Practice Areas Description

At Neal, Ashmore & Killebrew, we offer legal services on the following areas of family law:

- Divorce

The lawyers at our firm know how divorce affects people and we have the compassion to support you through it while simultaneously protecting your interests. We are a calm, rational island in the rough waters of divorce. Whether you need a fierce trial lawyer whose reputation precedes him, a mediator noted for her diplomatic negotiation skills or a lawyer capable of structuring complex divorce settlements, our law firm has what you are looking for.

* Separation

Unlike some other states, Texas does not have statutory provisions for a "legal separation." Spouses can physically separate, but because Texas is a community property state, all the statutory and constitutional provisions continue to operate on the marriage as if the parties were still living together. However, there are other legal ways to protect the interests of spouses during a designed separation. Methods that have been used by spouses who want to separate but not divorce for the time being, include: Contractual separation agreements; Property partitions; Filing for a divorce and entering into temporary orders with no desire to complete the divorce.

* Spousal Support

Spousal Support disputes then often carry through the entire divorce process. At the beginning, a dependent spouse may need temporary spousal support to pay bills and maintain a reasonable standard of living. Once a divorce is finalized, a spousal support order may remain in effect for many years. And because spousal support involves regular, monthly payments, it's important that you obtain qualified legal help if you: Anticipate the need to pay spousal support in regard to a divorce; Anticipate the need to receive spousal support in regard to a divorce.

* Mediation/ADR

Mediation and other alternative dispute resolution (ADR) processes: Allow the divorcing parties more control over the outcome of their family law matter; Help maintain open communication and minimize disruption in their children's lives; Focus on maintaining long term family relationships; Can be less formal and quicker than the traditional court system; Often save money; Avoid the tension and hostility that often accompanies court hearings and trials. The lawyers at Neal, Ashmore & Killebrew, offer mediation services for individuals and attorneys who seek skilled, experienced mediators to assist in resolving family law matters. We also offer alternative dispute resolution (ADR) as an option to clients facing divorce.

* Collaborative Law

Through the collaborative law model, divorcing spouses work with a team of neutral professionals to civilly resolve the issues in their divorce. The team usually includes two attorneys, a mental health professional and a financial expert and may include appraisers, accountants, child specialists, therapists and others. All professionals work for the benefit of both parties. Not all clients are candidates for collaborative divorce. Our goal at all times is to protect your essential interests and see you through this time of change. At Neal, Ashmore & Killebrew, we have the full range of family law attorneys: mediators, collaborative law divorce attorneys and litigators. Whatever your divorce requires, we can help you.

- High Net Worth Divorce

At Neal, Ashmore & Killebrew, our expert possesses years of expertise in addressing legal issues pertaining to: Complex property division; The property concerns of business owners, business executives, medical practitioners, lawyers and other professionals during divorce; Business valuation; The protection of professional practices; The valuation of professional practices. When you and your spouse own complex or high-value property like a business, stock plans or an inheritance, it's vital that your interests be protected during the divorce process.

- Property Division

At Neal, Ashmore & Killebrew, it's important to us that your assets are protected and that your financial future is secure. We can provide the legal help you need regarding: Assets from family-owned businesses; Trusts; Investment accounts; Protecting assets; Inheritances and assets from estates; Hidden assets; Stocks and bonds; Pensions, IRAs and 401(k)s; Qualified domestic relations orders (QDROs); Marital debt; Mineral rights and drilling rights. While we work to identify, characterize and valuate assets and debt, our expert focuses on the specific financial issues involved in your divorce.

- Child Custody, Possession and Relocation

Our lawyers' experience and knowledge make us effective family law attorneys when helping clients in: Determining legal custody, physical custody and in establishing joint or sole child custody; Drafting parenting plans and determining visitation/possession rights; Matters regarding child relocation to other cities, states, and countries due to a host of factors not the least of which are re-marriage and employment changes; Dealing with issues of parental alienation and loss of both quality and actual time with a child during his or her growing-up years; Drafting and reviewing child support agreements that protect your interests and are in the best interests of your child; Parents' rights issues relating to lifestyle or differences in raising children in today's world; Modifying or enforcing divorce decrees; Establishing joint or sole child custody; Determining visitation/possession rights; Establishing grandparents' rights.

- Agreed/Uncontested Divorce

We provide guidance to clients throughout the uncontested divorce process. Our services include:
Drafting and filing the divorce petition; Filing the waiver of citation to show the court that the other party does not need to be served a copy of the divorce papers; Advising regarding the financial and child-related issues involved in your divorce; Negotiating, drafting and filing qualified domestic relations orders (QDROs), as needed; Representing you at your uncontested divorce hearing. In Texas, there is a mandatory waiting period of 60 days from the date of filing the petition for divorce and entry of the Waiver of Service before a Court will grant your divorce.

- Modification and Enforcement
Visitation and enforcement

As your life, your former spouse's life and the life of your child change, certain terms of your divorce agreement may need to be revisited and changed. Divorce decrees reflect your circumstances at the time of your divorce. They do not predict the future. At Neal, Ashmore & Killebrew, our attorneys have helped hundreds of clients modify: Child custody arrangements; Spousal support and child support amounts; Visitation rights; Property division terms. In addition to handling modifications, we handle the enforcement of existing child support, child custody, spousal support and property division decrees.

- Certified Divorce Financial Planning Expert

The family law firm of Neal, Ashmore & Killebrew (NAK) uses the services of a financial expert with specific training and experience in divorce to provide our clients with valuable information and to reduce overall divorce fees. While the financial expert focuses on the financial issues involved in your divorce, your attorney will have more time to focus on the legal issues at hand. A financial expert is valuable in all cases, from high net worth divorces to divorces involving few assets. An experienced divorce lawyer, along with a recommended divorce financial planner, can advise you regarding any financial component of your divorce.

- Premarital and Post-Marital Agreements

You may be wondering whether a prenuptial agreement or a post marital agreement is right for your situation. At Neal, Ashmore & Killebrew, our lawyers take the time to listen to your concerns and can help you determine whether a prenuptial agreement is appropriate. We can help you articulate your short-term and long-term financial goals. Some clients choose to draft a will and plan their estate instead of or in addition to documenting their assets through a prenuptial agreement. Our firm's caring, sensitive and knowledgeable participation in your prenuptial agreement can help ensure that it will be accepted and enforceable down the road.

- Adoptions

Adoption laws can be confusing and complex and one mistake can cost you far more than money, especially in the case of international adoptions of babies or children. It is wise to retain the services of a family law attorney knowledgeable and capable of guiding clients through adoption, including: Grandparent adoption; Stepparent adoption; Domestic adoption; International adoption; Surrogacy agreements and assisted reproduction; Open or closed adoption; Private or agency adoption. Many of our clients have waited a long time to have a child. Whether you are seeking a private or an agency adoption, an open or closed adoption, make sure that you protect your rights as the adoptive parent.

We offer comprehensive wills, trusts and estate planning legal services. Our guidance helps clients at all stages of life and at all levels of wealth.
