Practice Areas Description

- Hospital Negligence

When problems arise because of events that take place at the hospital, there are often multiple parties involved. Doctors, nurses and other health care professionals involved with patient care may all, to some degree, be at fault. Most nurses and technicians are employees of the hospital, which is responsible for their actions. Most doctors, however, are "independent contractors", and the hospital is not liable for their negligence.

- Nursing Home Negligence
Many patients are referred to skilled nursing facilities for convalescence and rehabilitation after surgery or acute illness. They often spend more time recovering in the nursing home than they spend in the hospital. The nurses and staff have a special responsibility to protect the well-being of these patients during their temporary convalescent stay.

- Kaiser Medical Malpractice

Health Maintenance Organizations (HMOs) are designed to help control medical costs. In Southern California, Kaiser is the largest HMO, with almost one quarter of all patients who have some form of health insurance belonging to the plan. Kaiser consists of a system of hospitals, clinics and doctors which provide services exclusively to Kaiser members. When a Kaiser member is injured at a Kaiser facility or through the negligence of a Kaiser professional, they do have the right to pursue a claim for malpractice against Kaiser. However, special rules and procedures apply to such a claim, which is handled in a different manner than one against other medical providers.

- Military Hospital Malpractice

Southern California has a large military community - one that is entitled to the best medical care available. Although active duty servicemen and women are prohibited from filing malpractice claims against military hospitals and doctors, their dependants are not. When military spouses or children are victims of negligent care, the law permits them to recover for their injuries and damages. Retired military are also able to pursue claims against Veterans Administration hospitals and clinics.

- Birth Injuries

Child birth is one of the most exciting times for a parent. It is also one of the most medically challenging and potentially dangerous events of a person's life. There are a variety of injuries that can occur before, during or after delivery - especially if health care providers are not as vigilant as they should be.

- ER Injuries

Patients who visit emergency rooms have problems of varying severity and complexity, and doctors are often required to make very rapid assessments about which patients need the most immediate care. When used effectively, the "triage" system can help ensure that the most critical needs are treated first. When used ineffectively, or when a doctor misdiagnoses a patient's injury or illness, or fails to appreciate its severity, the results can be serious and sometimes fatal.

- Brain Injuries

Any time the flow of blood or oxygen to the brain is interrupted, the brain can suffer injury. Brain injuries can be focal (meaning only a specific part of the brain is affected) or global (meaning they affect the entire brain).

- Cancer Misdiagnosis

When diseases are caught at an early stage, patients typically have more choices and treatment options. In some cases, delayed diagnosis or misdiagnosis can mean the difference between life and death. When tests or lab results are misread or misinterpreted, the consequences can be devastating for a patient, especially when dealing with diseases that respond much better with early treatment, such as cancer.

- Legal Malpractice

Lawyers have an obligation to exercise the utmost care and effort on their client's behalf. When a lawyer agrees to take a case, he or she is expected to have the skill, degree of knowledge and experience to effectively handle the matter. Although an attorney cannot promise a client they will win their case, if they lose, it should not be the result of the attorney's negligence. If you hired an attorney to represent you and that attorney did not perform at the expected standard, an experienced San Diego legal malpractice lawyer can help you hold that attorney accountable.

- Medical Malpractice

Medicine is not perfect - and it would be unrealistic to expect perfection from health care professionals. Despite the best efforts of health care professionals, patients sometimes experience poor outcomes or complications and we do not hold doctors responsible merely because their efforts are unsuccessful. However, when those efforts are less than we expect — when health care providers are negligent, careless or fail to meet professional standards — we expect them to be accountable for the injuries and damages they cause.
