- Prenuptial Agreements

If you are contemplating marriage, including marrying for a second or third time, we encourage you to work with our family law attorney to draft a prenuptial agreement. That all-important document can protect your right to premarital property or your children's right to your estate. Even though most of our clients who are remarrying truly want the marriage to last, many realize that circumstances change, and wish to take the pragmatic step of protecting their financial interests. They also recognize that the divorce rate for second and third marriages is even higher than the divorce rate for first marriages, so they ask our family law firm to review or draft a prenuptial agreement complying with Florida law.

- Supportive Relationships

The Florida Legislature has enacted new laws to address the supportive relationship between a former spouse and a new paramour who are cohabitating but are not married. Prior to the statutory revision, since alimony is typically only terminated upon the recipient’s remarriage or either party’s death, alimony recipients were taking advantage of this loophole by living with their new partner without the benefit of marriage in order to prevent their alimony from terminating. If your former spouse is financially interdependent with another person, is commingling assets, and/or is in a relationship that is substantially similar to a marriage, you may have grounds for an action to modify or terminate your spousal support obligation.

- Visitation and Timesharing

An important component of resolving custody issues is the successful establishment of visitation and timesharing schedules. Attorney Tina L. Lewert, our firm’s founder and Florida Supreme Court Certified Family Law Mediator, believes in the process of mediation. She encourages her clients to resolve issues about visitation and parenting plans through mediation and to attempt to avoid putting the decision in the hands of an impartial judge who does not know you or your family. However, if litigation is necessary to further your interests, Tina Lewert has the skills, experience and tenacity to achieve the best possible result in your case.

- Working with Custody Evaluators

Nothing you tell the custody evaluator or Guardian ad Litem is confidential, but everything you tell attorney Tina L. Lewert is. Her goal is to answer all your questions about divorce and custody arrangements, so you have the information you need to make informed decisions. Once the interviews are finished, the evaluator may meet with the children's pediatrician, teachers or daycare providers to help determine each parent's parenting skills and level of involvement. The evaluator will report his or her findings to the court, including recommendations for custody, timesharing, and a parenting plan.
