Practice Areas Description

The Navarette Law Firm offers legal representation on the following areas of employment law:

- Sexual Harassment

Sexual harassment statistics reveal that over half of all sexual harassment cases go unreported, especially those involving a hostile workplace. By law, employers must have a sexual harassment policy and they should provide sexual harassment training. But many employers do not have a sexual harassment policy. As a result, sexual harassment in the workplace often forces the sexual harassment victim to suffer in silence. Don't suffer anymore. At The Navarette Law Firm, we have the compassion, knowledge, expertise, courtroom skill and sheer tenacity to protect you from the harasser and to fight for your right to be free of a sexually hostile work environment.

- Wrongful Termination

The wrongful termination lawyers at The Navarette Law Firm understand how traumatic and destructive the sudden loss of a job can be. Unless you were terminated for serious misconduct, you may have a case against your former employer for wrongful termination. We will help you to understand your legal options, so you get fairly compensated for being wrongfully terminated. Our wrongful termination attorneys in San Jose and San Francisco understand the complexities of California wrongful termination laws and will explain to you how these laws apply to your specific case.

- Overtime Claims

If you think you have a claim for unpaid overtime, or an unpaid wage claim, we will help you. Your employer may have you on salary and tell you that because you are on salary you do not qualify for overtime pay. Your employer may be wrong. Or your employer may pay you a salary and classify you as a so called "Exempt Employee" and tell you that you are not entitled to overtime pay because of that. Again, your employer may be wrong. If you need an unpaid overtime lawyer, we file lawsuits for unpaid overtime on behalf of individual employees. We also sue companies for overtime pay violations in class action cases.

- Failure To Give Rest Breaks

Under California law, if you work at least 5 hours in a day, you are entitled to at least a half-hour lunch break. If you work at least 10 hours or more in a day, you are entitled to another half-hour lunch break. If you have been denied lunch breaks, you are owed 1 hour of pay for each lunch break that you were denied. You are also entitled to penalties under The California Labor Code. If you have been denied lunch breaks, the attorneys at The Navarette Law Firm will get you compensated.

- Employer Retaliation - Whistle Blower

Examples of employer retaliation include being given fewer hours, being assigned to dangerous duties or a dangerous location, being demoted, being fired, or other punishing conduct by your employer solely because you attempted to enforce your legal rights, helped a co-worker assert their legal rights, or reported what you believed to be illegal activity by the company. Fortunately, California and Federal employment laws prohibit employers from retaliating against workers in many circumstances. The lawyers at the attorneys at The Navarette Law Firm represent employees just like you who need help because you were retaliated against by your employer.

- Workers' Compensation

If you have a workers compensation case in California, you need the best workers compensation lawyer working for you. Workers Compensation laws in California have changed dramatically over the last five years. Unfortunately, the workers compensation laws in California now favor the workers compensation insurance companies instead of protecting the rights of injured workers. At The Navarette Law Firm, we will fight for all of the workers compensation benefits you are entitled to under the law, including your medical benefits, your temporary disability benefits and your permanent disability benefits, too.

- Class Actions

Class action lawsuits are a legal mechanism for a court to process a large number of similar claims against a single employer. Most employers are terrified of class action lawsuits. Even the prospect that a single person's complaint could become a class action lawsuit creates a huge incentive for the employer to settle the case on terms that are fair to the class of employees that you represent. If you suspect that you're not the only employee of your company who was not paid overtime, or not given rest breaks or lunch breaks, or has an unpaid wages claims, we will provide you with complete class action information so you can decide if you want to pursue a class action lawsuit against your employer or former employer.

- Disability Discrimination

Sometimes the worst instances of disability discrimination occur after you return to work with restrictions. Besides having to deal with the challenges imposed by your own disability, many disabled workers face additional and unnecessary burdens resulting from your employer's unlawful refusal to accommodate your disability. We represent clients with conditions such as cancer, blindness, amputation, paralysis, organ damage, chronic illness or degenerative disease. Additionally, we help people returning from a period of disability through workers' compensation, maternity leave or family medical leave.

- Cancer Discrimination

As you know, there are many cancer stages. But most cancers can be treated and some cured, depending on the type of cancer, the location, and the stage of severity. But when your employer interferes with your ability to get the cancer treatment that you need, that may constitute cancer discrimination. At The Navarette Law Firm, we have successfully fought and won cancer discrimination cases against some of the largest corporations in America. And we will fight for you, too. Our cancer discrimination lawyers are tenacious against employers who violate cancer discrimination laws, yet compassionate towards you.

- Pregnancy Discrimination

Too many employers refuse to make reasonable accommodations for their pregnant employees, such as not giving you more rest breaks or not allowing you time during the work day to see your OB/GYN. You have rights under the Family Medical Leave Act (FMLA) and under California law, as well, such as under the Fair Employment and Housing Act. If you have a pregnancy harassment or pregnancy discrimination in the workplace problem, our lawyers at The Navarette Law Firm can help you.

- Race Discrimination

Although race discrimination in the workplace has been illegal for many years now, we still encounter race discrimination cases where race is without a doubt a factor in termination, unfair hiring or promotion policies, unequal pay, unpaid overtime, unpaid wages, not given rest breaks or meal periods, or other workplace violations. Our race discrimination attorneys know the pretexts used by employers to hide racial discrimination. And we also have a thorough understanding of race discrimination laws. Knowing these pretexts and how the race discrimination laws can be used in your favor enables us to prepare the best possible race discrimination case for you.

- Age Discrimination

A lot of age discrimination cases involve one of the following circumstances: physically demanding labor, or time-consuming work that requires mobility or endurance, or jobs in industries that usually pay older workers more but you or your fellow older co-workers are getting paid less. Age discrimination is illegal. If you are over 40 and have been harassed or discriminated against at work, we can help you. Our employment lawyers have the experience and skill to make an accurate assessment of your age discrimination case in order to prove your case against your employer for age discrimination.

- Sexual Preference Discrimination

Gay and lesbian rights to a harassment-free workplace are protected under California law, but discrimination and abuse on the job persist for gays and lesbians, and even for those who might be perceived as gay or lesbian. At The Navarette Law Firm, our extensive experience coupled with our core belief that no person should be subject to harassment at work because of their sexual preference gives us the motivation to be tenacious in fighting your sexual preference discrimination case for you.
