Practice Areas
Practice Areas Description
- Business BankruptcyOperating a business requires a huge commitment of time and resources on the part of the owners. There are frequently significant start up costs and the ongoing costs associated with running the business. If there is ever a time where demand for your product or service starts to decline and your income no longer covers business-related expenses, it is important to understand your rights and responsibilities.
- Chapter 7 Bankruptcy
Chapter 7 bankruptcy can be a good debt relief option if you have unsecured debt such as credit cards, personal loans, income tax debt older than three years, deficiency claims from repossessed vehicles or medical bills. If you have little or no disposable income, Chapter 7 will eliminate your debt and give you a fresh start with no payments to creditors. You can receive a discharge in as little as six months.
- Chapter 7 Means Test
The 2005 changes in the bankruptcy laws were partly motivated by creditors who felt that Chapter 7 was being abused by people who could pay something toward their debts. Whether you qualify for bankruptcy protection is determined initially by the median income for a family the size of yours. If your income is higher than the median, you must undergo the means test, comparing your gross income and allowed expenses.
- Chapter 13 Bankruptcy
If you have a steady income but are having trouble keeping up with your bills on a monthly basis, filing for Chapter 13 bankruptcy could provide the relief you need to get back on your feet. Chapter 13 bankruptcy, sometimes called the wage earner bankruptcy, allows you to repay some or all of your debt over a three to five year period according to a court approved repayment plan.
- Chapter 13 Means Test
As in Chapter 7, a key issue is the means test. If your income is below median, Chapter 13 requires you to pay your actual disposable income over three years. If your income is above median, you will either pay your actual disposable income over five years or the means test number, whichever is greater.
- Bankruptcy
At the end of your bankruptcy proceeding, you will receive a discharge of most, if not all, debts included in your initial bankruptcy petition. The discharge relieves you of any further personal responsibility for those debts. The majority of debts, such as credit card debt, personal loans, medical bills, utility bills, vehicle deficiency claims, and personal guarantees of business debt can be discharged through bankruptcy.
- Stop Creditor Harassment
One of the greatest benefits our clients report after filing for bankruptcy is that creditor harassment stops. This is all thanks to a provision in the bankruptcy code called the automatic stay. The automatic stay requires all collection activity to stop immediately as soon as notice of your bankruptcy filing is received.
- Bankruptcy Exempt Property
Many people fear that, if they file for bankruptcy, they will lose everything they own. This is a very common misconception. The purpose of filing for bankruptcy is to give you a fresh start free from the burdens of excessive debt, not to take your property and make you start over with nothing. In those limited situations where assets are exposed, we will recommend bankruptcy alternatives.
- Stop Foreclosure
If you are behind in your mortgage payments or received a foreclosure notice, you should contact a lawyer immediately. You may have options to keep your home or at least maximize your cash flow. At the Collegeville, Pennsylvania, law firm of Nahrgang & Associates, P.C., we have been serving clients throughout the Delaware Valley area for 20 years. During that time, we have worked with countless clients facing foreclosure. We pride ourselves on our ability to provide customized solutions that meet the unique challenges of each case.
- Foreclosure Process
Your mortgage company cannot initiate foreclosure proceedings until you are 60 days delinquent on your payments. At that time, they can send you an Act 91 Notice. This informs you that you have the right to apply for a loan from the state to help pay your mortgage. You can apply for this assistance, but it is difficult to qualify. If you are denied, the foreclosure process can resume. The mortgage company would then file a foreclosure complaint and serve you with a copy, delivered by the sheriff. You have up to 30 days to respond. If you do not respond, they can get a judgment and schedule a sheriff's sale of your property.
- Bankruptcy Alternatives
Filing for bankruptcy may not be the best solution for some clients who have too much income or exposed assets. They need help finding an alternative route to debt relief. At the Collegeville, Pennsylvania law firm of Nahrgang & Associates, P.C., it is our commitment to help you find the best course of action to get back on the right financial path.
- Civil Suits & Negotiations
If you have trouble paying your debt or simply want to save money on the balances, you DO have options, and you do not have to declare bankruptcy. Do not rush into what you think is the best solution without speaking to an experienced debtor attorney.
- Family Law
Working through any family law matter can be extremely difficult. The emotion of the situation and the complexity of the legal issues involved can seem overwhelming. In cases like these, it is important to have a strong advocate on your side who can maintain an objective view and work to protect your best interests.
