Practice Areas Description
Martin & Kieklak Law Firm focuses its practice and experience on cases related to:- Personal Injury
Martin & Kieklak is dedicated to helping working people who have been injured because of someone else’s negligence, carelessness or wrongful conduct. The firm provides skilled, professional representation to clients injured in automobile accidents, motorcycle accidents, trucking accidents, railroad accidents, airplane and other aviation accidents, and work-related accidents. The firm also helps those who have been harmed by medical malpractice, nursing home neglect, and unsafe premises liability/slip-and-falls.
- Automobile Accidents
Martin & Kieklak has extensive experience managing automobile accident cases, including establishing fault and negotiating with the at-fault driver, challenging attempts to downplay the extent of damages and injuries, using accident reconstruction so juries can understand what really happened, determining the full extent of damages and ensuring that the injured person is fully compensated.
- Products Liability
Hazardous or inadequately labeled products, defective equipment and toxic exposures injure thousands of workers every year. Mark L. Martin has spent 20 years representing people who have been injured by defective or unreasonably dangerous products or equipment, including cases involving equipment defects or malfunctions resulting in workplace injuries, and injuries related to the specific areas of welding rods, benzene, silicosis, mesothelioma and other exposures.
- Welding Rod Litigation
Martin & Kieklak has been a leader in investigating and prosecuting emerging cases involving injuries to workers caused by welding rods. Welding rod fumes contain manganese, a known toxic substance that damages the nervous system and causes symptoms similar to Parkinson’s Disease, including tremors, arm and leg cramps and weakness, fatigue, headaches, memory loss and loss of balance. Manufacturers and suppliers of welding rods failed to warn welders of the risks involved in breathing these fumes and should be held accountable for the pain they have caused.
- Benzene Litigation
OHSA estimates that as many as 238,000 people may be exposed to benzene in the workplace, with the highest levels affecting workers in industries that make or use benzene, such as petrochemicals, petroleum refining, coke and coal chemical manufacturing and rubber tire manufacturing. Other workers who may be exposed to benzene because of their occupations include steelworkers, printers, paper-workers, rubber workers, shoe makers, laboratory technicians, fire fighters, gas station employees and other factory workers.
- Mesothelioma Litigation
By some estimates, nearly 3,000 new cases of Mesothelioma are diagnosed each year. Because it can take 20 to 30 years for exposure to asbestos to develop into Mesothelioma, prosecuting these cases requires specialized knowledge and experience. Since 1986, Mark L. Martin has been representing workers who developed Mesothelioma after being exposed to asbestos on the job. The firm has developed a track record of success in obtaining full compensation for patients and their families in actions against asbestos manufacturers.
- F.E.L.A.
The Federal Employers' Liability Act (FELA) is a federal law setting out railroad workers’ rights to damages from their employers when they are injured on the job. Martin & Kieklak helps railroad workers recover compensation for injuries caused by negligence and safety violations by their employers.
- Medical Malpractice
Martin & Kieklak represents patients and their families in medical malpractice cases resulting in catastrophic injuries or death, including those who have been injured by a medical provider’s treatment or failure to treat their illness, misdiagnosis cases including failure to diagnose, surgical errors, obstetric and birth injuries and other catastrophic injuries.
- Nursing Home Neglect
Reports of nursing home abuse, neglect and exploitation are on the rise. Martin & Kieklak helps families whose loved ones have been the victims of abuse or neglect in a nursing home. Signs of physical abuse can include frequent injuries, complaints of pain, passive or withdrawn behavior, unexplained weight loss, dehydration, lack of personal cleanliness, and a general decline in the person’s physical condition.
- Workers' Compensation
At Martin & Kieklak, our attorneys have extensive experience litigating Workers’ Compensation cases, helping injured workers obtain the benefits to which they are entitled. These benefits include proper medical attention, referrals to medical specialists, rehabilitation and compensation for lost wages due to a work-related disability.
- Social Security Disability
Washington County Social Security Disability benefits are designed to provide crucial financial support for people who cannot work because of an injury or disabling medical condition. Nationally, these benefits are a literal life line for millions of disabled individuals and their families.
