- Paternity

Paternity is the legal determination of a child's biological father when a child is born to unmarried parents. Until paternity is established, a father has no legal rights or obligations. In Hawaii, paternity can be established three ways: If the parents marry after the child is born; If the parents sign a voluntary establishment of paternity document when the child is born; One of the parents can file a paternity petition with Family Court, which can result in a court ordered test. Once paternity is established, the father can obtain custody and visitation rights, and may be required to provide child support. Following the paternity determination, child custody and support matters are determined the same way as in a divorce case.

- Domestic Abuse Protection

It is an unfortunate fact that many spouses and partners are unaware that they are victims of domestic abuse. Domestic abuse can be physical, but it can also be emotional or financial. Emotional abuse often goes undetected and unreported, and victims typically do not get the protection that a well-designed divorce decree, paternity judgment, or any other kind of order can provide. Ms. Nakamoto can assist you by monitoring abusive tactics and advise you of your legal options, including obtaining protective orders.

- Property Division

Under Hawaii law, once the court grants the divorce decree, it also determines several additional issues, including child custody, child support, alimony, and division of the assets and debts from the marriage. For division of property, Hawaii courts use an "equitable distribution" system. Under this system, courts use a five-category analysis of marital property to determine the fairest distribution of assets and debts. This analysis is done without considering which party might actually hold title to a certain asset.

- Alimony

There is no formula for determining alimony in Hawaii divorces. In fact, there is no guarantee alimony will be awarded in every case. Instead, courts evaluate several factors to determine whether alimony should be awarded and if so, how much and for how long. These factors include: the length of the marriage; each party's financial situation ability to support and maintain his or her own needs; each party's age, physical condition, and needs; each party's occupation and earning capability; and each party's responsibilities to any children from the marriage. Factors the courts do not consider include extramarital affairs, abuse (other than financial abuse), and a loveless marriage.
