Practice Areas

Practice Areas Description

Mitchell A. Byrd, PLLC has the following as the firm's primary areas of practice:

- Family Law

Ninety-five percent of our firm's practice is devoted to family law. Attorney Mitchell A. Byrd is certified as a family law specialist by the Tennessee Commission on Continuing Legal Education. Our firm assists with family law matters such as:

* Divorce

If you are considering divorce, Attorney Mitchell A. Byrd can offer you skilled guidance and representation throughout the divorce process. Some attorneys only handle divorce cases as a sideline. Ninety-five percent of our firm's practice is dedicated to divorce and family law. We help clients with issues such as the following: Contested and uncontested divorce; Substantial asset divorce; Military divorce. If you are not sure about whether divorce is right for you, we can connect you with a psychologist or another professional who can help you go over your concerns and identify your options. We would never try to push someone into divorce just so that our firm could gain a new client.

* Paternity

Under Tennessee law, when an unmarried woman gives birth to a child, whether or not the father's name appears on the birth certificate, he has no parental rights or responsibilities until one party pursues a paternity claim. Generally, these cases get filed for one of two reasons: Child support & Paternity plan. Occasionally, these cases arise when unmarried couples who have been living together break up. In other cases, the parents have never lived together with their child. A similar process can also be used to establish the paternity of a child born as a result of an extramarital affair.

* Parenting Plan

A parenting plan is a document that specifies each parent's legally enforceable rights and responsibilities with respect to the care and support of a child. In Tennessee, the term "parenting plan" is used for what most people still refer to as child custody and visitation. The following principles are strongly rooted in Tennessee law and are the backbone of our own practice in this area: The interests of the child must come first in any parenting plan; A child is best off when he or she is cared for by two loving parents; No dispute between adults is worth causing harm to a child; Even imperfect parents deserve to have a place in their children's lives.

* Child Support and Alimony

Child support and alimony obligations are determined based on the financial circumstances of both parties, and when those circumstances change after the fact; both child support and alimony can be modified to restore a fair and workable balance between the parties. The law office of Mitchell A. Byrd is available to address your concerns about the modification process, including the following: Periodic review; Uncontested modifications; Contested modifications; Child support in kind. Attorney Byrd has the experience and reputation to pursue the modification outcome you deserve.

* Property Division

In the state of Tennessee, the starting point for asset and debt division is to divide everything equally. Some people, and even some attorneys, stop there, assuming that a 50/50 split will always be the case. However, judges can and do deviate from this, based on a number of factors. There are also certain types of assets that need to be divided very carefully in order to ensure that each party obtains a fair outcome. Mitchell A. Byrd, PLLC regularly assists clients with issues like the following: Substantial assets; Substantial debts; Retirement benefits. Mr. Byrd has the experience to guide you through the property and debt division process.

- Estate Planning

It is never too early to start the estate planning process. There are many good reasons why people of all ages should have estate plans. Once you have a plan in place, it is a good idea to review it periodically, and especially after major life events such as marriage, divorce or birth of a child, to make sure it is still appropriate. An experienced lawyer can help you put together the right estate plan to achieve your specific goals. Attorney Mitchell A. Byrd has helped many clients address all types of concerns by drafting estate planning documents such as the following: Wills; Trusts; Probate; Powers of attorney; Living wills.

- Domestic Violence

Domestic violence is a serious matter that should never be swept under the rug. If you have been accused of domestic assault or you have been a victim of domestic assault, you should get legal representation and other professional attention as soon as possible. Mitchell A. Byrd is available to assist both accusers and the accused with orders of protection, criminal charges, and domestic abuse issues in divorce. He regularly represents people who have been served with orders of protection and/or charged with the crime of domestic assault. He also helps victims pursue orders of protection and criminal warrants.

- Juvenile Crimes

It is typical for young people to get into some trouble in the process of learning to be independent adults. Unfortunately, youthful criminal charges can have consequences for the rest of their lives. If your child has been accused of a crime, he or she needs a dedicated advocate. Attorney Byrd frequently defends young people against charges such as the following: Underage drinking; Minor in possession of alcohol or drugs; Driving under the influence (DUI); Public intoxication; Marijuana possession; Shoplifting and petty theft; Contributing to the delinquency of a minor; Sexual assault.
