I am Martin A. Delaney III, Attorney at Law. Like most people, you probably look for an experienced lawyer when you need legal assistance. In addition to having been an attorney for more than 25 years, I offer my clients the attention and effort they deserve in preparing for their cases.

I have been a trial lawyer for my entire career. Anyone who has been a trial lawyer will tell you that preparation and knowledge of the law are your two greatest weapons in litigation. Throughout my career, I have handled family law cases, which, in addition to divorce, may include: Child custody; Child support; Visitation; Alimony; Child abuse; Neglect; Child sexual abuse; Grandparents' rights; Parental kidnapping; Stepparent adoption; Orders of protection; Domestic violence; Division of property; Qualified Domestic Relations Order (QDRO); Name changes; Paternity; Post-divorce modifications; Restraining orders; Separation agreements.

- Divorce

When people see the term "family law," the first issue that often comes to mind is divorce. There are many other issues involved in family law, but many of them are divorce related, including: Legal separation; Child support; Division of property; Decree enforcement; Post-decree modifications; Separation agreements; Paternity determination; Grandparents' rights; Parental kidnapping; Restraining orders; Orders of protection. As an experienced divorce attorney, I am happy to assist with your divorce, or any related matter.

- Child Custody

In divorce cases, the decision about which parent has custody of a couple's children is typically based on what is best for the physical, mental, and emotional well-being of the child. As a parent, you have some legal rights as to which judge will decide your child custody case. Because of my experience in local courts, I can advise you about how that right can affect your concerns in numerous child custody issues, including: Joint custody; Paternity tests; Removal of children to another state or location; Post-decree modifications. Knowledge of Illinois divorce and child custody law is extremely important in these cases. I can assist you in protecting your rights and your child's welfare.

- Child Visitation

If you are divorced, and the non-custodial parent of a child, you may be concerned about the amount of time you get to spend with your child. If you and your child have a healthy relationship and some person or circumstance prohibits regular visitation time, you should consider calling a family law attorney. Custody and visitation matters are complex. An experienced lawyer can explain your rights and help you understand your options for spending time with your child.

- Property Division

Within a divorce, one of the most important issues that need to be decided is the division of the marital property. Divorcing spouses often argue over how to divide the property and determine what is marital property and separate property. At my firm, the office of Martin A. Delaney, III, I provide clients with experienced property division representation. I have worked with hundreds of clients over the years in my practice, and I understand how best to approach these issues.

- Post-Decree Enforcement and Modifications

After a divorce has concluded, the agreements and court orders are entered into the record and are binding on the parties. Modification of an order is possible when there has been a substantial change in circumstance for the child support, child custody or alimony (spousal support). The court will enforce its orders when presented with evidence of violations, such as failure to pay child or spousal support. Property settlements are almost never modified, absent a showing of actual fraud by one of the parties. At my office, the law firm of Martin A. Delaney, III, I represent clients with modification and enforcement issues.
