Practice Areas Description

Our practice includes:

- Bankruptcy

Bankruptcy is a legal vehicle that is governed by the court systems and gives you time to resolve your financial problems under the protection of the law. When you file bankruptcy, all creditors are immediately prohibited from: calling you; suing you; foreclosing on your home; garnishing your wages; repossessing your car; and, getting a judgment against you. It gives you options for catching up on delinquent home and car payments or gives you time to decide if you do not want to keep the property. At the end of a successful bankruptcy case, the court issues an order that states your debts (subject to exceptions) are discharged or wiped out. You do not have to repay those debts after you receive the discharge order, and creditors are prohibited by law from collecting on those debts.

* Chapter 7 Bankruptcy

Chapter 7 bankruptcy is a liquidation bankruptcy that allows you to wipe out most of your unsecured debt. Chapter 7 bankruptcy filers in Georgia often ask if they can keep their houses and cars in bankruptcy. Yes, you can even keep your house and your car in a Chapter 7. To qualify to file a Chapter 7 bankruptcy case in Georgia, you must have not filed a Chapter 7 bankruptcy less than eight years ago and must also meet an income test that is referred to as the “means test.” The means test uses median income for your household size as a threshold for qualifying to file Chapter 7.

* Chapter 13 Bankruptcy

A Chapter 13 bankruptcy is often utilized for debtors in Georgia to keep their homes and cars when they are behind on the payments. Chapter 13 is a form of bankruptcy that consolidates your debt into a payment plan based on your current disposable income and reasonable expenses. The Chapter 13 payments are made over the course of three to five years and must be approved by the court. Chapter 13 is a good option for debtors who are in arrears with their houses and cars and would like to consolidate the arrearages into a monthly payment. A debtor in a Chapter 13 may pay back anywhere from 0% to 100% of his or her unsecured debts, depending on the amount of disposable income he or she has at the end of each month.

* Chapter 11 Bankruptcy

Chapter 11 is a business chapter in the bankruptcy code that allows businesses to consolidate and restructure debt. If you are a small business owner, particularly, if you are a sole proprietor or a single-member LLC, you may not need to file Chapter 11, but may benefit from Chapter 7. If you or your business is a candidate for Chapter 11 bankruptcy, the attorneys at The Law Offices of Betty Nguyen Davis can direct you to qualified attorneys who handle such matters. If you have any further questions about Chapter 11, an experienced attorney at The Law Offices of Betty Nguyen Davis can help.

* Foreclosure Defense

Under Georgia law, the mortgage company is required to send certified notice of the foreclosure date and then advertise the foreclosure sale in a legal newspaper for four weeks prior to foreclosing on your property. When you file bankruptcy, your Atlanta, Georgia bankruptcy attorney will notify the attorney for the mortgage company that you have filed bankruptcy to stop the foreclosure on your home. The mortgage company will cancel the sale. If you are under the threat of foreclosure and wish to file bankruptcy to stop the foreclosure, you should talk to our attorneys as soon as possible in order to ensure that the mortgage company has sufficient notice to stop the foreclosure on a timely basis after you file bankruptcy.

* Wage Garnishment

When debtors hire the attorneys at The Law Offices of Betty Nguyen Davis to stop a garnishment, we file the bankruptcy as soon as possible and notify the creditor who is garnishing the debtor of the bankruptcy filing. The creditor is required to stop the garnishment action. If the creditor has already garnished your pay check, you may not be able to recover the money already taken. However, future wage garnishment should stop. You will probably want to speak with your human resources or payroll manager to ensure that they are aware that you have filed bankruptcy to stop the garnishment.

* Stop Repossession

In Georgia, you can file bankruptcy to stop repossession and even have time to get your car back after it has already been repossessed when you file bankruptcy. When you are behind on your car payments, creditors have the right to repossess your car. Whether the creditor is going to show up unexpectedly at your home or place of employment to take your vehicle is a stressful fear. Filing Chapter 7 bankruptcy can at least temporarily stop repossession so that you can have a plan for how to address your financial situation. Filing Chapter 13 bankruptcy could enable you to consolidate past due payments to automobile creditors and other debts into a monthly payment.

* Tax Debt

Past due income taxes to the IRS and Georgia Department of Revenue may be wiped out in bankruptcy in certain situations. If the IRS or Georgia Department of Revenue has levied your wages or filed a lien against your property for past due tax debt, you may wonder whether the tax debt is dischargeable in bankruptcy. There is much confusion as to whether tax debt is dischargeable in bankruptcy. As a general rule, IRS tax debt is not dischargeable in bankruptcy. The truth is that bankruptcy may wipe out your tax debt, depending on how old the tax debt is. Due to the complexity of tax debt and bankruptcy, you should consult an attorney to advise you as to the best course of action to address tax debt.

Our firm represents victims who have been injured as a result of another person's carelessness in cases involving automobile and trucking accidents, premises liability, and medical malpractice in the Atlanta, Georgia area. * Car/Auto Accidents

In Atlanta, Georgia, when you are involved in a car accident and injured as a result of another person's carelessness, Georgia law may give you the right to recover medical expenses, property damage, and lost wages, along with compensation for the pain you have suffered. Even though monetary damages will never take away the pain and inconvenience of having a car accident, such compensation will help you pay for the costs of medical bills and repairs. The Law Offices of Betty Nguyen Davis will not only help you evaluate your potential personal injury claim due to a car accident in Georgia, but we will also do our best to provide sufficient guidance to ease your mind through the difficult experience.

* Slip and Fall/Premises Liability

Georgia laws require property owners and operators to keep their property in a safe condition and to be responsible for the safety of invited guests and visitors who are injured due to dangerous conditions on their property. The most popular terminology for a premises liability claim is "slip and fall," but a premises liability claim can arise from any dangerous condition that causes an injury to a guest or visitor. Dangerous conditions that could cause injuries to visitors and raise a claim for premises liability include: Lack of security at a place of business; Negligence in apartment complex or hotel security resulting in assault, rape, or even death; Injuries to children due to dangerous conditions on any property.

* Trucking Accidents

With the volume of traffic and number of large interstates in the Atlanta, Georgia area, getting into an accident with a tractor trailer is every driver's worst fear. Injuries that result from a tractor trailer or semi-truck accident are often more severe and debilitating than car accidents, making it imperative that victims of such accidents obtain fair and necessary compensation to pay for both past and future medical care. Tractor trailer cases are more complicated than car accidents not only because of the sheer magnitude of possible injuries and damages, but also because both federal and Georgia laws govern the operation and use of such commercial vehicles. An understanding of such laws, in addition to knowledge about the intricate corporate relationships between employees, independent, contractors, brokers, and shippers, are essential to the successful negotiation and resolution of such cases.

* Medical Malpractice

Georgia victims of medical malpractice often find themselves burdened with medical bills, the need for extended professional care, and the inability to earn a living because of debilitating injuries. Under the worst circumstances, family members are left to grieve for the wrongful death of a loved one due to the carelessness of a medical provider. When medical professionals make mistakes, Georgia law allows patients who have suffered from the consequences of substandard treatment and their families to recover monetary damages for medical bills and for pain and suffering. If you or a family member has been a victim of medical malpractice in Georgia, the Law Offices of Betty Nguyen Davis LLC can help.

* Workers Compensation

If you are an employee in Georgia who has been hurt on the job, you probably have the right to make a workers' compensation claim and to recover for the injuries that you have suffered at work. When employees in Georgia are injured, Georgia law requires that employers pay up to two-thirds of lost wages and for medical bills incurred as a result of the injury. Even though coverage should be automatic, some employers and their insurance companies deny coverage or even fire their employees after they have suffered an injury. If your employer denies your workers' compensation claim, you need a lawyer to ensure that you will be able to obtain the medical treatment that you need to return to work. The Law Offices of Betty Nguyen Davis LLC can help with your workers' compensation claim.
