- Bankruptcy

- Chapter 7 Bankruptcy

Chapter 7 is by far the most popular and recommended type of bankruptcy. About 70 percent of all bankruptcies are filed under Chapter 7 of the Bankruptcy Code. Chapter 7 affords you the opportunity to eliminate your unsecured debt like credit cards, medical bills, repos, lease termination fees, and taxes, while allowing you to keep all of your exempt assets like your home, car and personal household items.

- Chapter 13 Bankruptcy

Chapter 13 is often recommended if you are facing foreclosure of your home, have many valuable assets that you want to protect or your income exceeds certain minimum requirements. If you have a regular income, Chapter 13 provides a method for repaying your debts over a period of time according to a court-approved plan. Chapter 13 allows you to stop foreclosures and wage garnishments, catch up on past due mortgage payments, eliminate a second mortgage or home equity line of credit (HELOC), restructure your car loan and pay off your other debts according to your ability to pay.

- Chapter 11 Business Bankruptcy

Upon filing a Chapter 11, all lawsuits and other collection activities against the company are stopped immediately. The company is now afforded an opportunity to re-evaluate its business plan without the added pressure and expense of defending lawsuits. During this period, the company may secure new financing, eliminate unprofitable operations and terminate unfavorable contracts.
