- Landlord / Tenant

Our firm provides representation in both commercial and residential tenancies in most of Central and Northern New Jersey including, Monmouth, Ocean, Middlesex, Hudson, Union, Passaic, Essex, and Sussex counties. Our client base includes many large real estate management companies, as well as some landlords who are just entering the business. Due to the large volume of cases our office handles, our rates are extremely competitive and we offer bulk filing discounts for large complexes. Our firm also recognizes the immediate attention that all evictions require. The slightest delay in processing our eviction complaint will result in lost profits. Since opening our office in 2002, we have specialized in “instantaneous” filings of all evictions. Specifically, we file most of our complaints within 24 hours of the time we receive them. In some cases, we even hand–deliver your complaint to the Courthouse to ensure the soonest possible trial date.

- Tax Appeals

Our firm takes great pride in its high rate of success in reducing Real Estate Tax Assessments. Our office has handled several hundred tax appeals, very often on a contingency fee basis, reducing the assessments for over 80% of our tax appeal clients. Since 2004, our firm has successfully reduced our clients’ tax assessments by more than $20 Million. Our representative results include $1,500,000 in assessment reductions in Lavallette and over $8,000,000 in assessment reductions in Lakewood. In 2008, Mr. Mirne became one of a select few attorneys to be certified and licensed by the State of New Jersey as a Tax Assessor. Our firm works with a team of highly qualified appraisers to will not only prepare your report, but will also testify at your hearing if necessary to ensure that your property receives the proper assessment. Following a successful tax appeal, your assessment generally cannot be raised for a minimum of three years (the year of the appeal plus two additional years). Because the amount of real estate tax that you pay is a function of your property value, it is essential that you file a tax appeal if you think the municipality has over-assessed your property.

- Zoning and Land Use

Our law firm has significant experience in zoning, planning and permitting matters with particular emphasis on commercial properties. We consistently work with some of the most highly respected and best-known engineering firms and architects in the region, who lend their expertise to the preparation of exhibits for our hearings, as well as credible testimony at those hearings. The firm has counseled clients or appeared before zoning boards of adjustment, planning boards and governing bodies in municipalities throughout New Jersey in connection with zoning and land use matters. In addition to representation of petitioners, the firm has also represented objectors to zoning applications. In 2006, the firm successfully prevented a gas station from being built near a residential neighborhood.

We handle a wide variety of business, real estate, and contract dispute litigation in Monmouth, Ocean and Middlesex Counties. Since opening our firm in 2002, the Law Office of Michael D. Mirne, L.L.C. has been active in the practice of Collection Law. Coupled with our tenancy practice, we have been successful at obtaining money judgments against both residential and commercial tenants. Since New Jersey Courts take a bifurcated approach to resolving tenancy disputes, evicting the tenant is only half the battle. The challenge sometimes begins when a Landlord has to track down the tenant and commence legal proceedings to recover the unpaid rents that the tenant owes to the Landlord. Our office has the resources to track down your delinquent tenants and pursue legal actions for their past due balances. We will handle your entire matter, from sending the debtor a letter that is compliant with the Federal Fair Debt Collections Practices Act, to filing a civil action either in the Special Civil Part or Law Division of the Superior Court, to docketing your judgment if necessary. We can also perform wage garnishments if necessary.
