- Murder

Nathan Gorham is a criminal lawyer in Toronto who defends First Degree Murder, Second Degree Murder, Manslaughter, and Attempted charges in Toronto, Brampton, Newmarket, or Whitby. The Criminal Code of Canada makes it an offence to commit Murder or Attempted Murder. There are several defenses to Murder, Manslaughter and Attempted Murder. For example, self defense is a defense to Murder, Manslaughter, and Attempted Murder. Provocation, on the other hand, is a defense to Murder that reduces it to manslaughter but cannot lead to a complete acquittal.

- Drinking and Driving

Impaired Driving requires that the Crown prove that a defendant operated a motor vehicle while his/her ability to operate the vehicle was impaired by drug or alcohol. Dangerous Driving requires that the Crown prove that a defendant operated a motor vehicle in a dangerous manner; meaning a standard of conduct that was a marked departure from conduct of a reasonable driver. - Assault

An Assault under the Criminal Code is a non consensual application of force. A Domestic Assault is an Assault that occurs within a family or romantic relationship, whereas Assault with a Weapon is any Assault where a weapon is used. Aggravated Assault is an Assault that causing wounding, disfigurement, or endangers life. The potential sentences for Assaults range from discharges right up to 14 years in prison. - Sexual Assault

The Criminal Code defines offences for Sexual Assault, Aggravated Sexual Assault, Sexual Assault with a Firearm, Sexual Interference, and Sexual Exploitation. Each offence has several elements that the Crown must prove beyond a reasonable doubt. There are several defenses to each charge as well. If you have been charged with Sexual Assault or related offence it is important to talk to a lawyer who is experienced in that area of law.

- Drugs

The Controlled Drugs and Substances Act defines offences for Possession, Possession for the Purpose of Trafficking, Trafficking, Importing, and Producing many drugs and substances including Cocaine, Marijuana, Ecstasy, Heroin, and MDMA. Potential sentences range from discharges right up to life in prison depending on the offences, the nature of the drug, and other aggravating factors as defined by the Controlled Drugs and Substances Act and the common law. - Guns

Gun offences in Canada include: Possession of Loaded Restricted or Prohibited Firearm, Careless Storage of a Firearm or Ammunition, Possession While Unauthorized, Pointing or Discharging a Firearm. There are several defenses to gun/firearms offences. First, the Crown must prove knowledge and control of the gun/firearm. Second, there are several technical issues that the Crown must prove in any gun/firearm offence. Finally, if the police violated a defendant’s right(s) then the gun/firearm is excluded from the evidence at trial.

- Theft/Fraud

Put very simply, Theft under the Criminal Code of Canada requires proof that the defendant moved or attempted to move something with intent to steal that thing. Fraud requires proof that the defendant did some act that involves dishonesty that risked depriving the victim of their property. The requirements of proof for Theft Over $5000 versus Theft Under $5000 are the same with the exception of the value of Theft. Similarly, Fraud Over $5000 includes the same elements as Fraud Under $5000 with the exception of the value of the Fraud.
