To give our clients the best possible representation, our law firm handles a limited number of cases each year. This allows us to concentrate on these few cases and provide personal attention, thorough preparation and ongoing updates. This, plus our attorneys' high level of experience in criminal law, has resulted in an enviable record of success for our clients.
Attorney Ray Taylor is Board Certified in Criminal Law by the Texas Board of Legal Specialization and has written seven books on criminal defense topics. Phil Spicer is known for his research skills in preparing trial and appellate briefs and finding the answers to complex legal questions. The five of them make a formidable legal team that has been able to obtain dismissals, reduced charges, not-guilty verdicts, and to overturn convictions for our clients.
Practice Areas
Practice Areas Description
- Sex CrimesOur firm handles all types of child and adult sex crime cases, including: child molestation, child pornography, indecency with child, internet pornography, aggravated sexual assault (of children and adults), rape, child enticement and solicitation, internet solicitation of a minor, statutory rape, internet pornography, public lewdness, indecent exposure, solicitation and criminal solicitation of a minor, failure to register as a sex offender and prostitution.
- Internet Crimes
In Internet cases, the facts are often very much in dispute. Computer users can have images or messages in their memories that the defendant did not download or have anything to do with. In some cases, they are unaware that the offensive material is stored on their machines. It is important to professionally investigate the source of the images or messages that have resulted in the criminal charges. Our cases include matters such as: possession of child pornography, distribution of child pornography, internet solicitation of minors, internet fraud in sales schemes, sale of counterfeit goods over the Internet, credit card fraud and identity theft.
- Attorney Misconduct
Ray Taylor's knowledge and experience in defending attorneys who have been charged with: grievance defense, disbarment defense, unethical conduct, overcharging, embezzlement from trust funds, attempting to improperly influence a government official, disobedience of court orders, allowing someone else to pose as an attorney using his or her name, misrepresentation on bar admission applications, allegations of incompetence, malpractice and contempt of Court.
- Licensed Professionals Defense
Since 1977, our firm has been defending professionals and occupations licensed by the state of Texas. Losing a license to practice your chosen profession is devastating. It means the loss of your livelihood and a waste of the lengthy training and experience you have gained over the years. It is important to mount an early and vigorous defense against any charges that could lead to the loss of your professional license.
- White Collar Crimes
Our cases in this area include matters involving: embezzlement, internet fraud, bank and savings and loans fraud, conspiracy charges, bid-rigging charges, identity theft, wire fraud and mail fraud, credit card fraud, insurance fraud, money laundering, theft of government property, state and federal attempts to seize private property (forfeiture cases), computer fraud, real estate fraud, federal firearm license cases, political corruption cases, bribery, RICO, mail fraud, crimes on military bases and government procurement fraud.
- Firearm Crimes
In our experience, prosecutors are often inadequately prepared in gun cases, partly because they regard these cases as a slam dunk conviction, and because they do not have the depth of knowledge regarding firearms necessary to counter unexpected defenses. This allows us to mount a vigorous and effective defense in matters such as: unlawfully carrying a firearm, felon in possession of a firearm, carrying a licensed handgun at a bar, polling place, airport, courthouse or other prohibited place, illegal sale of guns, commission of a crime using a firearm, possession of a machine gun (fully automatic weapon), possession of a sawed-off shotgun, modification of a gun to produce fully automatic fire, possession of silenced weapons and possession of explosive devices.
- Hunting Accidents
Our principal attorney, Ray Taylor, is a gun collector and the author of published books on hunting and unloaded gun litigation. He is the former President of the San Antonio Arms Collectors' Association, a National Rifle Association affiliate. He has appeared in virtually all state and federal district courts in Texas as well as the Fifth and Eleventh Circuits of the U.S. Court of Appeals. Ray Taylor has the knowledge, experience and understanding of hunters' concerns to provide a vigorous representation after a hunting accident.
- Juvenile Defense
Mr. Taylor understands the changes in attitude toward juvenile justice that have occurred in the past 20 years. The trend is toward harsher punishment and certification of juveniles for trial as adults. Certification and conviction as an adult takes the child out of the juvenile justice system and allows him or her to receive an adult prison sentence of up to 40 years. A juvenile charge can have tragic consequences that may last a lifetime. Parents need to know that the system will not be looking out for the best interests of their child. That is why you need an experienced Board Certified advocate who will defend the young person's rights and protect his or her future.
- Property Forfeiture
Forfeiture is a tool used by law enforcement personnel when they even suspect a crime and there is currency, real or personal property (especially guns) that might have facilitated or been purchased with the crime proceeds. If you have had money or property seized by law enforcement, it is important to consult a lawyer quickly to learn how you may recover your seized assets.
- Post-conviction Representation
As a criminal attorney practicing law for nearly 40 years, Ray Taylor has in-depth knowledge of sentencing and sentencing alternatives. He understands the operations of the Board of Pardons and Paroles. He is willing to handle the penalty phase of a criminal trial in search of the best possible result for a client. We represent clients at sentencing hearings, motions to revoke probation, and others post conviction matters, such as appeals, writs of habeas corpus, and motions for shock probation.
- Parole Representation
It takes a special "license" to represent prisoners before the Board of Pardons and Paroles. A disclosure copy authorizing the lawyer to practice correction law must be attached to each parole package, together with a proper attorney's affidavit in compliance with Parole Board Rules. Ray Taylor is one of the few Texas attorneys authorized to practice this subspecialty. Because parole rates are at their lowest ever, it is particularly important to seek representation from an attorney who is able to prepare the right parole package. Our law firm is one of a very few firms practicing this area of criminal law in San Antonio and the surrounding area.
- Appeals
To identify the reasons that the initial verdict should be reversed, attorneys Ray Taylor and Phil Spicer usually review page by page the entire trial transcript and other court records individually. They then consult with each other to determine the points that will stand the best chance for reversal. Phil Spicer then writes and edits a logical and step-by-step appellate brief in complete compliance with the complex rules of the Appeals Courts. The attorneys will then present a well organized and effective oral argument to the appellate judges. Appellate court rules are far different from those in a regular criminal trial court. Ray Taylor and Phil Spicer know the rules of the state and federal appellate courts thoroughly.
