uncontested divorce.
- Uncontested Divorce with Children
Uncontested divorce, although an extremely simple and streamlined process, is a little more complicated when children are involved. The court examines the uncontested divorce paperwork a lot closer when children are involved. The court is responsible for ensuring that the children’s’ rights are being protected, as they are minors and can’t fend for themselves.
- Stipulations Regarding Child Support
The Child Support Standards Act requires certain Child Support Guidelines be followed unless both parties agree otherwise in writing. A Stipulation Regarding Child Support is an agreement that you and your soon-to-be ex-spouse enter into as part of your divorce in which you can: opt out of the Child Support Guidelines and sets the terms and conditions of the child support for your child or children. I always advise that people retain a competent divorce attorney to prepare their Stipulation Regarding Child Support.

New York child support calculations are extremely complicated. We have seen many clients whose divorce paperwork has been rejected by the court over and over again because of child support calculation issues. Don’t let this happen to you. Many clients come to us after their papers have been rejected by the court. Many times, their papers are rejected because they failed to handle child support properly. They either failed to cite the Child Support Guidelines entirely, the reason for any deviation, or simply made incorrect child support calculations.

A New York Marital Settlement Agreement, also known as a Stipulation of Settlement, is a contract that you and your soon-to-be ex-spouse enter into regarding the distribution of your property. The Marital Settlement Agreement / Stipulation of Settlement allows you to retain control over what happens to your property rather than asking the court to get involved to divide your property “equitably.”
