- Mother's Rights/Father's Rights
At Macht, Brenizer & Gingold, P.C., we understand that mothers and fathers each have rights in a divorce and those rights need protection. Moreover, we understand that mothers and fathers are fighting for the same thing in a divorce: A continued relationship with their children; The health and emotional welfare of their children; A fair share of their marital property; A secure financial future; Protection of their financial and parental rights; and, A sense of fairness and closure.
- Orders of Protections
When there is cause to believe that domestic violence may occur, a judge may issue an order of protection designed to keep the threatening family member out of reach from those whom she or he might seek to harm. Judges will often be safe rather than sorry when an individual requests an order of protection. The family law attorneys at Macht, Brenizer & Gingold, P.C., are ready to act quickly to help you request or refute an order of protection or restraining order.
- Paternity
Whatever your family circumstances or your relationship to a child born outside of marriage, you are welcome to contact Macht, Brenizer & Gingold, P.C., to schedule a consultation with an attorney regarding a paternity matter.
- Cohabitation Agreements
There are many issues that may be addressed by a cohabitation agreement, including:Ownership of property acquired during the relationship; Contingencies in the event the relationship ends; Contingencies in the event the parties get married in the future; Ownership of retirement accounts; and, Ownership of property in the event of death. If you are thinking about a cohabitation agreement, you and your significant other should each have separate legal counsel and a full disclosure of assets and debts should be made between the parties.
- Military Divorce
If you are a member of the military or your spouse is a member of the military, there are special considerations you should make before filing for divorce. The family law attorneys at Macht, Brenizer & Gingold can advise you of your rights and provide the sound legal advice you need if you are thinking about a military divorce.
- Collaborative Divorce & Mediation
In a collaborative divorce, each spouse has their own attorney who advises them of their rights. The attorneys and the parties all communicate and attempt to resolve all disputes without going to trial. The attorneys and spouses sign an agreement that states that if the parties are not able to resolve all disputes and must take the case to court, the attorneys will withdraw from their representation of the parties. Of course, the parties are free to hire new attorneys. Because the threat of going to trial is not used as a hammer in negotiations, the whole focus of the process is towards dispute resolution and reaching an agreement. People find that a collaborative divorce often saves considerable time, stress and unnecessary conflict. A collaborative divorce may also save clients the cost of taking a case to trial.
- Grandparent Rights
The answers to your questions regarding "grandparents' rights" in your family will vary depending on your particular circumstances. It is often more helpful to frame the questions in terms of goals and methods rather than rights. Our family law attorneys are experienced and adept at helping grandparents discover and implement ways to protect bonds with their grandchildren. For example, a guardianship may be in your family's best interests.
- Same Sex Couples
At Macht, Brenizer & Gingold, P.C., we draft and review cohabitation agreements and provide additional assistance to individuals in a same sex relationship.
- Asset Protection Agreements
At Macht, Brenizer & Gingold, P.C., we draft and review prenuptial agreements, postnuptial agreements, separation agreements and cohabitation agreements, and counsel parties in pre-divorce planning.
