- Divorce

A divorce or legal separation case starts with one spouse (the petitioner) filing a petition with the court, and then delivering a copy of the petition to the other spouse (the respondent). The divorce or legal separation will end by trial or by the spouses entering into a Marital Settlement Agreement.

- Child Custody

Of all the issues that can arise in Family Court, your relationship with your child is the most important. This relationship should be protected, and you should be made aware of your parental rights. This is not only for your benefit, but for the benefit of your child as well.

- Child Support

Parents have a duty to nurture and support their children whether parents are married or divorced, separated or never married. If you are approaching divorce or have had a child out of wedlock, it is important to settle questions of child support and child custody in a timely manner. Your children's best interests are the guideline in all issues of child support and child custody.

- Spousal Support

- Property Division

California is a community property state when it comes to divorce. One of the jobs of the Family Court and the family law attorneys is to determine what property is ‘community property’, and what property is ‘separate property.’ Family Code Section 760 defines community property as follows: "Except as otherwise provided by statute, all property, real or personal, acquired by a married person while domiciled in this state [California]…"

- Marital Settlement Agreements and Prenuptial Agreements

Marital Settlement Agreements are contracts entered into by spouses after they separate from each other, they believe their marriage is over, and are in the middle of a divorce or legal separation. The purpose of a marital settlement agreement is to settle disputes over child custody, child support, spousal support, and property division, thereby alleviating the need of going to trial and having a judge make decisions on these issues.

- Domestic Violence

Domestic violence can be not only physical abuse, but verbal, mental and emotional abuse as well. Domestic violence can occur between spouses, between a parent and child, between a boyfriend and girlfriend, or between same sex partners. When domestic violence is committed, the Family Court judge can issue a restraining order protecting the victim against the perpetrator. As physical abuse can also constitute ‘battery’, which is a criminal offense, the District Attorney and the Criminal Court may also get involved.

- Post Judgment Modifications

Even after a divorce or legal separation is over, or even after the Family Court has made a judgment containing permanent orders for child custody, child support, or spousal support, circumstances may arise that justify changing those orders. For example, a spouse who was ordered to pay spousal support to the other spouse may have just been laid off from his/her job through no fault of his/her own, or the other spouse who was receiving support may have obtained a new, high paying job.

- Uncontested Divorce

These are difficult financial times. Many spouses contemplating divorce don't want to fight with each other, and just want a simple divorce based upon an agreement they've already reached which each other. However, these same people try to handle their own divorces, and frequently get frustrated or confused by the legal process and the paperwork. Alternatively, they simply may not have the time to handle their divorces themselves.

- Parental Relocations

Courts typically believe that a child's best interests are served by a parenting schedule that give the child continuous and frequent contact with both parents. However, when one parent wishes to move so far away from the other parent that a shared parenting plan is no longer feasible, a re-evaluation of the custody order and parenting plan is usually required.

- Prenuptial Agreements

Marriage involves the co-mingling of assets, income, and debt. Marriage also creates certain legal rights that affect everything from probate to access to certain kinds of information. Couples interested in protecting themselves or elaborating certain rights before or during marriage can create a prenuptial or marital agreement.
