In our criminal defense practice, we handle state and federal cases, including complex white-collar crime and racketeering charges, serious felonies, and murder.

We represent clients in post-sentencing matters involving constitutional violations. As a judge’s law clerk, Mr. Miglore researched and drafted for a Judge the opinion in the 1979 case of Donald Lang, applying the new decision standards for fitness to stand trial. Our firm regularly handles cases complicated by issues related to fitness to stand trial, mental illness, and insanity.

Our divorce and family law practice relies on referrals from other attorneys in complex cases of contested divorce, dissipation of assets, and custody and support of special-needs children.

Many of our clients are non-English speaking immigrants who face serious INS consequences for alleged criminal activity. Staff of our firm speak Polish, Russian, Italian, and Spanish. We guide our clients through the immigration law proceedings as well as the criminal law proceedings.

- Criminal Defense

As a knowledgeable defense lawyer, Mr. Miglore recognizes that not all cases that allege shaken baby syndrome have been properly diagnosed and that not all cases of infant death involve abuse. We consult with qualified medical experts to determine if the diagnosis of shaken baby syndrome is accurate. This is especially important when the child requires treatment. * Driver's License Reinstatement and Expungement
After being convicted for a DUI or a traffic violation, Illinois residents will face a license suspension. If you have finished serving your time in jail because you were convicted of a sexual offense, then most likely you will have to register as a sex offender in the state of Illinois with the police department located in the county where you live. If you decide to move, you have 3 days to report your new address to the authorities, even if you are just visiting out of state. Requirements to register as a sex offender, while on probation, could last for up to 10 years or could be for the rest of your life, depending on the type of sexual crime for which you were convicted. * Internet Sex Crimes
If you are charged with an internet sex crime, the state of Illinois will do everything possible to convict you. Since many sex crimes over the internet involve explicit chat room conversations, with police officers posing as minors, you could be charged with attempt to engage in a sexual act with an underage person. This could result in a long-term prison sentence, or require you to put your name on a sex offender registry for the rest of your life.

*Criminal Law and Immigration
Anyone who is arrested in Illinois for felonies involving drug crimes, DUI, or murder and other violent crimes, faces the possibility of losing employment and going to prison for life. When you are an immigrant or non-US citizen, being arrested for any criminal offense can get you deported and can cause you to lose your immigration status and chance at being a citizen. * Divorce
Two of the biggest problems people face when going through a divorce are learning how to live on half the income they had while married, and evaluating marital assets. Attorney Miglore will advise you of your options concerning child support, maintenance, asset division, and possible dissipation of assets. We will help you sort through all stages of your divorce. You will need answers to many questions. While we always recommend working things out during mediation or collaboration, sometimes resolving disputes about common issues in a divorce is not so easy. We help people resolve disputes over these issues.

* Child Custody and Visitation
The majority of custody and visitation decisions are amicably made by both parents. Sitting down and figuring out schedules and plans for raising a child is often in that child's best interests. When decisions about child custody are not resolved so easily, families need to speak to us. The courts make a custody ruling based on the best interests of your child. We will employ experts to make a case for granting you joint or sole custody. Sole custody is generally not awarded absent a showing lack of best interests of the children. We discourage custody disputes because they are costly and often leave families torn.

* Child Support and Maintenance
Child support awards are determined using Illinois's statutory child support guidelines. These guidelines determine the income of each spouse, and calculate the amount of child support needed. In the majority of divorces, the amount of child support is determined easily. Each spouse has a right to receive maintenance, also called spousal maintenance. You may be entitled to permanent or temporary maintenance. The amount of property distributed among the parties during a divorce weighs heavily on the court's maintenance determination. The court weighs a variety of factors to determine maintenance, including: Length of the marriage; Parties' ability to pay; The need of the parties; Standard of living enjoyed during the marriage; Education and ability to earn future income; Mental and physical health; and, Non-marital assets or income.

* Modification of Orders
We petition the court for a modification of a divorce decree for a substantial change in your family's circumstances. We will get a post-decree modification of child custody, maintenance, and a child support judgment. Some common things that require a post-divorce decree hearing involve: Custody and child support enforcements and contempt; Modifications or terminations of maintenance; Child support increases or decreases; When a custodial parent relocates; Parenting plan concerns; Educational and healthcare expenses; and, Issues concerning visitation and abuse.
