Practice Areas

Practice Areas Description

- Personal Injury

The attorneys of Lombardi and Lombardi P.A. have been fighting for victims of personal injury for more than 30 years. If you have been seriously injured by the negligence of others, we offer the serious legal representation you and your family will need. With our in-house experience and access to a vast network of experts, we have the resources and confidence to take on any case.

- Auto Accidents

At Lombardi and Lombardi P.A., our auto accident lawyers in New Jersey have been helping victims and their families injured in motor vehicle accidents for the past 30 years. In addition to our main office in Edison, we also have satellite offices in Brick and Freehold, New Jersey. Our attorneys have represented many clients in traffic accident lawsuits related to: car collisions, SUV Rollovers, ATV accidents, motorcycle accidents, bicycle accidents, pedestrian hit and run accidents, tire blowouts and victims of drunk drivers.

- Truck Accidents

Eighteen wheelers, commercial vehicles, and delivery trucks are a familiar sight in New Jersey, especially on roads such as Route 1, Interstate highways 287 and 78, and the New Jersey turnpike. Through the years, our lawyers have taken on many of these cases, and found that common contributing factors to the accidents are: driver fatigue or driver error; driver on drugs or alcohol; speeding or reckless driving; truck not meeting required safety standards; tire blowouts or tread separation; and overweight loads, unbalanced load, or load shift.

- Motorcycle Accidents

Motorcycle accidents commonly results in catastrophic injuries — brain injury, spinal injuries or lost limbs — as well as broken bones, road rash and scarring. One of our investigators formerly worked as a claims manager for the nation's largest carrier of motorcycle insurance. This enables us to prepare a comprehensive claim that accounts for ongoing medical expenses, future earnings and compensation for the emotional toll of a disabling injury.

- Construction Accidents

With relatives of our lawyers working in the construction field, we understand all of the hazards that can occur, what OSHA and safety requirements need to be followed, and any code violations that are evident. This inside knowledge helps us with our investigations into some of the types of work site injuries, such as: scaffolding injuries; ladder falls; falling through holes or loose boards; falling from a roof; improperly braced trenches; back injuries from lifting heavy equipment; planks and material falling; electrocution and burns; and forklift accidents.

- Medical Malpractice

At Lombardi and Lombardi P.A., with offices in Edison, Brick, and Freehold, our compassionate New Jersey medical malpractice attorneys have been helping clients and their families recover damages related to doctor errors or emergency room error such as: improper prescription or medication; wrong medication dosage; birth injuries or brain damage caused by lack of oxygen at birth; cerebral palsy; delay in performing Caesarian section (C-section); laparoscopic surgery errors; plastic surgery complications or botched jobs; post-surgical infections; sponges or surgical instruments left inside; failure to diagnose cancer or other diseases; mistake or delay in diagnoses; and negligent medical care in a clinic, hospital, or nursing home.

- Defective Drugs / Medical Devices

When drug makers bring their products to market without adequate testing — or with knowledge of harmful side effects — the results can devastating to unsuspecting patients who take it on faith that the drug is proven and safe. The successful trial lawyers of Lombardi and Lombardi P.A. have litigated claims against major pharmaceutical companies and manufacturers of medical products or implanted devices. We have participated in class actions involving: Phen-Fen (diet pills), Baycol (anti-cholesterol drug), Vioxx (osteoarthritis medicine), Propulsid (acid reflux medication) and Rezulin (anti-inflammatory drug).

- Wrongful Death

Since our law firm was founded in 1975, our New Jersey wrongful death claims lawyers have been helping clients use the legal system to hold the responsible party accountable for the loss of their loved one due to: auto accidents, trucking accidents, premises liability, construction site accidents, products liability and medical malpractice. In the state of New Jersey, wrongful death claims need to be filed within two years of the fatality. In addition to the loss of companionship of a husband or wife, there is a need to prove economic loss of future wages.

- Premises Liability

Whether you have fallen on an icy sidewalk, slipped on a wet floor in a grocery store, or were assaulted in an apartment laundry room, you may be eligible to a file a lawsuit to recover damages for your pain, suffering, and lost wages. A slip, trip, or fall can occur on uneven or elevated sidewalks, icy or snowy steps, or due to spills causing slick wet floors in stores. Other hazards can include retail store merchandise falling off shelves and improperly placed displays. Uneven stairs with code violations or defective construction or improper hand railings are responsible for many broken hips and falls also, as are holes in a floor or improper lighting.

- Product Liability

Dangerous and unsafe products and machinery can cause injury or even death of innocent persons. Whether the injury is caused by a negligent design, a manufacturer’s failure to provide adequate instructions, or inadequate warnings and labels, the responsible party can be held accountable. Our attorneys represent clients hurt by factory tools and equipment related to: accidental amputation on punch press equipment; loss of a hand, fingers, or toes (midpoint injuries) on factory machinery; and getting a body part or limb caught in moving equipment.

- Employment Discrimination / Sexual Harassment

We have won compensation for discriminatory practices in hiring, job assignments, pay, promotions or discipline based on age, race, gender, religion, national origin, disability or sexual orientation. We also handle cases involving failure to make reasonable accommodations under the Americans with Disabilities Act or interference with rights under the Family and Medical Leave Act regarding pregnancy leave or care for a sick family member. If a supervisor or co-worker has made unwelcome advances or created a hostile working environment through offensive touching, language or images, and the employer has not taken steps to stop the harassment or sanction the offender, the company may be liable for damages.

- Whistleblower Claims

Employers are within their rights to fire workers for poor job performance or insubordination. Investigation of whistleblower cases often reveals a record of steady or commendable reports and then an abrupt pattern of poor reviews that coincide with a whistleblowing incident or confrontation. Attorney Scott Telson is adept at sifting through employee records to demonstrate inconsistencies and uncovering other evidence that our client was singled out after reporting abuses.

- Unpaid Overtime / Other Labor Law Violations

If your employer has pressured you to work off the clock, refused to pay overtime or denied you mandatory work breaks, you and your co-workers may have grounds for a lawsuit to collect back pay and penalties. The law firm of Lombardi and Lombardi has prevailed in a number of class actions for wage and hour violations on behalf of employee groups in Central New Jersey. Employers can be liable for each instance of a denied break or off-clock work, compensated by a full hour's pay plus penalties. When these violations have been systematic over time, it can add up to a substantial amount.

- Occupational Diseases

Under New Jersey's workers' compensation law, victims of workplace accidents are entitled to recover lost wages and medical bills. Workers are also eligible for lump sum settlements or ongoing monthly disability pay if they develop permanent illness or injury over time from work-related conditions: asbestos exposure, toxic exposures, repetitive motion injury and hearing damage.

- Criminal Defense

With an honest, nonjudgmental approach and a dedication to getting the best plea possible for guilty defendants and acquittals for innocent defendants, our criminal defense attorneys have successfully represented clients in matters involving: drug possession and drug sales of marijuana, cocaine, and ecstasy (“XTC”); DWI / DUI / drunk driving; sexual assault / date rape / molestation; assault and aggravated assault; domestic violence; murder, manslaughter; speeding, reckless driving, and other traffic offenses; robbery, burglary; forgery; embezzlement; and shoplifting.
