Practice Areas Description

- Divorce

The end of a marriage is a stressful and uncertain time for everyone involved. There are many changes affecting your financial situation, living situation and your relationship with your children. We recognize the special importance of achieving satisfactory child custody arrangements. We strive for complete resolution of all issues, so you don't have to keep going back to court.

- Property Division

If you are facing a property division issue during divorce, the first thing you need to note is that Florida is known as an equitable distribution state. This means that all property and assets acquired during marriage — known as marital property — will be divided in an equitable manner. However, this does not necessarily mean that you and your spouse will each receive half of the marital property. When couples are unable to reach a settlement, the court will step in and determine the equitable distribution of marital property. For this reason, you need to seek knowledgeable representation that can determine what property should be divided and what is rightfully yours.

- Asset and Debt

If you are getting divorced, your property and assets must be divided. The basic standard in Florida is "equitable distribution." This describes what a court will do if you are unable to reach a settlement on your own. What many people overlook is that debts will be divided. Almost every couple has some type of debt, whether it be a mortgage, an auto loan, or credit card debt. The sad reality is that debt and financial problems are frequently a contributor to the breakup of a marriage.

- Marital Property

Depending on the extent of your assets, property division can be complicated. Florida law requires property division to be "equitable," or fair. And while what is divided is only marital property and not non-marital property, you need a strong advocate to clarify and assert that what is your own should not be part of the property that is divided.

- Marital Asset Protection

What ever happened during your marriage, the divorce process should be as fair as possible. Florida courts divide property equally unless grounds are shown to do otherwise. Aside from non-marital property which may include property or liabilities incurred prior to marriage all other property should be divided. Marital property is subject to equal division. A party found to be hiding assets is subject to sanctions. Contact us for more information.

- Parental Relocation

If a parent wishes to relocate with his or her minor child to a new residence 50 miles or more away from the current residence, the relocating parent must enter into a written agreement with the other parent, or obtain the court's permission. Parental relocation matters are specifically governed by statute. In these matters, it is necessary to seek a family law attorney who understands the relevant factors of your situation and can offer sound legal advice.

- Military Divorce

The divorce process can leave you feeling overwhelmed with emotion. Further complications can arise when you or your spouse is a member of the military. Matters with special relevance to the military, including being deployed to another country, transferring to an out-of-state military base, military compensation packages and pension plans, can make the divorce process more difficult for military members. Our attorneys at Pacheco Perez P.A. have experience dealing with these matters.

- Spousal Support

If you are considering divorce, you may also be entitled to alimony. Also known as spousal support, alimony can help you adjust to your new life without the financial support of your spouse. Unlike child support calculations where you have to use formulas and abide by strict guidelines, determining the amount of alimony you may receive depends on several factors .

- Prenuptial Agreement

Although a central idea of marriage is to have a life-long committed relationship, there are many reasons why relationships end in divorce. Carefully drafted prenuptial and postnuptial agreements can be important tools to protect valuable assets and property after divorce and to avoid complications in the future.

- Child Custody

The divorce process includes a variety of issues that spouses encounter concerning their future relationship with their children. As of October 2008, the words "custody" and "visitation" have been removed from Florida law and have been replaced with the terms "time-sharing" and "parental responsibility" to promote a sense of unity between spouses in raising the children.

- Modification

After obtaining a final court order during divorce in Florida, you have the right to make modifications if your situation is considered to be a "substantial change of circumstances." If you feel that your current situation is not meeting your needs or those of your family, consult with a family law attorney who can assist you in modifying a final court order.

- International Divorce

The international divorce process can add an element of complexity to divorce-related matters such as support and time-sharing. However, to file for divorce in Florida, a mandatory requirement is that you or your spouse must be a resident of Florida for at least six months. Regardless of whether your spouse lives overseas or you frequently travel internationally for work, couples can still pursue a divorce in Florida.

- Uncontested Divorce

When separating spouses are unwilling to make concessions or work together, bitter disputes and hostile negotiations often result. However, not all divorces end this way. Sometimes, divorce can be an amicable process, resolved quickly through mutual divorce agreement.

- Paternity

In the state of Florida a paternity action can facilitate the resolution of issues surrounding visitation, custody and child support. At Pacheco Perez P.A., we represent both fathers and mothers with paternity issues. Both parties have a lot to gain from an equitable resolution to their paternity case, and our lawyers will help you seek a positive outcome with as little frustration as possible. Informal visitation agreements and child support plans may seem appealing at first, but our experience has shown that if they are not legally binding, they can cause as much frustration as they are expected to alleviate. We will communicate with you about your unique goals and circumstances and help you resolve your case quickly and efficiently.

- Child Support and Alimony

Child support in the state of Florida is determined by child support guidelines that account for the incomes of both parents. Although these guidelines are strict, they can be modified if either party's income changes significantly.

- Domestic Violence

If you have been served with a restraining order or plan to petition for a restraining order for domestic violence, the attorneys of Pacheco Perez P.A. can skillfully represent you. With offices in Miami, we represent clients throughout Miami-Dade County. Contact our office today for a confidential consultation regarding your domestic violence case.
