The firm was founded twelve years ago by Edward Steinberg and Daniel Leav. From the outset the firm has focused on providing premier legal representation and excellent customer service. When the firm was started many other firms were representing their clients using outdated methods. Leav & Steinberg was one of the first firms to incorporate new trial techniques utilizing technology, computer graphics, and advanced case-management programs. The firm quickly established itself as a cutting-edge trial firm. Leav & Steinberg’s principal goals of working closely with our clients and achieving recoveries for them have remained the same.

The firm has grown to include seven attorneys and a fifteen person support staff. - Premises Liability

Those who are injured due to a defective condition or in an unsafe place, such as an apartment complex, restaurant, parking lot, shopping mall, or grocery store may be entitled to compensation for their injuries, pain, suffering, medical costs, lost wages, and other expenses that arise out of an accident. Common types of premises liability cases include: Sidewalk Accidents; Inadequate Security: at school (or field trip), club, bar, restaurant, apartment building, and more: resulting in roughhousing, fighting, assault, sexual assault, battery, murder, etc.; Animal Attack; Hot Water; Snow and Ice; Inadequate lighting; Faulty design of stairs, landings, doorways; Lack of or improper handrails; Turnstile Injuries; Exposed wiring or electrical equipment; Failure to post warning signs; Failure to adequately train employees; Objects blocking walkways.

- Medical Malpractice

Doctors and some other health care providers are responsible for exercising the same degree of care as is accepted by the medical profession in the area in which they practice. A deviation from that accepted medical practice which results in an injury or death to a patient may subject that medical provider to liability for their actions. We maintain a large network of experts in various medical fields who can opine, at the outset, whether your treating doctor may be liable for your injuries. We work with economists and analysts who can accurately calculate past and future lost wages, the cost of medical care, and other monetary losses related to a medical malpractice injury. Common types of Medical Malpractice cases include: Lasik; Improper delivery of a baby; Erb’s Palsy; Failure to properly diagnose cancer; Cerebral Palsy; Brain Damage; Surgical Error.

- Transportation Accidents

If a motor vehicle accident occurs, appropriate medical treatment should be sought at a hospital emergency room, urgent care center, or trauma center. The police report or incident report should be obtained. Potential witnesses should be interviewed, and their names and addresses collected. Photographs of the damage to the vehicle(s) and your body should be taken. Common types of motor vehicle accidents include: Rear end accident; Passenger in a Vehicle Involved in an Accident; Stop sign or stop light accident/Failure to Yield; Pedestrian; Bicyclist; Failure to properly maintain and service vehicle; Drunk driving; Improper placement of stop signs, stop lights, guardrails; Rental Car; Chain Accident/Multi-Vehicle Accident; Skateboarder; Motorcycle; Hit and Run; Sudden start or stop of a bus or train; Dropping off a passenger in a dangerous area; No seatbelt provided; Broken escalators or elevators in a train station; Poor lighting.

- Negligence of Organization

Government and municipal officials owe a duty to the public to not commit illegal acts and to carry out their duties with reasonable care. Some, but not all government and municipal officials are immune from liability. As an example, although police officers generally cannot be sued for a failure to protect an individual, they can sometimes be subjected to liability if a special relationship was created under the law. Government and municipality cases require prompt action, as there are special rules that serve as preconditions to commencing a case against a municipality or city. Common Types of Negligence of Organization Cases Include: Failure to Maintain a City Sidewalk from defects, snow, and ice; Insufficient Police Protection/Breach of Police Special Relationship; City Park Hazard; Faulty maintenance or construction of public structures, including monuments; Improper operation or maintenance of city equipment.

- Products Liability

Sellers, manufacturers, distributors, and some others are required to ensure that the products they make available are not defective or dangerous to the user. The three main types of product liability claims are for a design defect, manufacturing defect, and failure to warn. Other common product liability claims are rooted in negligence, breach of an express warranty, breach of an implied warranty of merchantability, breach of an implied warranty of fitness for a particular purpose, breach of consumer protection, and strict liability. Common Types of Products Liability Cases Include: Defective Automobiles; Defective Drugs; Defective Machines; Defective Tools; Defective Pool; Defective Toys; Defective Safety Device.

- Construction Accidents

Due to the physical nature of their work, construction and demolition workers have greater difficulty returning to their pre-accident status and regaining their ability to earn a livelihood. Construction and demolition workers should scrutinize and consider refusing releases or money offered in exchange for their promise to limit their rights after an accident until they speak with an experienced attorney. Injured workers may be legally entitled to recover monetary damages for their injuries, pain, suffering, medical expenses, lost wages, and other expenses that arise from an on the job injury. Common Types of Construction Accident Cases Include: Crane Accidents; Failure to comply with Labor Law; Broken or Malfunctioning Tools; Scaffolding and Ladders; Nerve Damage; Exposure to Hazardous or Toxic Materials; Slips, Trips, Falls on a construction site; Broken Handrails or Stairs; Falling Objects; Wrongful Death; Injuries using delivery trucks, cranes, high-low’s.

- Wrongful Death

Since the deceased person cannot bring the lawsuit, a representative of the estate is appointed and is authorized to file a lawsuit against the responsible party on the decedent’s behalf. The goal is to recover monetary compensation for survivors and beneficiaries after the death. Survivors and beneficiaries that may recover may include a widow, widower, children, parents, and other heirs. A wrongful death case can result in the recovery of medical expenses, funeral expenses, lost wages, pain and suffering, expected inheritance, and other types of compensation. The amount of compensation is dependent upon age, life expectancy, education, and earnings of the decedent. Though dealing with the death of a loved one is a difficult and sensitive process, it is important to promptly consider and investigate a possible wrongful death. The statute of limitations in New York to commence a wrongful death case is usually two years from the date of the death. If a lawsuit is not started by the time the applicable limit expires, the ability to start a lawsuit could be completely barred forever.

- General Negligence

A negligence claim consists of the following elements: duty, breach of that duty, causation, and damages. Negligence is not the same as carelessness. Rather, negligence is conduct that falls short of what a reasonable person would do to protect another from foreseeable risks of harm. All of the elements must be proved by the plaintiff in order to recover under a negligence claim. Thus, a deviation from the standard of care that results in no injury is not recoverable under the law. A defendant may test the ability of the plaintiff to prove one or more of these elements by motion to dismiss, motion for summary judgment, or demurrer. Types of damages applicable to negligence cases include special damages (quantifiable dollar losses that could be substantiated by an invoice, receipt, or other document), general damages (those which cannot be quantified in monetary terms, such as pain and suffering), and in rare cases, punitive damages (damages that are for the purpose of punishing the wrongdoer).
