Practice Areas

Practice Areas Description

Nemeroff Law Offices represent many victims who are injured or killed by the negligence of others, such as:

- ATV Accidents

ATV vehicles are extremely popular recreational vehicle in Illinois. ATV vehicles are also known as all-terrain vehicles, quads, and four wheelers. These outdoor recreational vehicles can lead to serious injuries or even death. In 2006, 555 ATV-related deaths were reported to the U.S. Consumer Product Safety Commission. Over 100 children died in ATV accidents in 2006. The Consumer Product Safety Commission estimated that over 146,600 people were treated in emergency rooms for ATV-related accidents in 2006.

- Asbestos and Mesothelioma

Asbestos became popular among manufacturers and builders in the 19th century because of its insulating, sound absorption and its fire–retardant properties. Asbestos is a group of minerals that occur naturally as long strands of strong, flexible fibers that can be separated into thin threads and woven. In the US, a large number of people diagnosed with mesothelioma are linked to asbestos exposure.

- Automobile Accidents

One of the most frequent types of personal injury or wrongful death claims involves transportation either by automobile, truck, bus or train. In automobile litigation, States require residents to carry minimum vehicle liability insurance for their vehicles. If you are involved in an automobile accident and think you have a claim, it is best to first speak to an attorney before talking to the other parties, most importantly, insurance companies.

- Aviation and Airplane Crashes

Chicago aviation accident attorney David Nemeroff has years of experience helping Illinois transportation accident victims maximize their compensation. Nemeroff Law Offices represents clients in the Chicago, Illinois area who have suffered personal injuries or lost loved ones in aviation accidents.

- Bicycle Accidents

Bicycle riding is an extremely popular sport for all ages. Approximately 85 million American adults ride a bike at least occasionally. As a result of its increasing popularity, there about 540,000 bicyclists visit emergency rooms with injuries every year. Of those 540,000 about 67,000 arrive with head injuries, and about 27,000 have injuries serious enough to be hospitalized. 1 in 8 of the cyclists with reported injuries has a traumatic brain injury. Two–thirds of bicycle accident deaths are from traumatic brain injuries. Nemeroff Law Offices represents bike riders who are injured in collisions with motor vehicles.

- Birth Injury

A birth injury is harm caused to the baby before, during, or upon birth. There can be many different causes of birth injuries, from complications during pregnancy to problems during delivery. Some birth injuries can result from natural causes. In most cases, birth injuries are caused by errors, delays in treatment, miscalculations, and negligence of doctors, nurses and hospital staff, and other healthcare staff during the labor and delivery process.

- Boating Accidents

Illinois waterways are spectacular. And boating is a great way to enjoy our rivers and lakes. Operators of boats, however, like operators of cars, have a legal obligation to operate their watercraft in a safe manner. Unfortunately, the overwhelming majority of boating accidents are caused by factors that can be controlled by the operator of the boat. In 1998, for example, the primary cause of boating accidents nationwide was operator inattention, followed by careless/reckless operation, operator inexperience, operating at an unsafe speed, and failure to have a proper lookout.

- Brain Injury

Over 1.2 million people in the United States sustain a traumatic brain injury (TBI) every year. The severity of a TBI can range from a mild concussion to coma or even death. An overwhelming number of TBI cases result from preventable accidents.

- Burn Injury

Burns in the home or workplace are among the most common types of personal injury and among the most serious. Burn injuries are not only physically debilitating but can cause emotional and mental trauma as well. There are four main sources of burn injuries: heat, chemicals, electricity, and radiation. Burn injuries can range from the mild to the severe, including extreme cases that may cause death.

- Car Accident

One of the most frequent types of personal injury or wrongful death claims involves transportation either by automobile, truck, bus or train. In automobile litigation, States require residents to carry minimum vehicle liability insurance for their vehicles. If you are involved in an automobile accident and think you have a claim, it is best to first speak to an attorney before talking to the other parties, most importantly, insurance companies. It is also important that you seek immediate medical attention if you are seriously injured in an automobile accident.

- Catastrophic Injury

Suffering a catastrophic or serious injury is a life–altering event. Catastrophic injuries often include spinal cord injuries, brain injuries (TBI), or the loss of limbs, burns and multiple bone fractures. The majority of catastrophic injuries often occur as a result of traffic accidents, aviation and train accidents. Catastrophic injuries are widely associated with an impaired quality of life, and also come with a substantial loss of income.

- Cerebral Palsy

Over a half a million people in the United States are afflicted with cerebral palsy or CP. CP is commonly a result of a birth injury caused by negligence of a medical provider during the labor and delivery process. Cerebral palsy is a neurological disorder that affects muscle control, head control, walking, muscle tone, coordination, balance, and cognitive functioning. CP is the result of damage to specific areas of the brain that control those functions.

- Construction Accidents

Accidents on the job unfortunately occur when machinery, equipment or the workplace itself is unsafe. Workers and their families may sue on several tort theories of liability, including negligence and strict liability against general and sub-contractors and product manufacturers. Even though you may be receiving workers compensation benefits, you may also have a recovery for your injuries against a party other than your employer.

- Defective Drugs

Everyday new drugs are approved by the FDA and enter the marketplace. Many save patient lives and improve the patient’s quality of life. Unfortunately along with the benefits of pharmaceutical drugs come some inherent dangers. There are thousands of prescription drugs sold in the US every day. To date an unprecedented number of side effects both minor and major, ranging from mood disruptions to brain injury, heart attack and death has been reported. It may take months, even years, before a dangerous side effect manifests itself.

- Dog Bite Injuries

Dog attacks represent some of the most gruesome personal injuries that are suffered, particularly where a child is involved. During 1997 and 1998, at least 27 people died as the result of dog bite attacks in the United States. In 1994, roughly 4.7 million people in the United States were bitten by dogs. Children of small size may cause a dog to act in a dominant way toward a child. Many children's lack of judgment and ignorance about how to behave around a dog and their inability to fend off an attack can add to the risk. It is very important that parents closely supervise children when around dogs.

- Drunk Driving Accidents

Attorney David Nemeroff understands the heartache and suffering experienced by drunk driving victims. He became an attorney after suffering his own serious injuries when he was hit head-on by a drunk driver. David's own experience puts him in a unique position of truly understanding his client's experiences when seriously injured.

- Erbs Palsy

Erb's palsy is a condition that affects the upper limbs or brachial plexus of a newborn and may last through childhood and beyond, causing reduced sensation, impaired control or paralysis. The brachial plexus is where the neck joins the shoulder. Found in this area is a bundle or large network of nerves running from the spinal cord to the arms and shoulders.

- Failure to Diagnose

Cancer is a disease that can occur in virtually every part of the body. Every year thousands of Americans die from cancer. It has been medically proven that ddelay in treatment will affect survival rates and the quality of life that a patient experiences. Too often doctors fail to diagnose cancer early when the disease is still treatable. This type of error puts patients in danger of losing the option of early treatment, recovery and even remission.

- Food Poisoning

Food poisoning lawsuits involve complex legal issues and are best handled by attorneys who have expertise in the areas of food safety and foodborne illness. Foodborne illness also referred to as food poisoning is any illness resulting from the consumption of contaminated food.

- Injuries to Children

Everyday young children in Illinois are injured or killed because of the actions of other people or corporations. Over 2,000 children are killed in accidents or die from an unintentional injury every day. And every year tens of millions of children are left with life–long disabilities.

- Medical Malpractice

A 1999 study by the Institute of Medicine, which is part of the National Academy of Sciences, estimated 44,000 to 98,000 hospital patients in the U.S. die each year from medical malpractice. That's 268 deaths per day. This far exceeds the number of people killed in traffic accidents per year (43,450), or those who die yearly from breast cancer (42,300) or AIDS (16,400). In addition to death, medical mistakes can cause birth trauma, brain injury, paralysis, amputation, disability, and disfigurement.

- Medication Errors and Pharmacy Mistakes

Millions of Americans depend on medication daily for many different medical conditions. Unfortunately, medication errors occur, when this happens the consequences can be disastrous. Approximately 6,900 deaths and over 400,000 preventable drug-related injuries occur each year in hospitals alone.

- Motorcycle Accidents

In 2006, close to 5,000 people were killed in motorcycle accidents. Over seventy–five percent of reported motorcycle crashes result in serious injury versus twenty–five percent of automobile crashes. Motorcycle accidents often end in catastrophic injuries or death. Other injuries injuries suffered include broken bones and burns, limb amputations, road rash, facial fractures and disfigurement, spinal cord injuries, paralysis and Traumatic Brian Injuries (TBI) and death.

- Nursing Home Injuries

Negligence and mistreatment occur in almost every nursing home or nursing care facility in the United States. Nursing Home injuries occur in almost 43% of the U.S. population of nursing homes and/or elder care facilities. Every day, American families face difficult decisions about whether to move a loved one into a nursing home, and to trust their loved ones to nursing homes and/or elder care facilities. Understaffing, inadequate training and employees overworking themselves are just a few of the shortfalls that result in poor treatment of residents, causing injuries and/or death.

- Pedestrian and Crosswalk Accidents

In the US a pedestrian is injured in a car crash every eight minutes. Several thousands of pedestrians are killed and injured each year. You could have been crossing the street, walking your dog, or jogging on the side of the road when a driver didn't pay attention and hit you and caused serious injury or death. Iinjuries suffered as a result of these types of accidents can be severe and cause loss of normal life.

Inside a building, dangerous conditions such as torn carpeting, abrupt changes in flooring, poor lighting, narrow stairs or a wet floor can cause you to slip, trip and fall and injure yourself.

- Product Liability

All products on the market are required to meet certain safety standards. If someone suffers injury or death because a product they used was defective, or because its potential dangers or correct operating instructions were not adequately explained, the manufacturer may be found responsible and required to pay damages to the victim or his or her family.

- Traumatic Brain Injury

Over 1.2 million people in the United States sustain a traumatic brain injury (TBI) every year. The severity of a TBI can range from a mild concussion to coma or even death.

- Trucking Accidents

Accidents involving large trucks are among the most serious and most deadly in the United States. At Nemeroff Law Offices, we recognize that handling these cases requires a thorough understanding of commercial vehicle regulations on both the federal and state level. Trucking companies are required to follow Federal Motor Carrier Safety Regulations concerning their equipment. Failure to follow these regulations are commonly the cause of many of the truck accidents.

A wrongful death claim is a suit that arises from the death of an individual that was caused by the conduct of another. A wrongful death suit is different from other types of personal injury claims because the actual victim (the "decedent") is not bringing suit, rather it is the family members or the decedent's estate. What that generally means that a lawsuit that is filed when someone's wrongful conduct results in the death of another.
