Practice Areas

Practice Areas Description

At Neil Flaxman, P.A., we represent employees and labor unions involved in the following matters:

- Labor Law

We represent labor unions throughout South Florida in contract negotiations, labor disputes, and Employee Retirement Income Security Act (ERISA) matters. For the past 44 years, our firm's founding attorney has fought hard for the rights of employees in disputes with their employers. One of the differences between employment law and labor law centers on what laws govern the relationship between your employer and you. Most labor law issues involve the National Labor Relations Board (NLRB). This independent government body is authorized to investigate and settle disputes related to unions and unfair labor practices. Some of the labor law issues we advise people about relate to: Severance negotiations; Contract Negotiations, including Non-compete agreements; Grievances and Lawsuits; Violations of the Fair Labor Standards Act.

- Employment Law

Given the realities faced by businesses today, it is essential that a legal dispute does not detract from your profits. The success of your business may depend on your ability to remain in compliance with federal and state employment laws. We have represented both employees and employers in all types of employment litigation. If you have a question about any of the following, feel free to speak to us about your case involving: Severance Package; Non-compete Agreement; Wrongful Termination; Retaliatory Discharge; Overtime Pay; Sexual Harassment and Discrimination Defense; Whistleblower Claims; Labor Law.

- Employee Rights

Every employee deserves to be treated fairly by his or her employer. Despite the presence of numerous types of federal and state protections, many employers still consistently violate employment laws. If your rights as a worker have been violated, hire a lawyer to represent you. In most cases, overtime pay is mandated even if you are on a salary and non-exempt. For some employers, the fear of litigation does not dissuade them from behaving inappropriately. Our firm will stand up and fight against violations of state and federal employment and overtime laws. There are many ways that an employer can violate the law, some of the more common disputes involving the following: Retaliatory Discharge; Overtime; Whistleblower Claims; Non-compete Agreements; Severance Packages; Discrimination. You must act quickly to preserve your right to file a claim against an employer who violated an employment or overtime law.

- Exceptions to At-Will

Most employment agreements are at will. This means you can leave your job at any time. It also means that your employer may fire you at any time. While employers may believe that they can fire you at will, there are exceptions to the general principle. Our firm will review your termination to determine if it was done legally. We also review severance packages to determine if they are fair.

- Administrative Law (Licensure)

Professionals often spend years securing the necessary education and credentials to obtain licensing or certification. If your license or certification is in jeopardy, your career and professional reputation may be at stake. It is important to work with an experienced lawyer to protect your future. Mr. Flaxman has more than 40 years of legal experience, including 20 years of experience handling administrative law matters and representing professionals in front of administrative licensure hearings. If your license or certification is at stake, come to our offices to discuss your concerns with an experienced administrative law attorney.

At the law firm of Neil Flaxman, we provide mediation services for businesses in Southern Florida.
