Practice Areas
Practice Areas Description
- BankruptcyThe U.S. Bankruptcy Code provides for several types of debt relief mechanisms depending upon a petitioner's financial circumstances and goals. Bankruptcy does not mean "failure." It does not mean "irresponsible." In many cases, it is an overdue acknowledgment of both a financial problem and its most efficient cure. The Law Offices of Michael H. Raichelson in Woodland Hills, California, is ready to evaluate your financial situation and offer sound advice designed to put you on the road to financial recovery.
- Chapter 11
Chapter 11 may be a costly process, and it is limited to those who have a lot of cash flow or assets but not much savings. A person or business entity that does not qualify for Chapter 7 or Chapter 13 bankruptcy could find Chapter 11 to be a valid option. At The Law Offices of Michael H. Raichelson in Woodland Hills, California, we understand the panic that debt causes our clients. We solve their problems through Chapter 11 bankruptcy. Our experienced and competent California bankruptcy lawyer has the skill and competence to provide favorable results for our clients.
- Chapter 7
When most people talk about bankruptcy, they mean Chapter 7 bankruptcy. It allows people to eliminate most of their debts in a short time, while erecting a legal fence that keeps creditors and bill collectors at bay. At The Law Offices of Michael H. Raichelson, we understand the fears that grip individuals, couples and small-business owners when debt collectors are pounding at the door. We use Chapter 7 to clear their debts and to protect their exempt property.
- Chapter 13
Chapter 13 bankruptcy is often called a "wage earners bankruptcy." The reason is that most people who file are "wage earners" — people who are earning money and not necessarily interested in liquidating assets in exchange for immediate debt forgiveness, as in a Chapter 7 proceeding. Instead, in a Chapter 13 bankruptcy the filer will pay off some past-due and current debts in monthly increments over three to five years according to a reorganization plan and according to what they can reasonably afford. Such debts can include anything from mortgages and car loans to past-due taxes. Also, a Chapter 13 bankruptcy will stop a foreclosure and allow you to make catch up payments over time.
- Lien Stripping
In both Chapter 11 and Chapter 13 of the Bankruptcy Code, the debtor may be able to remove a lien on a property. The process of doing this is called "lien stripping." To lien strip, the debtor must show that the property has no equity to secure the lien. If this happens, the debt will be re-characterized as an unsecured debt, and the lien may be stripped in the bankruptcy.
- Adversary Proceeding
When creditors, bankruptcy trustees or debtors have disputes about the dischargeability of certain debts or the protection of certain assets, an adversary proceeding may result. Either side can file a complaint against the other in bankruptcy court for a variety of reasons. At The Law Offices of Michael H. Raichelson, we represent both creditors and debtors in adversary proceedings.
- Creditors Representation
At The Law Offices of Michael H. Raichelson, we say we represent honest debtors and creditors that are being challenged by dishonest debtors. Bankruptcy litigation is not only about the rights of the person or business that is filing for bankruptcy. Creditors have rights before, and after, a bankruptcy proceeding has begun.
- Asset Protection
Whether you are considering a Chapter 7, Chapter 11 or Chapter 13 bankruptcy, protecting what you have is almost as important as settling your obligations on what you owe. At The Law Offices of Michael H. Raichelson, we protect our clients' assets within the legal limits using the tools of bankruptcy law and the courts.
