Law Firm Overview Free Consultation

Edward E. DeWerff, since 1994 has been representing Tennessee residents dealing with the emotional trauma of divorce, the physical pain of a personal injury or the uncertainty following an arrest. He brings not only legal experience and knowledge, but also a keen and unique insight into the opposing side's tactics and strategies. At the Law Office of Edward E. DeWerff, the founder of our firm is your best choice to have someone fighting for your rights and focusing on your best interests, despite the claims of police officers or insurance adjusters.

After a life-changing event involving criminal charges, injuries in an accident or the end of your marriage, you need more than an attorney. You need a protector of your rights. You need an advocate with insight into the opposing side. As a former prosecutor in Tennessee, our founder has a keen insight into how the opposing side prosecutes cases that involve everything from domestic violence to sex crimes. The complexities of a drunk driving charge require the experience of a Montgomery County DUI attorney. The police know your rights. We know your rights. The difference is that we will tell you what they are and our founder will not hesitate to assert those rights in a jury trial.

The emotional element of a child custody dispute as part of a divorce cannot be ignored. The personal impact of a car or truck accident should never be dismissed. Both are life-changing events. Both require immediate legal help to ensure that your needs are met and your rights are protected. If you have been arrested in connection with a crime, assert your right to be silent. If you are facing a divorce, secure an attorney's representation to protect your rights. If you have been injured in an accident, retain a legal advocate to speak on your behalf. Talking too soon or too much can have negative consequences on your case, regardless of the legal issue.

Practice Areas

Practice Areas Description

- Criminal Defense

The law firm of Edward E. DeWerff, Attorney at Law, is committed to protecting your rights and shielding you from the worst consequences of an arrest. You can rest assured knowing that you are represented by an accomplished trial lawyer who knows how to find the weaknesses in the prosecution's case. Ed DeWerff has practiced in criminal law for 20 years — three years as a Montgomery/Robertson County assistant district attorney and as a private criminal defense lawyer ever since. He has handled more than 80 jury trials, including a dozen first-degree murder cases, the last two resulting in not-guilty verdicts.

- Weapon Charges

Mere possession of a weapon is not illegal unless you are a felon or have been convicted of domestic assault. In addition, possessing a weapon does not equate to carrying a gun on your person. It may be on the floorboard of a car you are traveling in with friends. If discovered by a police officer and no one claims ownership, all occupants may be charged. The arrest, however, does not mean a conviction is automatic.

- Homicide

You may think you are helping yourself by speaking to the police regarding a homicide. Cooperation is one thing. Answering questions during a homicide investigation without consulting a criminal defense attorney compromises your rights and can make a bad situation worse. Depending on the circumstances surrounding the death of the victim, you could face serious charges of: first-degree murder, second-degree murder, voluntary manslaughter, reckless homicide, criminally negligent homicide, vehicular homicide and aggravated vehicular homicide.

- Assault / Violent Crimes

Ed DeWerff brings 20 years of criminal law experience to your case, including more than 80 jury trials as both a criminal defense lawyer and a former prosecutor for the Montgomery/Robertson district attorney's office. He has handled the full range of crimes against persons, including: simple assault and battery, domestic violence, aggravated assault (bodily harm or use of a weapon), sexual assault, kidnapping, murder, manslaughter or attempted homicide, robbery and armed robbery and gun crimes (felon in possession, illegal firearms).

- Domestic Violence

Most domestic violence cases involve two people who are married or living together or unmarried parties who have a child together. An argument escalates until someone slaps or hits the other person, grabs or pushes them, throws something or verbally threatens violence. Police are obligated under Tennessee law to arrest the primary aggressor — not necessarily the person who initiated the confrontation, but the person whose actions rise to the definition of assault or aggravated assault.

- Drug Crimes

Ed DeWerff has practiced in criminal defense for 16 years in the Clarksville area. Before that, he was an assistant prosecutor for Montgomery County and Robertson County. He has more than 80 jury trials under his belt, including many acquittals in drug cases. We provide knowledgeable representation for any drug charges: simple possession of marijuana (misdemeanor amount), possession of drug paraphernalia (bongs, scales, etc.), possession of cocaine, heroin, illegal prescription drugs, intent to distribute (possessing a certain quantity) and drug trafficking.

- Drunk Driving / DUI

Ed DeWerff is a former prosecutor and an accomplished criminal defense trial lawyer who has represented hundreds of people charged with drunk driving in his more than 16 years of criminal defense practice. He knows how to raise many legitimate DUI defenses to: get charges dismissed because of sloppy police work or violations of your rights; get charges reduced to a lesser DUI or reckless driving; negotiate alternative or lesser penalties; and fight for your freedom at trial.

- Sex Crimes

Trial lawyer Ed DeWerff has handled all types of sex crimes, including: sexual assault (rape), child rape, statutory rape, aggravated statutory rape (teacher, coach or other authority figure), possession of child pornography, Internet solicitation of underage girls (or boys) and sex offender registry violations Mr. DeWerff is a former prosecutor with more than 16 years of experience in criminal defense, including more than 80 jury trials. He makes every attempt to have charges dismissed for lack of evidence or get charges downgraded to a lesser offense.

- Illegal Search and Seizure

The police must follow strict procedures in a search and seizure. When they fall short, they are not likely to admit it and will move forward with an arrest. Overlooking the simplest of steps violates your rights, requiring you to hire an experienced criminal defense attorney. At the Law Office of Edward E. DeWerff, our founder, Ed DeWerff, is a former prosecutor for the Montgomery County and Robertson County District Attorney's Office. He has an in-depth knowledge of police investigation procedures and can identify when they fall short.

- Family Law

Mr. DeWerff represents men or women in divorce, and the primary residential parent or non-custodial parent in post-divorce matters. He handles all types of family law scenarios, including: divorce and equitable division of property, complex asset division, initial child custody and co-parenting plans, modifications of custody or visitation, parent relocation, enforcement / contempt of court and paternity (child support and visitation rights).

- Divorce / Child Custody / Division of Property

At the Law Office of Edward E. DeWerff, our goal is to lessen the impact of a divorce on the children while striving to minimize your costs and any animosity toward your spouse. While many divorces are resolved through mediation and other forms of alternative dispute resolution (ADR), Ed DeWerff will not hesitate in taking a case into the courtroom if it can provide the best outcome on your behalf. Specific areas of our divorce practice include: military divorce, child custody and co-parenting plans, child support, visitation, parental relocation, complex division of property and assets, enforcement/contempt of court and paternity, including child support and visitation rights.

- Personal Injury

If someone's negligent actions caused your auto accident, or you were injured at work, your rightful compensation is not automatic. The insurance companies will often downplay your injuries and undervalue your claim in attempts to settle for less than you deserve. In 16 years of private practice, Ed DeWerff has helped hundreds of clients recover compensation for medical bills and ongoing treatment, lost wages and future earnings, pain and suffering, and any permanent disability in relation to: car accidents and truck accidents, motorcycle accidents, pedestrians and bicyclists hit by cars and premises liability (slip and fall or trip and fall hazard). Mr. DeWerff also represents surviving spouses, children or parents in wrongful death lawsuits arising from a motor vehicle fatality or other preventable death.

- Workers' Compensation / Third-Party Lawsuits

Your employer is obligated to cover your medical treatment and provide lost wage benefits until you recover from your workplace injury and can return to work. However, companies and their insurers commonly deny or delay workers' compensation claims, disputing the severity of the injury or whether it is work-related. We can step in to assert your rights to get your medical bills paid and receive maximum benefits, including permanent disability or disfigurement. We have represented construction workers, warehouse employees, drivers, health care professionals, office workers and anyone injured on the job, either in the workplace or at a job site.
