Practice Areas

Practice Areas Description

McPhail & Associates, PLC provides legal assistance and representation in the following areas of law:

- Estate Planning

For more than 20 years, Douglas McPhail has worked with clients providing estate planning solutions for families. In order to do this, McPhail & Associates, PLC helps you to understand what comprises your estate: personal belongings, your house, other real estate, cash in bank or retirement accounts, stocks and bonds, and insurance policies. Once you know the value of your estate, McPhail & Associates, PLC can work with you to design a valid estate plan. At minimum, this includes having the following: wills and trusts, and powers of attorney. Proper estate planning makes it easier on your family and loved ones after you are gone. It also gives you the peace of mind that comes with knowing you have done everything to protect those you love.

- Financial Loss Risks

Nine out of ten families do not know how they will pay for long-term care. And, what's even scarier is that most people have no idea about how much they have to lose if they don't have a plan. When nursing home care costs $7,000.00 or more per month, it's not hard to figure out how long your money will last. McPhail & Associates, PLC can help you determine your risk of loss by guiding you through the following three unique planning steps: discovery, diagnosis and design.

- Medicaid Planning

Douglas McPhail is ready to assist you with Medicaid planning whether you are in or out of crisis. We don't want you to be deceived by the many myths about Medicaid and the frequently changing Medicaid rules that affect your ability to get the help you deserve. At McPhail & Associates, PLC, we'll help you determine if: your assets and income allow you to qualify for help; a nursing home is your best option; you are gifting your assets properly so you do not lose your Medicaid benefits; long-term care insurance is an option for you; and your choice and quality of care is not limited. Let us help you navigate through the nursing home and Medicaid process.

- Medicaid Eligibility

McPhail & Associates, PLC can guide you confidently through the Medicaid eligibility process. There are four tests that you must pass in order to prove you are eligible to receive Medicaid benefits. 1) This test is met if you can prove you are over age 65, blind or disabled, and in need of medical assistance in a nursing home. 2) You must prove that you are a Michigan resident and identify all other benefits or payment sources that you have to help pay for your care. 3) You must prove that your medical expenses are higher than your income and your assets are less than the maximum resources allowed. and 4) You must fully disclose all of your assets and income on an application for Medicaid, prove you are asset and income eligible with supporting documents, and report any changes in your circumstances.

- Transfer Rules

The cost of long-term care continues to increase and at nearly $7,000.00 per month, is more money than most families can afford. For most families facing a healthcare crisis, it is not a question of “if” they will be wiped out financially but rather “when.” At McPhail & Associates, PLC we know that when a client requires a stay in a nursing home, an application for Medicaid benefits will be required for all but the very wealthiest of families. Your assets can be legally arranged so they can be protected for you or your family without counting towards your Medicaid spend-down requirements when you apply for help. We know the complex asset and transfer rules and can help you navigate them.
