- Medicaid Trusts

A Medicaid trust is a way to transfer money to someone you trust with restrictions so that they cannot just keep the money. If you no longer qualify for long-term care insurance, a Medicaid trust is a great way to secure your future eligibility for Medicaid. The key word here is “future,” because a Medicaid trust will not qualify you for Medicaid immediately - there will be a penalty period, which can be up to five years but is often less. If you have an immediate need for Medicaid, there are a number of other techniques we can use, such as a Gift and Loan or a spousal refusal. The main advantage of the New York Medicaid trust is that it allows you to receive Medicaid in the future. This allows you to protect the family’s assets from being used to pay for your medical and nursing home care.

- Special Needs Trusts

The Purpose of the Special Needs Trust is to protect its beneficiary from losing government benefits such as Medicaid and SSI. A Supplemental Needs Trust, (also known as Special Needs Trust) enables the disabled or sick person to have substantial assets and still receive Medicaid and SSI. In conjunction with other Medicaid and SSI planning strategies, a Special Needs Trust is paramount to protecting assets from being counted for the purposes of Medicaid, SSI, vocational rehabilitation, subsidized housing, and other benefits based upon financial need. Supplemental Needs Trusts are completely legitimate, being authorized by New York State and Federal Law.

- Will Contests

The only way to overturn a New York will is to present a legally sound challenge and prove the underlying facts. If you are involved in a will contest, your next step should be to contact a New York estate attorney and describe the circumstances behind the will. The attorney will determine whether the objections have merit, and may request a kinship hearing or the court examination of those involved before deciding whether it is worth your while to invest in a full-blown will contest. It is common for a will contest to settle before trial, especially if family is involved. If settlement is not possible, the sides exchange documents and information and ultimately proceed to trial.

- Spousal Claims

Spouses of the deceased have strong inheritance rights under New York law. If the decedent died without a will (intestate), a spouse has the right to fifty thousand dollars and one-half of the residue of the estate. Even if there is a will disinheriting the spouse, a spouse still has a limited time to claim the "elective share" of the greater of fifty thousand dollars or one-third of the estate (up to one-half of the estate if the couple has no children). A prenuptial agreement may restrict a spouse’s ability to claim a right of election. On the flip side, there are many ways to declare a prenuptial agreement to be invalid.
