Law Firm Overview
Founder Joshua A. Schulman began his practice of the law following his graduation from Pace University School of Law in White Plains, New York. He opened his law firm in 1999 to assist victims of negligence as well as medical, dental and podiatric malpractice.
In addition to earning a reputation for personalized representation and an aggressive pursuit of justice, we have also assembled a network of experts in the following fields: hospital administration and staffing, nursing home and long term care and staffing, medicine (including: OB/GYN, Pediatrics, Orthopedics, Cancer, Hematology, etc.), dentistry and podiatry.
Negligence can take many forms inside and outside of a medical or healthcare facility. Victims of car crashes and work-related accidents and those suffering injuries from a slip-and-fall at a store or a mishap at a construction site can also rely on our attorneys for equally aggressive representation.
Practice Areas
Practice Areas Description
- Personal InjuryAn accident resulting in serious and potentially fatal injuries changes your life. A thriving career is sidelined or ended. An active personal life is no longer a reality. Insurance companies want you to settle fast. You need an advocate to even the odds against you. At the Law Offices of Joshua A. Schulman, LLC, we focus our personal injury practice on the following areas: slip and fall, car accidents, work accidents, workers' compensation and construction site accidents.
- Medical Malpractice
Medical Malpractice is defined as the failure of a medical professional (be it a Physician, Surgeon or Nurse) to provide care that meets the "good and accepted standards of medical care existing in the community." Failing to provide care commensurate with these standards means that the medical professional has "deviated from good and accepted standards" and thus committed medical malpractice.
- Prescription Errors
Part of the trust you place in doctors and hospital and nursing home staff involves the accurate prescribing and dispensing of medication. Regardless of the detail involved in documenting your prescription drug needs, errors occur. The wrong medication or more than you were supposed to be administered can have catastrophic consequences. Medication errors are also part of our practice area of nursing home malpractice. Errors are most common in nursing homes and residential care facilities. In many cases, staff members are under-trained and overworked. Misadministration leads to drug interaction that could result in serious injuries or even death.
- Emergency Room Malpractice
Emergency rooms are rife with chaos. The fast-paced and often hectic environment of an emergency department is often unavoidable as doctors and nurses seek to provide immediate care to patients in need. However, that rushed setting often leads to serious oversights and deadly errors. As hotbeds of activity, physicians and nurses can either provide the wrong treatment for patients or send them home, presuming that they do not need any care. In many cases, emergency room doctors handle illnesses, injuries or other medical conditions beyond their expertise.
- Nursing Home Malpractice
Nursing home malpractice encompasses a range of mistreatment, including: failure to maintain nutrition and hydration, medication errors, including administration of wrong medicine and dosage mistakes, unexplained bruises and injuries and pressure sores, also known as bed sores or decubitus ulcers, which indicate poor care. Many nursing home malpractice cases go unreported. Frequently, the residents are unable to communicate the neglect, and family members are not always familiar with the signs. If your loved one has pressure sores, significant weight loss, broken bones or other indication of nursing home malpractice, the Law Offices of Joshua A. Schulman, LLC, can help.
- Dental Malpractice
The fields of dentistry that have the highest frequency of malpractice are: failure to diagnose and treat periodontal disease; failure to diagnose oral cancer; extractions; dental (osseous integrated) implants; prosthodontics (crowns and bridges); ondodontics (root canal therapy); orthodontics (braces); and orthognathic surgery. It is important to bear in mind that not every less than desirable outcome is necessarily the result of malpractice. There are occasions when the dental practitioner has done everything correctly and still the patient does not do as well as expected or hoped.
- Nursing Errors
Regardless of schooling, training and on-the-job experience, nurses are not immune to making errors that have serious and deadly consequences. Licensing means little when you or a loved one is suffering the effects of poor treatment or an overall lack of necessary care. Mistakes occur while under the care of registered nurses and midwifes. Pregnant mothers and their babies can suffer serious injuries and death due to negligence. Cases are complex, and proving malpractice is often a challenge.
- Birth Injuries
At the Law Offices of Joshua A. Schulman, LLC, we represent clients in birth injury claims that involve: negligence during labor and delivery, premature birth, ruptured uterus, oxygen deprivation, brain injuries and damage, cerebral palsy, hydrocephalus, brachial plexus, shoulder dystocia, hyperbilirubinemia and Rh-ABO incompatibility. Attorney Joshua Schulman established our New York City law firm and focused his practice on medical malpractice cases. In birth injury claims, he helps establish if malpractice led to the injuries of the mother and/or her newborn child. He combines his experience and legal knowledge with a network of medical experts.
- Podiatric Malpractice
Podiatry malpractice generally involves either foot surgery negligence or failing to accurately diagnose an underlying problem, which suggests improper treatment. When a foot doctor makes an error during a simple bunion surgery, or chooses the wrong procedure to achieve the desired result, the patient may be forced to endure an amputation in some cases. Likewise, hammertoe surgery mistakes can lead to infection or accidental damage to tendons. Podiatrists can also fail to recognize diabetic foot ulcers, or sores, missing the opportunity to refer patients to orthopedists or wound care specialists
- Premises Liability / Slip and Fall
A walk along a sidewalk, a trip to the store or a visit to your neighbor's house should not result in serious injuries. Yet, many New York residents find themselves suffering physical pain following accidents. At the Law Offices of Joshua A. Schulman, LLC, we work hard not only to identify the responsible party, but also to protect your rights. Handling a slip-and-fall claim on your own and settling with the insurance company immediately ignores the complexity of your case. The first step we take in representing clients injured on residential or commercial premises is to identify the property's true owner.
- Car Accidents
There are minimum injury thresholds that must be met for car accident victims to be deemed seriously injured. Permanent limitations on the use of a body part or a loss of a body part meet the requirements of the legal definition. Specific results include: death, dismemberment, significant disfigurement, fracture loss of a fetus, permanent loss of use of a body organ, function or system, permanent consequential limitation of use of a body organ and significant limitation of use of a body function or system. If you are temporarily injured or impaired and cannot substantially perform your usual and customary daily activities for more than 90 days during the 180 days following the accident, you are considered seriously injured and can move forward with a claim.
- Work Injuries
Some work conditions are more hazardous than others. In many claims we handle, dangers were created by a party other than the injured worker or his/her employer. A plumber fixing pipes that caused flooding failed to clean up or another crew on the site left debris, resulting in a serious slip-and-fall injury by an employee. While workers' compensation will protect the employer from liability, the third party must be held accountable. Taking a personalized approach to cases is the only way to discover the truly responsible party. Personal injury and workers' compensation mills that churn out claim after claim may fail to identify the actual cause of the accident.
- Workers' Compensation
Dangers are inherent on a construction site. The most seasoned, hard-working professionals are aware of the hazards. Yet, regardless of experience, knowledge or attention to their surroundings, construction workers suffer serious injuries. Some claims are strict workers' compensation matters. Others are more complex and involve the action or inaction of a negligent third-party. New York construction workers have protection under Section 241 of the Labor Law. Specific steps must be taken by construction site owners and general contractors to ensure work site safety. Adequate protection of a workers health and safety in accordance with laws, statutes and/or codes is required.
