- Family Law

Every family is unique. Each has its own dynamics, characteristics, and from time to time — its own set of unique problems too. The attorneys at our firm address all of the various problems and legal issues that a family can have and point the way towards workable solutions. In disputed family matters, we stress the importance of communicating to our clients the benefits of resolving their differences through negotiation and settlement, especially in cases where children are involved. However, we emphasize the fact that our lawyers are ready, willing, and able to aggressively advocate for them in the courtroom when other methods of dispute resolution are unsuccessful or fail to produce a workable solution.

- Divorce

Our firm believes that thorough preparation and committed advocacy are the keys to achieving good results. But to be truly committed, you have to be honest and up front with people from the very start. This means talking to clients the realities of divorce, division of community property, and parental and children rights…and of the various outcomes different approaches are likely to provide. children are involved; we emphasize the benefits of settling matters without resorting to litigation. However, we are more than ready and willing to go to trial when other methods of resolving difference are not successful.

- Complex Property Division

Dividing marital property is rarely an easy thing to accomplish — even when a general spirit of cooperation is present between two spouses. Complex estates, estates comprised of commingled funds, real estate holdings or investments, businesses, and other significant assets can be more difficult to appropriately divide. Our experience with complex property division and all of its various aspects is just one of the assets that set us apart from others in the DFW Metroplex area. Achieving the clients' desired results in complex property division begins with thorough preparation and a careful valuation of all of the marital assets, property, and debt.

- Business Valuations

Accurately evaluating the true value of a small business, professional practice, or large company is critical to achieving fair property settlements no matter which spouse you are representing. But like families themselves, each business needs to be looked at and understood as the unique entity it is. We understand the complexities of business valuation and both how, and how not to approach this critical aspect of complex property division. A significant distinction between a business valuation for Divorce verses a valuation for a sale of business to third parties is the allocation of discounts for intangible assets such as good will and non compete agreements.

- Division of Benefits & Retirement Accounts

Employee benefits, stock options, pension plans, and retirement accounts need to be evaluated when dividing the marital estate. That said — the division of these assets can be fairly complicated. With over 35 years of combined experience handling divorce cases in the DFW Metroplex and North Texas, we understand the financial anxieties our clients are dealing with when they come to us for help. As attorneys, we work to relieve as much of that stress and anxiety as possible by honestly and fully informing clients with regards to the law, their legal options, and what they can realistically expect to have happen.

- Child Custody, Visitation & Conservatorships

The most precious asset in any divorce case are the children. Unfortunately children are often caught in the middle of the battle between divorcing parents. Children become the "prize" or the "pawn" in the tactical fight of divorce. The damage caused by custody litigation can have a long term affect on relationships between the parents or a parent and their child. Our attorneys provide compassionate support and strong legal representation to people in the North Dallas area and throughout the DFW Metroplex who are dealing with divorce and child custody issues. - Modification of Divorce Decrees and Prior Orders

Regardless of how a divorce is ultimately settled, children's needs and parent’s circumstances often change over time. The legal standard for determining child related issues is simply "the best interest of the children." The best interests of children at the time of divorce may not necessarily remain best for the children years after the divorce. What happens if a parent remarries and the new spouse obtains a job out of state? Parents that divorce when their children are infants will likely face different issues when their children are teenagers. our firm represents mothers and fathers in the North Dallas area and throughout the DFW Metroplex, and work with them to develop child visitation and parenting plans that benefit their children and that fit within their busy lives even as those lives change over time. Our experience has shown us that this is possible even when there are extraordinary obstacles to overcome, if the parents can put aside their differences and be reasonable with one another.

- Enforcement of Divorce Decrees and Orders

Unfortunately, the end of a divorce case or Suit Affecting Parent Child Relationship is only the beginning of litigation between former spouses. A court Order is only as good as a party's willingness to enforce the terms contained in that Order. While enforcement issues may include transfer of assets post divorce, the majority of enforcement actions are for nonpayment of child support, nonpayment of child medical obligations, and denial of visitation rights. Our skilled divorce attorneys have experience in seeking and obtaining enforcement of court Orders through Contempt Motions, Post Divorce Judgments and Clarification of Orders that were previously unenforceable.

- Alimony & Child Support

In Texas, post divorce spousal maintenance is relatively new and often difficult to obtain. The Texas Family Code generally requires that the marriage be at least 10 years in length, that the spouse seeking the alimony be unemployable due to lack of basic job skills in the marketplace, or otherwise unable to work due to disability or the need to care for a disabled child, and a finding that there are inadequate marital assets that would provide for minimum financial needs of the spouse seeking support. Spousal maintenance is limited to a maximum of three years with some limited exceptions that can extend support, and is also limited in amount. We have been handling complex divorces in the North Dallas area and throughout the DFW Metroplex for a combined 35 years. Since the Texas law was changed to make post divorce spousal maintenance a real consideration in divorce, our attorneys have helped many clients, on both sides of this issue, resolve it successfully.

- Premarital & Post marital Agreements

At our firm, we understand that people have reservations about whether prenuptial and postnuptial agreements make sense, or whether they are nothing more than admitting defeat before anything at all has been settled. We ask them to look at these agreements the same way that business partners who want to avoid the potential costs, delays, and uncertain outcomes associated with litigation look at theirs — as legal tools that can properly define rights and obligations thereby minimizing contested litigation and increased legal costs.

- Mediation

More and more, people who want to resolve property, custody, and other difficult issues associated with divorce, are turning to mediation for answers. Texas Courts routinely order cases to mediation prior to allowing a contested trial to begin. Our mediation lawyers represent and advise clients as advocates throughout the mediation process for both family and civil matters. Attorneys Brian Loughmiller and Eric Higgins are also available to provide both civil and family law mediation services to people who have lawyers of their own already, but who are seeking an experienced Texas mediator to resolve a legal dispute whether related to business litigation, personal injury or divorce issues.
