Practice Areas
Practice Areas Description
Our practice includes:- Adoption
Whether you have decided upon adoption or you have questions about the adoption process, our lawyers are delighted to represent both prospective adoptive parents and birth parents in private and international adoptions. We are prepared to assist with many types of adoptions, including open adoptions, closed adoptions (sometimes called confidential adoptions), semi-open adoptions (sometimes called cooperative adoptions), and stepparent adoptions. If you are a birth father considering termination of your parental rights to enable stepparent adoption, or if you are seeking to adopt a child, we have the knowledge to help you through the process.
- Child Custody & Visitation
When parents are divorcing or separating, some of the most difficult issues to resolve are child custody and visitation issues. These issues are especially difficult in cases where there are allegations of domestic violence or parental alienation. Even when there are no allegations of abuse or alienation, it is hard for parents to come to grips with the idea that they will not be spending as much time with their children. We are dedicated to ensuring that your rights and your children's rights are protected.
- Child Support
Child support is but one of many issues to resolve in divorce and paternity cases. Typically speaking, the non-custodial parent is obligated to pay child support to the custodial parent. Therefore, child custody and visitation issues are interlinked with child support problems. Our firm strives to help our clients make decisions that honor their parental rights while maintaining a plan that is in the best interests of the child.
- Division of Marital Assets
Firm founder, Attorney Mark C. Lane has the experience, handling more than 2,000 family law cases and has helped clients resolve many family law issues, including property division issues. We have handled the full range of property division disputes. We have a complete understanding of Texas family law. However your divorce is eventually resolved, our law firm will be able to take the approach that meets your needs. In some cases, we are able to draft a mutually agreeable marital settlement agreement relatively quickly. Other cases start out uncontested, but conflict arises as the parties begin working out the details of liquidating their marital estate. These may take more time and work on the part of the spouses and the lawyer, but generally result in a settlement agreement in a moderate amount of time. In still other cases, we have encountered complex property division issues that take longer to resolve. These may involve issues such as dishonesty and fraud on the part of a spouse who is attempting to hide assets or minimize actual income.
- Divorce
Our firm concentrates on the issues that arise as spouses make the decision to go their separate ways. We focus on vigorously representing our clients' best interests. Since beginning our family law practice almost a decade ago, Mark C. Lane has handled more than 2,000 family law cases. You can take comfort relying on our experience as we help you reach a positive outcome in your case. We represent clients in every aspect of divorce such as property division, child support, child custody and visitation, and order modification. Divorce is not an easy matter; you don't have to face it alone. Our law firm can help.
- Domestic Violence
If you have been the victim of spousal abuse, you may need to seek a temporary restraining order to protect yourself and your children from further physical or psychological abuse. Whether you are married to the person who abuses you or not, you have rights. Our law firm can help you complete the forms and seek a temporary restraining order. If you are financially dependent on your spouse, you may have the right to have temporary spousal support and child support before your divorce is final and while restraining orders are in place. If you are an unmarried parent living with your child's other parent, you may be afraid to lose the financial support you need if you have the other parent removed from the home because of domestic violence. Trust that our attorneys can advise you of all your legal options involving domestic violence protective orders, child support, and child custody and visitation.
- High Net Worth Divorce
In Texas, once an order for property division is filed, it generally cannot be modified unless the spouse seeking modification can show fraud. That is why it is very important to be sure all marital asset division issues in your divorce case are thoroughly analyzed and investigated before the settlement agreement is finalized. At our firm, you can count on us to fully protect your rights under Texas commercial property division law. Because an order is so difficult to modify once it is established, if you have reason to believe that your spouse is hiding assets in contemplation of divorce, has established procedures for making it look as if his or her business or professional income is significantly lower than it should be, or failed to identify property that is under his or her sole control, you need to hire an attorney that has the knowledge and experience required to be sure that your spouse is kept from defrauding you and the court.
- Order Modification
While many marital settlement agreements and paternity orders continue working for the former spouses and the parents involved, many do not. In some case, battles over the modification of child custody and support orders can become more contentious than the original case. Our firm is committed to helping clients modify family law orders such as: modifying a child support order in which circumstances have materially and substantially changed; and alimony order, either a former spouse dies or a former spouse who is receiving maintenance remarries or cohabitates, spousal support (alimony) is terminated. When the circumstances of either party have materially and substantially changed since the initial spousal maintenance order or decree, a motion to reduce maintenance may be filed with the court.
- Paternity
Our firm handles different issues that arise in paternity cases including: Child Support - A mother may seek to establish paternity in order to obtain an order for child support. When a father acknowledges paternity, he may be required to provide health insurance or other benefits as well. A man who does not believe he is the father may wish to contest the petition naming him as the father so that he is not obligated to pay support for a child who isn't his; custody and visitation where in Paternity can be established through legal acknowledgement or by DNA testing. Whether you are a mother and want to enforce your rights to support, or if you are a father and want to enforce your rights to visitation, we can help you. We also represent men who dispute the paternity of a child.
