Practice Areas
Practice Areas Description
- Workers' CompensationPeople often wonder why they need an attorney for a New York Workers' Compensation claim. After all, payment is mandated by state law. However, the Workers' Compensation system is complex and recent changes have made it more challenging. Having an experienced attorney to help you navigate the claims process can improve your chances of obtaining maximum compensation for your work-related injury or illness. At Terry Katz & Associates, PC, we help injured workers navigate the Workers' Compensation system. We prepare and submit your claim and manage your case, from the initial application for benefits through hearings and litigation, including appeals. If your claim is denied at any stage of the process, we will contest the decision. We manage your case throughout your claim.
- Construction Site Injuries
Working on a construction site can be extremely dangerous; many of our clients come to us after accidents caused by: slip-and-falls; falls from unguarded roofs, walkways and loading docks; burns from explosions and chemical exposure; collapse of cranes, forklifts and scaffolding; back, neck and head injuries; vision and hearing loss; repetitive stress injuries; fractures, broken bones and amputations; and injuries to extremities (schedule loss of use). We also handle cases covered by Section 240 of New York labor law. If you have fallen from a scaffold, hoist, lift or ladder while working at a construction site, you may be eligible for compensation — even if you think the fall was your fault.
- Motor Vehicle Accidents
If you drive for your employer and were injured in an accident in New York State, you may be eligible for New York Workers' Compensation benefits — even if the accident occurred many miles from your employer's location, or even if the accident was your fault. These benefits cover commercial drivers such as delivery van drivers, long-haul truck drivers, package truck drivers, sales representatives or operators of road construction equipment. Whichever type of vehicle you were driving, you may be eligible for payment of your medical bills, lost wages and other expenses, if you were hurt in a vehicle accident in New York State.
- Slip and Fall
A slip-and-fall accident is extremely common and can happen to anybody. It can be as simple as tripping on a carpet and hurting your toe or as devastating as slipping in a pool of water and suffering broken bones or serious head, neck or back injuries requiring extensive medical treatment and time away from work. While a severe injury cannot be ignored, there are many more minor injuries that go unreported such as a fall on ice in your employer's parking lot or other relatively minor injuries. Many people simply brush off these types of falls and carry on with their jobs.
- Machine Injuries
Most people in the manufacturing industry work with machines on the job every day. However, according to the 2007 annual report of the New York State Workers' Compensation Board, the manufacturing industry sector alone is responsible for 10.3 percent of all accepted claims resulting from work-related injuries. And since machinery-related injuries can occur in many other workplaces, including construction, warehouses and offices, the total number of machinery-related injuries is actually much higher.
- Back, Neck and Spinal Cord Injuries
Injuries to the head, neck and back are extremely common workplace injuries, no matter what kind of work you perform. Something as simple as picking up a box or falling can cause significant neck, back, and head injuries. These types of injuries can alter the course of a person's life, making it impossible to work or live a normal life. Even if the victim recovers, there is always the possibility of residual damage.
- Vision and Hearing Loss
When an explosion, persistent noise, chemical exposure, slip, trip and fall, power tool malfunction, fire or other injury or illness leaves a victim with total or partial vision or hearing loss, our lawyers will litigate to obtain maximum compensation. Even if you do not suffer a complete loss of hearing or vision, you may still be entitled to medical treatment and monetary benefits, including a lump-sum award for your lost vision or hearing.
- Repetitive Stress Injuries
By definition, repetitive stress injuries and diseases are those that develop over time. For example, a warehouse worker who lifts boxes all day may experience back pain due to repetitive bending, while an electrician who kneels all days may experience constant knee pain. We assist people with repetitive strain injury claims for diseases and conditions such as: carpal tunnel syndrome, cubital tunnel syndrome, thoracic outlet syndrome, bursitis, tenosynovitis, tendinitis, including flexor/extensor, bicipital and rotator cuff tendinitis, back pain, knee pain, tennis elbow (lateral epicondylitis), golfer's elbow (medial epicondylitis), De Quervain's disease and Dupuytren's contracture.
- Fractures and Broken Bones
At the Law Offices of Terry Katz & Associates, we have helped people who have broken arms or legs, undergone knee surgery or been told they need arthroscopic surgery to repair earlier hand or ankle injuries. There are often long-term or residual consequences to orthopedic injuries, so it is important to get prompt medical care and protect your legal rights. In addition, if your injury was caused by the negligence of a third party, we will evaluate your case to determine if you are eligible to file a personal injury claim to recover additional compensation.
- Schedule Loss of Use Injuries
If an accident on the job has caused an injury to your hands, feet, arms or legs, you may be eligible for benefits from the New York Workers' Compensation system. This program provides benefits to injured workers regardless of fault — whether or not they lose time from work or are permanently disabled. If you suffered a work-related injury to your extremities, such as your hands, fingers, feet, toes, arms, or legs, you may be entitled to a Schedule Loss of Use (SLU) award even if you did not miss any time from work
- Social Security Disability
If you suffer from an injury, illness, or combination of impairments that prevents you from working in any capacity, you may be eligible for monetary benefits and health insurance from the Social Security Administration. The government offers many different programs to provide safety, security, and peace of mind to millions of disabled Americans. These programs have different rules for establishing your entitlement, but they all require that you suffer from an injury, illness, or impairment that renders you unable to perform your past work or any other work for at least one full year, or is expected to result in your death.
- Personal Injury
At Terry Katz & Associates, PC, our New York injury lawyers will evaluate your Workers' Compensation claim to determine your eligibility for a third-party injury claim. A successful personal injury claim can increase your compensation after an on-the-job injury. In addition to reviewing your eligibility for a third-party personal injury claim, our attorneys will determine whether you should file a Social Security Disability (SSD) claim. If your injury has kept you from working for more than six months, forced you into part-time work or required you to take a lower paying job, you will probably qualify for SSD benefits. We have helped many clients obtain all three types of benefits: Workers' Compensation benefits, personal injury compensation and SSD payments.
